Talton, Mayor Town of Mount Olive PO Box 939 Mount Olive, NC 28365-0939 SUBJECT: NOTICE OF VIOLATION & INTENT TO ASSESS CIVIL PENALTY Tracking Number: NOV-2021-DV-0191 Sanitary Sewer Overflows — March 2021 SOC EMC WQ S20-002 Collection System Permit No. WQCS00129 Mount Olive Collection System Wayne County Dear Honorable Talton: The self -reported Sanitary Sewer Overflow (SSO) 5-Day Report submitted by Town of Mount Olive indicates violations of permit conditions stipulated in the subject permit and North Carolina G.S. 143-215.1. Violations include failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the land or surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required. Paragraph 4 of the Consent Order states in part that the stipulated penalties are not due if the Town satisfies the Division that on -compliance was caused by events or circumstances beyond the Town's control as outlined in the SOC. If you have justification that this violation was caused by events or circumstances beyond the Town's control, you must reply in writing to the Washington Regional Office within ten (10) days after receipt of this Notice. Your justification will be reviewed, and a recommendation forwarded to the Director for their consideration. In the absence of such justification, this Office shall proceed with recommendations that the Director demand payment of the stipulated penalty as included in the Consent Order.
