Based on a review of this permit file by the Raleigh Regional Office, the Division is hereby forwarding the following modification to the subject permit. This permit modification is issued to delete chronic toxicity testing from the effluent page and Part III Conditions page. Please insert the enclosed effluent pages and Part III Conditions page and discard the old effluent pages and Part III Conditions page. This permit modification becomes effective immediately. All other terms and conditions in the original permit remain unchanged and in full effect. These modifications are issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency dated December 6, 1983. If any parts, measurement frequencies or sampling requirements contained in this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604. Nutrient Condition for Permits Without Phosphorus Limits This permit may be modified, or revoked and reissued to include an effluent limitation on nutrients for this discharge depending upon the following: 1. The findings of a study by the Division of Water Quality determine nutrient control is necessary. 2. Local actions do not successfully reduce the nutrient loading on the receiving waters. 3. The onset Of problem conditions in the receiving waters.
