Division staff has confirmed that the subject Certificate of Coverage [issued under NPDES
General Permit NCG510000] is no longer required. Therefore, in accordance with the request
submitted by your Authorized Representative [Matt Bramblett of Hart & Hickman}, CoC
NCG510438 is rescinded, effective immediately.
If in the future your company wishes to discharge to the State's surface waters, you must first
apply for and receive a new NPDES permit. Discharge of wastewater without a valid NPDES
permit will subject the responsible party to a civil penalty of up to $25,000 per day.

NPDES General Permit NCG510000, under which the subject facility is covered, expires on
September 30, 2006. North Carolina Administrative Code (15A NCAC 2H.0105(e)) requires that an
application for permit renewal be filed at least 180 days prior to expiration of the current permit. To satisfy
this requirement, your renewal package should have been sent to the Division postmarked no later than
April 3, 2006.
The Division has not received a renewal request for the subject CoC. This is a violation of your
permit at Part II. B. 10, which states "Any permittee that has not requested renewal at least 180 days prior
to expiration...will subject the permittee to enforcement procedures as provided in NCGS 143-215.6 and 33
USC 1251 et. seq.".
To prevent an assessment of civil penalties you must submit a completed permit application (see
enclosed forms) no later than June 19, 2006. If the system is inactive due to lack of trust fund payments,
but the remediation equipment is still on site, the CoC should be renewed.

9. Location, of Nearest Dwelling: A mobile home park is approximately 200 feet east of the
site.
10. Receiving Stream or Affected Surface Waters: Toby Creek
a. Classification: C
b. River Basin and Subbasin No.: Yadkin 03-07-11
c. Describe receiving stream features and pertinent downstream uses: The outfall is
located in the upper headwaters of Toby Creek. At the time of the site visit, a
light rain had been falling for several hours prior to inspecting the channel, The
wetted channel cross-section was approximately 2-5 feet wide and 1-2 inches
deep. The total channel width was very wide (15-30 feet) and highly braided.
The channel substrate was a white silty sand. The stream was buffered on both
sides by an undisturbed wooded buffer of approximately 30-75 feet. No crawfish
or fish were observed, but a 4 inch salamander was uncovered. While minimal
flow was observed at the time of the site visit, the breadth of the channel indicates
that the stream may receive significant runoff during storm events. The stream is
within the City of Charlotte and the downstream area is moderately developed
with business and residential properties.
PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS

WWT facilities consist of an oil/water separator, a coarse sediment filter, air
stripper unit, and two activated carbon canisters connected in series.

Possible toxic impacts to surface waters: Some of the groundwater contaminants
being treated are toxic; however, the facility has not exceeded any limits during its
operation.

PART IV - EVALUATION AND RECOMMENDATIONS
The permittee has applied for renewal of the existing NPDES permit. The NPDES permit
is required in order to operate a groundwater remediation system. Since high contaminant levels
remain in the groundwater and water supply wells continue to operate in the area, the permittee is
required by the underground storage tank (UST) section to maintain treatment at the facility.
Upon review of the existing permit and associated DMRs, this Office believes that the
monitoring requirements in the permit should be modified. Recommended modifications are
listed below:
1) Remove Oil & Grease from the permit — Oil and Grease is not a good indicator of
contaminants associated with the petroleum hydrocarbon release.
2) Remove Iron & Manganese from the permit — No permit limits were established for
either pararneter, and Iron has been well below the water quality standard listed in 2B.
Iron and Manganese are not associated with petroleum contamination.
3) Reevaluate permit limits — An April 8, 1999 Memo (copy attached) recommends that
the perrnit limits be reevaluated. The following limits were identified in the memo:

subject permit; she suggested that you be alerted to possible problems with the perrni
The subject wastewater treatment facility is for groundwater (gasoline and possibly
diesel) remediation. The permit was issued on April 29, 199ta, and is scheduled to expire on
September 30, 1999. If a renewal application has been submitted, it is not yet reflected on the
"NIT' screen.
The specified discharge point is near the head of Toby Creek, a Class C water in the
Yadkin -Pee Dee River Basin. Even the map included in the permit shows Toby Creek at the
discharge point to have an intermittent flow; yet the permit daily maximum limits for benzene,
1,2-dichloroethane, and 1,1,2,2-ttetrachioroethane are 3665.3 ug/1, 5082.1 ugll, and 554.4 uull,
respectively. Even toluene had a daily maximum limit of 564.9 ug/l in the draft permit, but the
limit was later modified to 11.0 ugll. Neither the MRO or the NPDES Unit files (according to
Jackie) include information concerning how the permit limits were developed.
It is recommended that the limits in this permit be reevaluated in the upcamin

groundwater that has been contaminated with gasoline and
possibly diesel fuel.. Impact on the environment is expected
to be minimal.

PART IV - EVALUATION AND RECOMMENDATIONS
The Davey Tree Expert Company requests an NPDES Discharge
Permit for the discharge of treated groundwater from a proposed
groundwater remediation facility. The groundwater has been
contaminated with gasoline (and possibly diesel fuel) due to the
leakage of three (3) underground storage tanks (2 gasoline tanks
and 1 diesel fuel tank in the same pit). Recovered groundwater
will be treated via a proposed remediation facility prior to
discharging to a drainage ditch that enters an unnamed tributary to
Toby Creek. Since similar discharges have been shown to be toxic,
a toxicity limit and/or monitoring may be necessary.
Since the proposed facility is located in the Charlotte-
Mecklenburg area, the applicant may need approval from the
Mecklenburg County Department of Environmental Protection (MCDEP)
for possible air emissions.
Pending final review and concurrence by the SERG and MCDEP, it
is recommended that an NPDES Discharge Permit be issued to the
applicant as requested.

Dear Gentlemen:.
Please accept the attached application for a NPDES permit on behalf of our client, The Davey
Tree Expert Company. A copy of the Notice of Intent for the permit is contained in Appendix
I.
The anticipated groundwater treatment facility will consist of two pneumatic groundwater pumps,
transferring free product and dissolved phase gasoline contaminated ground water into an oil/water
separator at a combined rate of approximately 3 gallons per minute. Free product skimmed off
in the oil/water separator will be stored in a 200 gallon steel tank with a high level alarm and
system shut down switch. Dissolved phase gasoline and water from the oil/water separator will
flow by gravity into a 250 gallon surge tank. From the surge tank, the dissolved phase liquid will
be pumped through a multi -stage low profile air diffuser. The BTEX compounds will be removed
to anticipated concentrations of less than 1.0 part per billion in the diffuser. The diffuser effluent
will be pumped through two activated carbon columns in series. The effluent from the carbon
columns will then be discharged to the environment.
We expected that the activated carbon will remove any MTBE, IPE, and napthalene (or other less
volatile compounds) not previously removed to below acceptable limits by the air diffuser. A flow
meter and totalizing meter in the effluent line of the carbon columns will measure flow rate and
total flow, respectively, through the plant, and an influent flow meter will measure total fluids

flow. Sampling ports will be provided (1) in the influent line to the diffuser, (2) the influent line
to the first carbon column, (3) the influent line to the second carbon column, and (4) in the
effluent line ahead of the totalizing meter. The influent to the groundwater treatment facility is
expected to contain the following compounds, based on laboratory analyses performed August 14,
1995:

MTBE 2.600 ppb

A copy of the analytical results is contained in Appendix II.
The groundwater treatment facility will incorporate several safety devices to insure that untreated
water is not discharged into the environment. A high level switch in the free product storage tank
will shut the plant down if the free product level in the storage tank rises above a safe level, The
surge tank ahead of the air diffuser will also be equipped with high and low level shutdown
switches. Likewise, a shutdown switch in the air line to the well pumps will prevent too much
liquid from reaching the oil/water separator. A pressure activated safety switch on the blower to
the air diffuser will shut the plant down in case of blower failure. By regular monitoring the

effluent from the first carbon column, the carbon consumption will be predicted well in advance
of breakthrough so that the carbon columns can be changed as required. Local power failure to
the recovery plant will automatically shut all systems down. When power is restored, all systems
will re -activate and the safety devices will again monitor the recovery plant's components. Prior
to the initial system discharge, F&R Will measure the effluent to assure adequate system operation.
Please refer to the drawings and diagrams in Appendix III for the proposed location of the
recovery plant, effluent discharge location, treatment system schematics, and well diagrams,
F&R has considered several discharge options for the groundwater treatment facility. Our
decision to apply for an NPDES permit for this site was based on the following:
A. Mecklenburg County no longer issues POTW permits for groundwater treatment
facilities.
B. The soil at the site has a low permeability rate (4x 10-7cmisec). An infiltration
gallery using a non -discharge permit for the effluent appears impractical based on
the ]ow permeability rate.
C. Space at the site for a spray irrigation system is restricted due to parking
requirements of Davey Tree's equipment and service vehicles.
We have attached manufacturer's calculations on the diffuser and carbon performance as well as
data on other system components in Appendix IV. F&R trusts that the foregoing information
and attachments will be sufficient for this application. We also respectfully request that the
Permits and Engineering Section allow us to apply for the Permit To Construct concurrently with
the NPDES permit application.

Dear Permittee:
The subject permit expires on September 30, 1999. North Carolina General Stature 143.215.1(c) requires that an
application for permit renewal be filed at least 180 days prior to the expiration date.
To satisfy this requirement, your renewal package must be sent to the Division postmarked no later than April 3,
1999. Failure to request renewal by April 3, 1999 will result in a civil assessment of at least $250,00. Larger
penalties may be assessed depending upon the delinquency of the request.
If any wastewater discharge will occur after September 30, 1999 (or if continuation of the permit is desired), the
permit must not be allowed to expire. Operation of waste treatment works or continuation of a discharge after
September 30, 1999 would violate NCGS 143-215.1 and could result in assessment of civil penalties of up to $10,000
per day.
If all wastewater discharge has ceased at the subject facility and you wish to rescind this permit, contact Robert
Farmer of the Division's Compliance Enforcement Unit at [phone], extension 531. You may also contact the
Mooresville Regional Office at [phone] to begin the rescission process.

A cover letter requesting the renewal and documenting any changes at the facility
since issuance of the last permit. Submit one signed original and two copies.
The completed application form (copy attached), signed by the permittee or an
Authorized Representative. Submit one signed original and two copies.
If an Authorized Representative is preparing the renewal package, documentation
must be provided from the permittee defining the person or company preparing the
renewal package as an Authorized Representative (see Part II.B.11.b. of the
current NPDES permit).
A narrative description of the sludge management plan at the subject facility. If
your facility has no sludge management plan, explain the reason for this in your
cover letter. Submit one original and two copies.

Reference is made to your request to rescind the subject NPDES Permit, A phone
call from Sarn Phifer, indicated that while city sewer was available for domestic sewage at
this facility, the groundwater remediation wastewater was not accepted by the City of
Charlotte. Therefore, the facility still requires the NPDES Permit to discharge
groundwater remediation wastewater. Mr. Phifer understands that the permit fee Invoice
was signed by mistake and that the fee will still need to be paid. Therefore, the Division
of Water Quality is returning the DAVEY TREE EXPERT COMPANY's request to
rescind the subject permit. Your request to rescind this permit is being cancelled.
The portion of the Invoice that was signed is also being returned to you. It is
important for you to pay the fee as soon as possible to avoid being issued a Notice of
Violation for late payment. Thank you for your attention to this matter.
Failure to pay this permit fee will initiate permit revocation proceedings.
Please be aware that operating a wastewater treatment works without a valid NPDES
Permit will subject the facility to a civil penalty of up to $10,000 per day.

Froehling & Robertson, Inc. (F&R) is pleased to present a Monthly Monitoring and Effluent
Report for the Davey Tree Expert Company's site in Mecklenburg County, North Carolina. The
remedial system has been in operation for approximately fourteen months.
The groundwater pump and treat system (GWPTS) operated normally during the month of
September, 1997 except for the occasional malfunction of various float switches and a tripped
breaker on the air compressor electrical panel. A larger breaker was installed on the air
compressor on September 15, 1997 and one float switch was replaced in the stripper on
September 19, 1997. During the period from August 29, 1997 to September 30, 1997, the
GWPTS treated approximately 4,085 gallons of petroleum impacted groundwater for an average
of approximately 9.08 gallons per minute (gP)reflects 12 uthe veryllion lons per day. We low flow of groundw�ater

Based on the laboratory results of the effluent sample from the GWPTS, it appears that the
system is operating within the NPDES permit requirements. A copy of the laboratory report,

In accordance with your application for an NPDES discharge permitreceived on March 14, 1994
by the Division, we are herewith forwarding the subject Certificate of Coverage under the state-NPDES
general permit for a groundwater treatment system and one set of final approved plans and specifications.
Authorization is hereby granted for the construction and operation of a groundwater treatment system with.
discharge of treated wastewater into an unnamed tributary to McAlpine Creek. This Certificate of
Coverage is issued pursuant to the requirements of North Carolina and the US Environmental Protection
Agency Memorandum of Agreement dated December 6, 1983 and as subsequently amended.
If any parts. measurement frequencies or sampling requirements contained in this general permit
are unacceptable to you, you have the right to submit an individual permit application and letter requesting
coverage under an individual permit. Unless such demand is made, this decision shall be final and
binding. Please take notice this permit is not transferable. Part II, E.4. addresses the requirements to be
followed in case of change of ownership or control of this discharge.
The Authorization to Construct is issued in accordance with Part III, Paragraph 2 of NPDES
Permit No. NCG510000, and shall be subject to revocation unless the wastewater treatment facilities are
constructed in accordance with the conditions and limitations specified in Permit No. NCG510000.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee- shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Mooresville Regional Office, telephone number 704/663-1699, shall be notified at least forty-
eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.

In accordance with your application for permit renewal, the Division is forwarding the subject NPDES general
permit for petroleum contaminated groundwater remediation systems. This General Permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US .Environmental Protection Agency dated December 6, 1983 and as subsequently amended.
The Certificate of Coverage previously issued to your facility is now valid under the revised General Permit for
discharges associated with groundwater remediation systems (NCG510000 - issued August 22, 1996). The new General
Permit is more comprehensive, in that it covers remediation of groundwater contaminated with heavier fuels (such as
diesel, fuel oil, and kerosene) as well as gasoline contamination, Please note that the permit has three effluent
limitations pages. The type of contamination at your site (gasoline only, heavy fuels only, or gasoline and heavy
fuels) will determine the effluent limitations for your discharge.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you
have the right to request an individual permit by submitting an individual permit application. Please take notice
that the previously issued Certificate of Coverage is not transferable except after notice to the Division of Water
Quality. The Division of Water Quality may require modification or revocation and reissuance of the Certificate of
Coverage.

The facility listed above is covered under NPDES permit NCG510000 for discharge of remediated
groundwater. NCG510000 expires on September 30, 2006. Federal (40 CFR 122.41) and North Carolina (15A
NCAC 2H.0105(e)) regulations require that permit renewal applications must be filed at least 180 days prior
to expiration of the current permit. If you have already mailed your renewal request, you may
disregard this notice.
To satisfy this requirement, the Division must receive your renewal request postmarked no later than
April 3, 2006. Failure to request renewal by this date may result in a civil assessment of at least $500.00.
Larger penalties may be assessed depending upon the delinquency of the request.
If any discharge from the remediation system will occur after September 30, 2006, your CoC must be
renewed. Discharge of wastewater without a valid permit would violate North Carolina General Statute 143-
215.1,; unpermitted discharges of wastewater may be assessed civil penalties of up to $25,000 per day.
If you have halted remediation activity due to lack of trust fund money, but your site ranking from the
Aquifer Protection Section requires future remediation & discharge, your CoC must be renewed.

GENERAL:
The facility was last inspected by Mr. David Pier of the MCWQP on September 17.
2003. A Compliance Evaluation Inspection report was issued on October 10, 2003.
PERMIT:
The general permit issued by the Division of Water Quality bee effective on October
1, 2 1 and will expire on September 30, 2006.
The portion of the facility associated with the NPDES treatrnent works and discharge
consists of a groundwater remediation system (GWRS) with 4 recovery wells, oil/water
separator, 2 holding tanks, air stripper column, 2 sediment filter units in parallel, 2 carbon filter
units in series, and a non -recording totalizer effluent flow meter. The facility also utilizes a
catalytic oxidizer to treat volatiles collected from the air stripper coy The treated volatiles
are released as air emissions under an approved air quality permit.
ATC Associates of Raleigh, NC operates the facility, The ORC of this ud
facility does not hold any Wastewater Certification, which is acceptable.
FACILITY SITE REVIEW:
The facility discharges to a storm sewer system, which ultimately discharges to an
unnamed tributary to McAlpine Creek, a Class C water River Basin. The GWRS
was not in operation at the time of the inspection and has not been in operation for the past
twelve months. The GWRS has been in shutdown mode for over twelve months and no plans
have been made by the Aquifer Protection Section to resume operation.

and is visited on a bi-weekly basis by ATC. Circle K store employees are on -site daily and can

GENERAL:
The facility was last inspected by Mr. Derrick Harris of the MCWQP on April 24, 2002.
A Notice of Deficiency/Compliance Evaluation Inspection report was issued on July 25, 2002.
PERMIT:
The general permit issued by the Division of Water Quality became effective on October
1 , 2001 and will expire on September 30, 2006.
The portion of the facility associated with the NPDES treatment works and discharge
consists of a groundwater remediation system (GWRS) with 4 recovery wells, oil/water
separator, 2 holding tanks, air stripper column, 2 sediment filter units in parallel, 2 carbon filter
units in series, and a non -recording totalizer effluent flow meter. The facility also utilizes a
catalytic oxidizer to treat volatiles collected from the air stripper column. The treated volatiles
are released as air emissions under an approved air quality permit.
ATC Associates of Raleigh, NC operates the facility. The ORC of this unclassified
facility does not hold any Wastewater Certification, which is acceptable.
FACILITY SITE REVIEW:
The facility discharges to a storm sewer system, which ultimately discharges to an
unnamed tributary to McAlpine Creek, which a Class C. water in the Catawba River Basin, The
groundwater remediation system was not in operation at the time of the inspection because the
air compressor's electric motor was inoperable. The electric motor is scheduled for replacement
the week of April 28th and has been inoperable since the beginning of April. 2,003..
RECORDS/REPORTS:
Detailed records, logs and reports are maintained for the facility. All records and reports
reviewed appeared to be well maintained; no discrepancies were noted.
FLOW MEASUREMENT:
Flow measurement is accomplished using a non -recording totalizer flow meter on the
effluent discharge line. Because the discharge from the facility is not continuous, this method of
flow measurement is acceptable.
LABORATORY:
Analysis of the effluent samples is performed by the I- ygeia Laboratories, Inc. Hygeia
Laboratories hold North Carolina Certification No. 409 and was not evaluated under this
inspection.

OPERATIONS & MAI ENANCF:
The facility and site appeared to be properly operated and intained. AFC Associates
completes all routine rnainte ice and repairs to the system. A new air compressor was installed
by ATC in April of 2002. The current overall operating strategy of the ORC appears acceptable
for the size and t of facility The facility operates on automatic controls and is visited on a bi-
weekly basis by ATC. Circle K store employees are an -site ;laity and can alert the ORC if
problems occur with the system.

ATC Associates of North Carolina, P.C. (ATC), on behalf of Circle K Stores Inc., is responding
to the Notice of Deficiency (NOD) issued for Circle K Store #8382. The NOD was received on
August 2, 2002, concerning the Self -Monitoring Program for the groundwater treatment system
(GWTS). According to the findings, the following monitoring requirement violation was noted:
. One (1) failure to monitor Lead occurred in October 2001. This constitutes one (1)
failure to monitor effluent Lead.
As reported in the original NPDES Permit and the reissued NPDES Permit (September 26, 2001),
if Lead is detected less than or equal to 25.0 )1g/L during eight consecutive sampling events, then
Lead monitoring is no longer required and may be discontinued for the remainder of the permit
term. Between July 23, 1998, and April 7, 1999, Lead was detected less than or equal to 25.0
µg/L for eight consecutive sampling events. Therefore, Lead monitoring was discontinued in
May 1999.
Per our conversation on August 8, 2002, Darren England of the NCDWQ Raleigh Regional
Office verified that the renewal of Lead monitoring is not required for the reissued NPDES

with the air compressor. The ORC indicates that the air compressor will be replaced by June
2002.
It is recommended that a 24-hour notification sign be placed on the building that houses
the GWRS.

chain of custody forms appeared to be properly completed. The system encountered some down
time during the review period. No monitoring was conducted during the month of December.
All records and reports reviewed appeared to be well maintained; no discrepancies were noted.

Mecklenburg County Department of Environmental Protection (MCDEP). A Compliance
Evaluation Inspection Report was issued on April 12, 1999.
PERMIT:
The facility's permit expires on September 30, 2001. A request for permit renewal has
been submitted to the Division of Water Quality.
The portion of the facility associated with the NPDES treatment works and discharge
consists of a groundwater remediation system (GWRS) with 4 recovery wells, oil/water
separator, 2 holding tanks, air stripper column, 2 sediment filter units in parallel, 2 carbon filter

project manager for the facility. The ORC of this unclassified facility holds a Grade I

The permit properly describes the facility and appears adequate for the waste stream
being treated.
RECORDS/REPORTS:
Detailed records, logs and reports are maintained for the facility. Laboratory reports and
chain of custody forms appeared to be properly completed. The system encountered some down
time in January, February, April, May, and October 2000; therefore, no monitoring was
completed during these months. All records and reports reviewed appeared to be well
maintained; no discrepancies were noted.
FACILITY SITE REVIEW:
The facility discharges to a storm sewer system which ultimately discharges to an
unnamed tributary to McAlpine Creek, which is a Class C water in the Catawba River Basin.
All of the major components of the facility were in service and appeared to be operating
properly at the time of the inspection. The effluent discharge to the storm sewer system was
clear. The ORC visits the site twice per month and completes sampling once a month.
FLOW MEASUREMENT:
Part I. Section A.1 of the facility NPDES permit requires continuous recording flow
measurement at the effluent if the discharge is continuous or a weekly instantaneous flow
estirnate if the discharge is not continuous.
Flow measurement is accomplished using a non -recording totalizer flow meter on the
effluent discharge line. Since the discharge from the facility is not continuous, this method of
flow measurement is acceptable. There was no documentation of flow meter calibration.

LABORATORY:
Analysis of effluent samples is performed by Hygeia Laboratories, Inc. Hygeia
Laboratories hold North Carolina Certification No. 409 and was not evaluated under this
inspection.

effluent was clear. No petroleum sheens or odors were noted in the effluent.
SELF -MONITORING PROGRAM:
Laboratory analysis reports were reviewed for the period January 2000 through
December 2000. The groundwater remediation system encountered some down time in January,
February, April, May, and October 2000, during which there was no discharge; therefore, no
monitoring was completed during these months. The reports indicate that the facility was in
compliance with permit effluent limits at the times of sampling. Self -monitoring is conducted
monthly as required by the permit.
OPERATIONS & MAINTENANCE:
The facility and site appeared to be properly operated and maintained. ATC completes all
routine maintenance and repairs of the system. The current overall operating strategy of the ORC
appears acceptable for the size and type of the facility. The facility maintains an adequate
inventory of supplies and spare parts necessary for proper operation of the site. The facility
operates on automatic controls and is routinely checked by ATC personnel twice per month.
Circle K store employees are on -site daily and can alert the ORC if emergency problems occur
with the system.
