This information is in response to the letter we received from you dated 1-28-2009. The drainage pond was inspected by an engineer from John L. fierce and Associates in May 2008. Please see that attached certification. The engineer was supposed to have sent the permit application to the owner to be filled OLIt and SUbi-nitled, but the owner did not receive it. We have asked John L. Pierce and Associates to resend the permit application packet to Gary Wallace, CF0, who ~`works for the owner, the Multiple Sclerosis Association of America. Once Mr. Wallace signs the permit package, Landura Management Associates will write a check from N4SAA Suites' account For the permit 1-ee and send the package to the Division of Water Quality for processing. We have requested the plans for the drainage pond so that we can begin the repairs or placement of the vegetative filter and level spreader. These will be sent to Bill Ogburn at Landura Management Associates so that we may begin planning the project and obtaining bids from contractors. if you have any further questions. Modifying the permit to more accurately represent the current conditions is certainly an acceptable solution. However, the outlet flow path will still require stabilizing as well since that is a permit condition for all discharges. During that visit, I also noted that the pond was actually built quite a bit larger than the design requirements, Second visit (last week) I was able to access the filter. It was constructed much like VERY much like MOST built during that era .... minimal width and flow spreader long since deteriorated. As you noted, the "filter' (swale) bottom is not very well vegetated. The pond was originally designed by Fred Cone, PE who no longer practices in the private sector, Yesterday, l was able to get a copy of the original calculations prepared by Mr. Cone. SAIDA = 7.3 % (from 90% removal table) SA = (26,055 sf) (.073) = 1,902 SF required ---- 2,635 SF actually provided. Therefore, it appears the pond, as constructed, would meet the 90% removal criteria, and perhaps not require the vegetated filter. My question is as follows... In light of the fact that pond contains sufficient surface area, would it be possible to simply re -permit this pond as a 90% removal facility, and avoid costly/disruptive repairs to the vegetated filter? Wilmington, NC 28405 33 RIB: Stormwater Project No. SW89705 Dear Pat: I'm writing to update you on the status of the MSAA of Jacksonville's runoff pond. This information is in response to the Notice of Inspection: Non -Compliance Status that was sent to us July 23, 2007. To date, we have applied for a new engineer's certification permit, since the previous one expired in July, 2007. The owner is trying to find out when it will be approved. It should be available for review once we get the signed copy sent to us. The garbage/debris at the inlet and outlet has been removed. The landscaper monitors and removes the debris once a month along with his regular landscaping duties. The mowing ofthe pond slopes has been done. The slopes are usually mowed twice a year, once in the spring and once in the fall_ The last mowing was November, 2007. The trees have been trimmed and mimosa trees removed from the slopes. The "large woody vegetation" has been cut clown and removed; see the enclosed Landscaper statement from July 31, 2007. The drainage bypass can now be observed. The vegetative filter strip is also now visible. We have not reseeded the slopes to date, but the site manager will instruct the landscaper to reseed them with grass seed this spring. The site manager will begin keeping a folder for pond area maintenance to be available for review/inspections. Wilmington, NC 28405 Dear Pat: Subject: MSAA Jacksonville This letter is in response to the recent inspection and letter of non-compliance to MSAA Jacksonville's runoff pond and the property's Storm Water Permit Number SW8970583 that was issued on 7/25/1997. Landura Management Associates recently began managing this property and because of the recent letter received from you, we are beginning to investigate and take action on what needs to be done to bring the Property into compliance. At this time, management has contacted the Department of I-nvirollment and Natural Resources and is waiting on information to be mailed to us relating to the renewal of the permit. We are researching to find the copy of the signed Engineer's certification that should be in the file. The landscapers and caretakers are working oil mowing around the Mond and picking up the trash around it. We will have them evaluate the large woody vegetation around the pond to see what needs to be cut. Once the mowing and heavy vegetation is removed, the spillway/bypass should be able to be located and the filter should be more accessible to evaluate operational status. We will have the landscapers reseed the slopes and document all work done on the pond area. We will begin keeping a maintenance file for the pond area. At this time, I estimate it will take us about 90 days to get all of this work completed, as long as the permits and certifications are approved in a timely manner. Provide the normal water level and the design storm water level elevations in the ditch. I am concerned that the "vegetated filter" as you show it is really nothing more than a connecting channel from outlet pipe to ditch. The bottom of the vegetated filter must be located above the design storm water level in the ditch, and be wide enough to promote sheet flow over the entire width in order for the filter to function properly. ✓ 7. Add the dimensions of the road and parking. Add a road detail including the road width, crown type (reverse or normal), sidewalk width and location, ditch section, etc. ✓ 8. Add the dimensions for the patios, or provide a dimensioned unit footprint. L,,-'_9. You have labelled the slopes above permanent pool as 1:3 on the spillway detail. It should read 3:1. ✓10.
