I'm writing, to update you on the statLIS of the MSAA of'Jacksonville's runotYpond. This
information is in response to the letter we received from you dated 1-28-2009.
The drainage pond was inspected by an engineer from John L. fierce and Associates in
May 2008. Please see that attached certification. The engineer was supposed to have sent
the permit application to the owner to be filled OLIt and SUbi-nitled, but the owner did not
receive it. We have asked John L. Pierce and Associates to resend the permit application
packet to Gary Wallace, CF0, who ~`works for the owner, the Multiple Sclerosis
Association of America. Once Mr. Wallace signs the permit package, Landura
Management Associates will write a check from N4SAA Suites' account For the permit
1-ee and send the package to the Division of Water Quality for processing.
We have requested the plans for the drainage pond so that we can begin the repairs or
placement of the vegetative filter and level spreader. These will be sent to Bill Ogburn at
Landura Management Associates so that we may begin planning the project and
obtaining bids from contractors.

I apologize for not having replied to your e-mail yet, despite having received my answer from Linda
soon after you asked it.
Modifying the permit to more accurately represent the current conditions is certainly an acceptable
solution. However, the outlet flow path will still require stabilizing as well since that is a permit
condition for all discharges.

have also been to the site (now on two occasions). First trip in summer, I was unable to access
the vegetated filter due to thick poison ivy and NUMEROUS cottonmouths (you need to be careful
when you do these inspections in the summer). During that visit, I also noted that the pond was
actually built quite a bit larger than the design requirements,
Second visit (last week) I was able to access the filter. It was constructed much like VERY much
like MOST built during that era .... minimal width and flow spreader long since deteriorated. As you
noted, the "filter' (swale) bottom is not very well vegetated.
The pond was originally designed by Fred Cone, PE who no longer practices in the private sector,
Yesterday, l was able to get a copy of the original calculations prepared by Mr. Cone. As reflected
in the permit, those calculations were based on 85% TSS removal....

Based upon my asbuiit measurements the pond actually contains approximately 2,635 sf (85' long
x 31' wide), substantially more than required by the permit. If fact, the pond contains enough
surface area that it meets the area requirements for 90%TSS removal (with no vegetated filter).....
SAIDA = 7.3 % (from 90% removal table)
SA = (26,055 sf) (.073)
= 1,902 SF required ---- 2,635 SF actually provided.
Therefore, it appears the pond, as constructed, would meet the 90% removal criteria, and perhaps
not require the vegetated filter.
My question is as follows...
In light of the fact that pond contains sufficient surface area, would it be possible to simply
re -permit this pond as a 90% removal facility, and avoid costly/disruptive repairs to the vegetated
filter?

Dear Pat:
I'm writing to update you on the status of the MSAA of Jacksonville's runoff pond. This
information is in response to the Notice of Inspection: Non -Compliance Status that
was sent to us July 23, 2007.
To date, we have applied for a new engineer's certification permit, since the previous one
expired in July, 2007. The owner is trying to find out when it will be approved. It
should be available for review once we get the signed copy sent to us.
The garbage/debris at the inlet and outlet has been removed. The landscaper monitors and
removes the debris once a month along with his regular landscaping duties.
The mowing ofthe pond slopes has been done. The slopes are usually mowed twice a
year, once in the spring and once in the fall_ The last mowing was November, 2007.
The trees have been trimmed and mimosa trees removed from the slopes. The "large
woody vegetation" has been cut clown and removed; see the enclosed Landscaper
statement from July 31, 2007. The drainage bypass can now be observed. The
vegetative filter strip is also now visible. We have not reseeded the slopes to date, but the
site manager will instruct the landscaper to reseed them with grass seed this spring.
The site manager will begin keeping a folder for pond area maintenance to be available
for review/inspections. Currently, she is putting the folder together with all the relevant
landscaped work orders that have been done in the last 6 months.

Subject: MSAA Jacksonville
This letter is in response to the recent inspection and letter of non-compliance
to MSAA Jacksonville's runoff pond and the property's Storm Water Permit
Number SW8970583 that was issued on 7/25/1997. Landura Management Associates
recently began managing this property and because of the recent letter received from you,
we are beginning to investigate and take action on what needs to be done to bring the
Property into compliance.
At this time, management has contacted the Department of I-nvirollment and
Natural Resources and is waiting on information to be mailed to us relating to the
renewal of the permit.
We are researching to find the copy of the signed Engineer's certification that
should be in the file.
The landscapers and caretakers are working oil mowing around the Mond and
picking up the trash around it. We will have them evaluate the large woody vegetation
around the pond to see what needs to be cut. Once the mowing and heavy vegetation is
removed, the spillway/bypass should be able to be located and the filter should be more
accessible to evaluate operational status. We will have the landscapers reseed the slopes
and document all work done on the pond area. We will begin keeping a maintenance file
for the pond area.
At this time, I estimate it will take us about 90 days to get all of this work
completed, as long as the permits and certifications are approved in a timely manner.

M.S.A.A. Jacksonville on May 30, 1997, A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater review:

Z3. There appears to be some off -site runoff entering the pond via the 5:1 perimeter swales along
the north phase line and the west roperty line. Please clarify. How is the runoff from Hargett

4. How will runoff from the section of entrance road nearest Hargett Street be directed into the
pond?
Z5. Provide clear access to the pond for inspection and maintenance purposes.

L/6. Provide the normal water level and the design storm water level elevations in the ditch. I am
concerned that the "vegetated filter" as you show it is really nothing more than a connecting
channel from outlet pipe to ditch. The bottom of the vegetated filter must be located above
the design storm water level in the ditch, and be wide enough to promote sheet flow over the
entire width in order for the filter to function properly.
✓ 7. Add the dimensions of the road and parking. Add a road detail including the road width,
crown type (reverse or normal), sidewalk width and location, ditch section, etc.
✓ 8. Add the dimensions for the patios, or provide a dimensioned unit footprint.
L,,-'_9. You have labelled the slopes above permanent pool as 1:3 on the spillway detail. It should
read 3:1.
✓10. Please note the 6:1 vegetated shelf location on the spillway detail. Include the begin and end
elevations.
V 11. Add a forebay section to the spillway detail. Include the bottom elevation, side slopes and
weir elevation.
✓12. Add a detail of the 5:1 perimeter collection swale.
3. Add a note that all roof drains must be collected and directed into either the parking area or
/ the perimeter collection swale.
14. You have used only the impervious area to calculate the required pond surface area. The
entire drainage area to the pond is used for this calculation. In this case, 65,200 square feet.
Please revise your calculations.
✓ 15. Provide calculations indicating that the forebay is sized to hold a volume equivalent to 20%
of the first inch.
16. Provide calculations of a non -erosive flow in the vegetated filter.

Dear Ms. Lewis:
In response to your June 19 letter, the following information is provided
(responses follow the order of your letter):
1. A sealed sheet 1 is provided.
2. City of Jacksonville has been added to the vicinity map.
3. North and west areas drain away from the site. Runoff from
.Hargett Street drains to existing roadside ditches that do not drain to
the pond.
4. A small section of the entrance road will drain to Hargett Street.
This is necessary to maintain a safe transition from Hargett Street to
the site in accordance with DOT requirements. The area is considered
minimal.
5. Plans have been modified to provide clear access.
6. Normal water level and stormwater level have been noted on the
plans. The vegetated filter elevation is above the expected stormwater
level.

7. Dimensions and details have been added.
8. Patio dimensions have been added.
9. The detail has been corrected to show 3:1.
10. The spillway detail has been modified to show the 6:1 vegetative

12. A detail of the 5:1 perimeter collection swale has been added.
13. Note 4 regarding roof drains has been added.
14. Revised calculations including the entire drainage area are
provided.
15. Forebay calculations are provided on the plans.
16. Calculations for the non -erosive flow in the vegetated filter are
provided on the plans.

LOW DENSITY AND ALL SUBDIVISION PROJECTS
GENERAL SUBMITTAL REQUIREMENTS
A completed stornnwater permit application.
2. Two sets of plans showing north arrow, scale, revision date, property/project boundaries, lot lines,
proposed and existing contours, drainage areas, mean high water line, wetlands, easements, the 30'
minimum vegetated buffer between impervious areas and surface waters, proposed impervious areas,
and road cross -sections.
3. Calculations of the built -upon area, For subdivisions, please show the methodology for arriving at the
per lot built -upon area. For non -subdivision projects, please break down die calculation into buildings,
- roads, parking, and other (include all impervious areas).
4. Low density projects with curb outlet systems will require:
a. Drainage area delineation and swale locations shown on the plans.
b. Detail of the swale, showing minimum 5A side slope.
C. Velocity calculations, indicating a non -erosive flow for the 10 yr storm.
d. Inlet and outlet elevations. Maximum longitudinal slope is 5%.
e. The type of vegetated cover specified on the plans.
f. A flow spreader mechanism located at the swale entrance.
g. A signed Operation and Maintenance Plan.
DEED RESTRICTION REQUIREMENTS
The following statements must be included for all low density projects, and for all subdivisions:
No more than N A square feet of any lot, including that portion of the right-of-way between the edge
of pavement and the front lot line, shall be covered by impervious structures, including asphalt, gravel,
concrete, brick, stone, slate or similar material, not including wood decking or the water surface of swimming
pools. 77tis covenant is intended to ensure continued compliance with the storm water permit issued by the State
of North Carolina. The covenant may not be changed or deleted without the consent of the State.
No one may fill in or pipe any roadside or lot -line swale, except as necessary to provide a minimum driveway
crossing.
For curb outlet system projects, no one may pipe, fill in, or alter any lot line swale used to meet North
Carolina Stonttwater Management Pertnit requirements.
NOTE If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot number, size,
and the allowable built -upon area for each lot.
