Therefore, in accordance with the request submitted by your Authorized Representative [Matt Bramblett of Hart & Hickman}, CoC NCG510438 is rescinded, effective immediately. If in the future your company wishes to discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. Discharge of wastewater without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. North Carolina Administrative Code (15A NCAC 2H.0105(e)) requires that an application for permit renewal be filed at least 180 days prior to expiration of the current permit. To satisfy this requirement, your renewal package should have been sent to the Division postmarked no later than April 3, 2006. The Division has not received a renewal request for the subject CoC. This is a violation of your permit at Part II. B. 10, which states "Any permittee that has not requested renewal at least 180 days prior to expiration...will subject the permittee to enforcement procedures as provided in NCGS 143-215.6 and 33 USC 1251 et. seq.". To prevent an assessment of civil penalties you must submit a completed permit application (see enclosed forms) no later than June 19, 2006. If the system is inactive due to lack of trust fund payments, but the remediation equipment is still on site, the CoC should be renewed. Location, of Nearest Dwelling: A mobile home park is approximately 200 feet east of the site. 10. Receiving Stream or Affected Surface Waters: Toby Creek a. Classification: C b. River Basin and Subbasin No.: Yadkin 03-07-11 c. Describe receiving stream features and pertinent downstream uses: The outfall is located in the upper headwaters of Toby Creek. At the time of the site visit, a light rain had been falling for several hours prior to inspecting the channel, The wetted channel cross-section was approximately 2-5 feet wide and 1-2 inches deep. The total channel width was very wide (15-30 feet) and highly braided. The channel substrate was a white silty sand. The stream was buffered on both sides by an undisturbed wooded buffer of approximately 30-75 feet. No crawfish or fish were observed, but a 4 inch salamander was uncovered. While minimal flow was observed at the time of the site visit, the breadth of the channel indicates that the stream may receive significant runoff during storm events. The stream is within the City of Charlotte and the downstream area is moderately developed with business and residential properties. PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS a. Volume of Wastewater (Actual flow from DMRs): 0.0003 MGD b. What is the current permitted capacity: 0.0043 MGD c. Current design capacity: 5 gpm => 0.0072 MGD d. Description of existing or substantially constructed WWT facilities: The existing WWT facilities consist of an oil/water separator, a coarse sediment filter, air stripper unit, and two activated carbon canisters connected in series. g. Description of proposed WWT facilities: N/A Possible toxic impacts to surface waters: Some of the groundwater contaminants being treated are toxic; however, the facility has not exceeded any limits during its operation. h. Residual handling and utilization/disposal scheme: Spent carbon is collected by CETCO [Telephone ti (800)256-8466] and analyzed for hazardous substances. Other disposal options: N/A PART IV - EVALUATION AND RECOMMENDATIONS The permittee has applied for renewal of the existing NPDES permit. The NPDES permit is required in order to operate a groundwater remediation system. Since high contaminant levels remain in the groundwater and water supply wells continue to operate in the area, the permittee is required by the underground storage tank (UST) section to maintain treatment at the facility. Upon review of the existing permit and associated DMRs, this Office believes that the monitoring requirements in the permit should be modified. Recommended modifications are listed below: 1) Remove Oil & Grease from the permit — Oil and Grease is not a good indicator of contaminants associated with the petroleum hydrocarbon release. 2) Remove Iron & Manganese from the permit — No permit limits were established for either pararneter, and Iron has been well below the water quality standard listed in 2B. Iron and Manganese are not associated with petroleum contamination. 3) Reevaluate permit limits — An April 8, 1999 Memo (copy attached) recommends that the perrnit limits be reevaluated. Signatureof Report Preparer h;\nd\detree.d€a Date DIVISION OF WATER QUALITY April 8, 1999 MEMORANDUM TO: Dave Goodrich FROM: --)D, Rex Gleason PREPARED BY: Richard Bridgeman SUBJECT: Davey Tree Expert Company NPDES No, NC0085316 Mecklenburg County On 7 April the writer and Jackie Nowell had a telephone conversation concerning the subject permit; she suggested that you be alerted to possible problems with the perrni The subject wastewater treatment facility is for groundwater (gasoline and possibly diesel) remediation. The permit was issued on April 29, 199ta, and is scheduled to expire on September 30, 1999. If a renewal application has been submitted, it is not yet reflected on the "NIT' screen. The specified discharge point is near the head of Toby Creek, a Class C water in the Yadkin -Pee Dee River Basin. Even the map included in the permit shows Toby Creek at the discharge point to have an intermittent flow; yet the permit daily maximum limits for benzene, 1,2-dichloroethane, and 1,1,2,2-ttetrachioroethane are 3665.3 ug/1, 5082.1 ugll, and 554.4 uull, respectively. Even toluene had a daily maximum limit of 564.9 ug/l in the draft permit, but the limit was later modified to 11.0 ugll. Neither the MRO or the NPDES Unit files (according to Jackie) include information concerning how the permit limits were developed. The subject wastewater treatment facility is for groundwater (gasoline and possibly diesel) rez zediation. The permit was issued on April 29, 16, and is scheduled toexpireo September 30, 1999. If a renewal application has been submitted, it is not yet reflected on the ' screed. The specified discharge point is near die head of Toby creek, a Class C water in the Yadkin -Pee Dee Rives Basin. The groundwater has been contaminated with gasoline (and possibly diesel fuel) due to the leakage of three (3) underground storage tanks (2 gasoline tanks and 1 diesel fuel tank in the same pit). Recovered groundwater will be treated via a proposed remediation facility prior to discharging to a drainage ditch that enters an unnamed tributary to Toby Creek. Since similar discharges have been shown to be toxic, a toxicity limit and/or monitoring may be necessary. Since the proposed facility is located in the Charlotte- Mecklenburg area, the applicant may need approval from the Mecklenburg County Department of Environmental Protection (MCDEP) for possible air emissions. A copy of the Notice of Intent for the permit is contained in Appendix I. The anticipated groundwater treatment facility will consist of two pneumatic groundwater pumps, transferring free product and dissolved phase gasoline contaminated ground water into an oil/water separator at a combined rate of approximately 3 gallons per minute. Free product skimmed off in the oil/water separator will be stored in a 200 gallon steel tank with a high level alarm and system shut down switch. Dissolved phase gasoline and water from the oil/water separator will flow by gravity into a 250 gallon surge tank. From the surge tank, the dissolved phase liquid will be pumped through a multi -stage low profile air diffuser. The BTEX compounds will be removed to anticipated concentrations of less than 1.0 part per billion in the diffuser. The diffuser effluent will be pumped through two activated carbon columns in series. The effluent from the carbon columns will then be discharged to the environment. We expected that the activated carbon will remove any MTBE, IPE, and napthalene (or other less volatile compounds) not previously removed to below acceptable limits by the air diffuser. The groundwater treatment facility will incorporate several safety devices to insure that untreated water is not discharged into the environment. A high level switch in the free product storage tank will shut the plant down if the free product level in the storage tank rises above a safe level, The surge tank ahead of the air diffuser will also be equipped with high and low level shutdown switches. Likewise, a shutdown switch in the air line to the well pumps will prevent too much liquid from reaching the oil/water separator. A pressure activated safety switch on the blower to the air diffuser will shut the plant down in case of blower failure. By regular monitoring the Froehling & Robertson.. in, effluent from the first carbon column, the carbon consumption will be predicted well in advance of breakthrough so that the carbon columns can be changed as required. Local power failure to the recovery plant will automatically shut all systems down. When power is restored, all systems will re -activate and the safety devices will again monitor the recovery plant's components. Prior to the initial system discharge, F&R Will measure the effluent to assure adequate system operation. Please refer to the drawings and diagrams in Appendix III for the proposed location of the recovery plant, effluent discharge location, treatment system schematics, and well diagrams, F&R has considered several discharge options for the groundwater treatment facility. Our decision to apply for an NPDES permit for this site was based on the following: A. Mecklenburg County no longer issues POTW permits for groundwater treatment facilities. B. The soil at the site has a low permeability rate (4x 10-7cmisec). An infiltration gallery using a non -discharge permit for the effluent appears impractical based on the ]ow permeability rate. C. Space at the site for a spray irrigation system is restricted due to parking requirements of Davey Tree's equipment and service vehicles. We have attached manufacturer's calculations on the diffuser and carbon performance as well as data on other system components in Appendix IV. F&R trusts that the foregoing information and attachments will be sufficient for this application. (F&R) is pleased to present a Monthly Monitoring and Effluent Report for the Davey Tree Expert Company's site in Mecklenburg County, North Carolina. The remedial system has been in operation for approximately fourteen months. The groundwater pump and treat system (GWPTS) operated normally during the month of September, 1997 except for the occasional malfunction of various float switches and a tripped breaker on the air compressor electrical panel. A larger breaker was installed on the air compressor on September 15, 1997 and one float switch was replaced in the stripper on September 19, 1997. This constitutes one (1) failure to monitor effluent Lead. As reported in the original NPDES Permit and the reissued NPDES Permit (September 26, 2001), if Lead is detected less than or equal to 25.0 )1g/L during eight consecutive sampling events, then Lead monitoring is no longer required and may be discontinued for the remainder of the permit term. Between July 23, 1998, and April 7, 1999, Lead was detected less than or equal to 25.0 µg/L for eight consecutive sampling events. Therefore, Lead monitoring was discontinued in May 1999. A new general permit was issued by the Division of Water Quality and became effective on October I, 2001. The portion of the facility associated with the NPDES treatment works and discharge consists of a groundwater remediation system (GWRS) with 4 recovery wells, oil/water separator, 2 holding tanks, air stripper column, 2 sediment filter units in parallel, 2 carbon filter units in series, and a non -recording totalizer effluent flow meter. The facility also utilizes a catalytic oxidizer to treat volatiles collected from the air stripper column. The treated volatiles are released as air emissions under an approved air quality perronit. ATC Associates of Raleigh, NC operates the facility. The ORC of this unclassified facility holds a grade I Wastewater Certification, FACILITY SITE REVIEW: The faciliry discharges to a storm sewer system which ultimately discharges to an. unnamed tributary to McAlpine Creek, which a Class C water in the Catawba River Basin. The groundwater remediation system has been down since December 2001 because of a problem with the air compressor. The ORC indicates that the air compressor will be replaced by June 2002. It is recommended that a 24-hour notification sign be placed on the building that houses the GWRS. RECORDS/REPORTS: Detailed records, logs and reports are maintained for the facility. Laboratory reports and chain of custody forms appeared to be properly completed. The system encountered some down time during the review period. No monitoring was conducted during the month of December. All records and reports reviewed appeared to be well maintained; no discrepancies were noted. FLOW MEASUREMENT: Flow measurement is accomplished using a non -recording totalizer flow meter on the effluent discharge line. Since the discharge from the facility is not continuous, this method of flow measurement is acceptable, There was no documentation of flow meter calibration. LABORATORY: Analysis of the effluent samples is performed by the Hygeia Laboratories, Inc. Hygeia. Laboratories hold North Carolina Certification No. 409 and was not evaluated under this inspection. The system encountered some down time in January, February, April, May, and October 2000; therefore, no monitoring was completed during these months. All records and reports reviewed appeared to be well maintained; no discrepancies were noted. FACILITY SITE REVIEW: The facility discharges to a storm sewer system which ultimately discharges to an unnamed tributary to McAlpine Creek, which is a Class C water in the Catawba River Basin. All of the major components of the facility were in service and appeared to be operating properly at the time of the inspection. The effluent discharge to the storm sewer system was clear. The ORC visits the site twice per month and completes sampling once a month. FLOW MEASUREMENT: Part I. Section A.1 of the facility NPDES permit requires continuous recording flow measurement at the effluent if the discharge is continuous or a weekly instantaneous flow estirnate if the discharge is not continuous. Flow measurement is accomplished using a non -recording totalizer flow meter on the effluent discharge line. Since the discharge from the facility is not continuous, this method of flow measurement is acceptable. There was no documentation of flow meter calibration. LABORATORY: Analysis of effluent samples is performed by Hygeia Laboratories, Inc. Hygeia Laboratories hold North Carolina Certification No. 409 and was not evaluated under this inspection. EFFLUENT/RECEIVING WATERS: The groundwater remediation system was operational at the time of the inspection and the effluent was clear. No petroleum sheens or odors were noted in the effluent. SELF -MONITORING PROGRAM: Laboratory analysis reports were reviewed for the period January 2000 through December 2000. The groundwater remediation system encountered some down time in January, February, April, May, and October 2000, during which there was no discharge; therefore, no monitoring was completed during these months. The reports indicate that the facility was in compliance with permit effluent limits at the times of sampling. Self -monitoring is conducted monthly as required by the permit. OPERATIONS & MAINTENANCE: The facility and site appeared to be properly operated and maintained. ATC completes all routine maintenance and repairs of the system. The current overall operating strategy of the ORC appears acceptable for the size and type of the facility. The facility maintains an adequate inventory of supplies and spare parts necessary for proper operation of the site. The facility operates on automatic controls and is routinely checked by ATC personnel twice per month. Circle K store employees are on -site daily and can alert the ORC if emergency problems occur with the system.
