hey Linda, this particular project was somewhat confusing, my memory
tells me that we initially tried to do the second phase of the shopping
center as a modification to the existing ponds. We subsequently found
out thru Rhonda that the pond would have to be modified to meet todays
requirements and that
a simple additional volume solution was not acceptable. Later in 2007
we
resubmitted a new design which was permitted under SW8 070741 dated
September 4, 2007 in which new ponds were proposed. No activity on that
permit has started. I hope that helps if I need to dig a little deeper
just let me know. thanks, ron

was NOT assigned any BUA under the permit that I can tell. The proposed
project appears to extend beyond the Phase II area to encompass
additional area between the Phase II area and the existing Dollar
General property, not previously included in the permit. You can either
provide a separate pond for that runoff or modify/expand the existing
pond to accommodate the additional development.
Can you update me on when (if) we can expect to see the stormwater
application? If the project has been abandoned, please advise.

Dear Mr. Conner:
This office has received a soil erosion and sediment control plan for the project listed above which
was submitted as required by the North Carolina Sedimentation Pollution Control Act (G.S. 113A-57 (4)). The
Act requires that all persons disturbing an area of one or more acres of land must obtain approval of a soil
erosion control plan prior to the commencement of the land -disturbing activity (G.S. 113A-54(d) (4)).
The review period for an express review is three days of receipt of a complete plan. If additional
information is requested, it must be submitted within five working days of receipt.
Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to
the approval of an erosion and sediment control plan is a violation of the Act.
We have performed a preliminary review of your submitted plan and have determined that additional
information will be necessary before a final review can be completed. Enclosed is a checklist of items that
must be submitted before we can complete the review process. Failure to provide the additional information
may result in disapproval of your plan.
The approval of an erosion and sediment control plan is conditioned on the applicant's compliance
with Federal and State water quality laws, regulations and rules.
If you have questions please do not hesitate to contact this office. Your cooperation in this matter is

On March 20, 2007, the Wilmington Regional Office received a copy of an Erosion Control Plan for the subject
project. The North Carolina Administrative Code requires any project that must receive either Sedimentation and
Erosion Control Plan approval and/or a CAMA Major permit to apply for and receive a Stormwater Management
Permit by the Division of Water Quality. Any construction on the subject site, prior to receipt of the required
permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement action by this
Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed application form, fee, and
supporting documentation,. or a written response regarding the status of this project and the expected submittal
date must be received in this Office no later than May 17, 2007. Failure to respond to this request may result in
the initiation of enforcement action, and construction may experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan approval letter must
NOT be considered the Coastal Stormwater Management Permit, which will be signed by the Water Quality
Supervisor. Please reference the Project Number above on all correspondence. If you have any questions,

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of a wet detention pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the
approved stormwater management plans and specifications and other supporting data as attached
and on file with and approved by the Division of Water Quality and considered a part of this
permit.
This permit shall be effective from the date of issuance until May 27, 2013, and shall be subject
to the following specified conditions and limitations:
1. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as
described on page 3 of this permit, the Project Data Sheet. The stormwater control has
been designed to handle the runoff from 258,747 square feet of impervious area. This
pond must be operated with a vegetated filter.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of this
permit, and per approved plans. The built -upon area for the future development is limited
to 258,747 square feet.
4. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this project must
be directed into the permitted stormwater control system. A permit modification must be
submitted and approved prior to the construction of additional built -upon area from
outside of the approved drainage area.

II. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in it's entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
The permittee shall at all times provide the operation and maintenance necessary to assure
the permitted stormwater system functions at optimum efficiency. The approved
Operation and Maintenance Plan must be followed in its entirety and maintenance must
occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. immediate repair of eroded areas.
C. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader,
catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
Decorative spray fountains will not be allowed in the stormwater treatment system.
6. The facilities shall be constructed as shown on the approved plans. This permit shall
become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting documentation. Any deviations from the approved plans and specifications
must be noted on the Certification. A modification may be required for those deviations.
If the stormwater system was used as an Erosion Control device, it must be restored to
design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
9. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the drainage
area.
e. Further subdivision, acquisition, or sale of all or part of the project area. The
project area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval or a CAMA Major permit was
sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved
plan.

10. The permittee shall submit final site layout and grading plans for any permitted future
areas shown on the approved plans, prior to construction. If the proposed BUA exceeds
the amount permitted under this permit, a modification to the permit must be submitted
and approved prior to construction.
I t . A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
12. At least 30 days prior to the sale or lease of any portion of the property, the permittee
shall notify DWQ and provide the name, mailing address and phone number of the
purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be
granted in favor of the permittee if access to the stormwater facilities will be restricted by
the sale or lease of any portion of the property.
13. The permittee must maintain compliance with the proposed built -upon area and ensure
that the runoff from all the built -upon is directed into the permitted system.
14. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the permittee shall submit a written time schedule to the Director for modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
15. The permittee must maintain the current permitted drainage area. No additional runoff
from outside of the permitted drainage area boundary may enter the permitted stormwater
facilities without first applying for and receiving a permit modification.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director. In the
event of a change of owership, or a name change, the permittee must submit a formal
permit transfer request to the Division of Water Quality, accompanied by a completed
name/ownership change form, documentation from the parties involved, and other
supporting materials as may be appropriate. The approval of this request will be
considered on its merits and may or may not be approved. The permittee is responsible
for compliance with all permit conditions until such time as the Division approves the
transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
as may be required by this Division, such as the construction of additional or replacement
stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal business
hours for the purpose of inspecting all components of the permitted stormwater
management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and reissuance or termination does not
stay any permit condition.

7. Unless specified elsewhere, permanent seeding requirements for the stormwater control
must follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address changes
within 30 days.

Dear Ms. Munn.
The following is a summary letter of our response to your review comments (each dated
4/25/03) on the above referenced projects.
We have addressed the items in your letter referenced to SW8 980716 Modification as
follows:
1), We have provided a copy of the designer's certification of the pond with this
correspondence.
2). We have provided a revised sheet #2 of 4 which shows the impervious areas in square
feet as well as acres. We have also provided a revised copy of the calculations, which
show that the impervious area for Out Parcel #5 will increase by 7320 square feet to
45.085 total square feet impervious after modification (37,765 sf original permit + 7320
sf = 45,085 square feet after modification). This will cause the total after modification
impervious area of all 5 out parcels to be 218,206.00 square feet. These numbers are now
coordinated between the permit application form and the calculation sheet.
3). We are including a copy of the recorded deed restrictions with this correspondence.
4). This was an item of information only.
We have addressed the items in your letter referenced to SW8961108 Modification as
follows:
1). We have provided a revised copy of Sheet #2 of 4 of the permit showing all

The Wilmington Regional Office received a Stormwater Management Permit Application for
Newport Food Lion on February 18, 2003. A preliminary review of that information has determined that
the application is not complete. The following information is needed to continue the stormwater review:
Please report all built -upon areas in square feet on the application. ✓
2. Please let me know the status of the covenants and deed restrictions. -
Please provide a copy of the designer's certification of the pond.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to May 25, 2003, or the application will
be returned as incomplete. The return of a project will necessitate resubmittal of all required items,
including the application fee.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information. The Division is allowed 90
days from the receipt of a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to
enforcement action pursuant to NCGS 143-215.6A.

Permit Modifications Calculations and Narrative
The permit modification will consist of revising the entrance road into the existing
shopping center. The existing curve in the road where it connects to US Hwy 70 will be
replaced with a 90' intersection. This will result in a reduction of impervious area of 0.23
acre and a subsequent increase in impervious area of 0.29 acres, which will result in a net
increase in impervious area of 0.06 acres for the drainage area.
The existing storm water retention pond has adequate extra capacities previously
designed into it to allow for this small increase in impervious area without any redesign
of the existing pond.
The following is a list of conditions that show that the pond is adequately sized to
accommodate this modification without any need for changing the existing pond
dimensions.
I . Previously permitted impervious area = 256,133 sf
New surface area after modification = 258,746.60 sf
(Net increase of 0.06 acres = 2,613.60 sf)
2. Existing surface area of pond = 9317 sf
Required surface area after modification = 9137.83 sf
(Assumes 90% T55 removal and 7.5' deep pool) Therefore adequate surface area
exists for modification.
3. Existing storage volume = 38,121 ft3
Storage volume required after modification = 25,334.49 ft3
(Assumes 7.27 acres — one inch deep) Therefore adequate storage volume exists
for modification.
4. Draw down will occur through the 2 1/2" orifice after modification in 3.10 days,
which falls between 2-5 days and therefore is o,k.
This concludes the narrative and calculations relating to the modification request to
existing storm water permit number SW8 9611 08. As can be seen the original design of
the retention pond included additional capacities as it relates to all design parameters and
this smaII modification to the impervious area will not require any change or revision to

4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per
approved plans.
5. Deed restrictions must be recorded prior to the sale of any outpa.rcel or future area shown on the approved
plans to ensure that future owners are made aware of the built -upon area limitations. The following
statement must be recorded:
"To ensure continued compliance with the NCDivision of Water Quality Stormwater Management
Permit Regulations, 15A NCAC 2H.1000, the outparcels and future areas as shown on the
approved plans must submit for and receive a Stormwater Management Permit prior to
development."
"All built -upon area from the outparcels and future areas must be directed into a permitted
stormwater control system. "
"Additional built -upon area will require a permit modification."
6. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable
built -upon area.
7. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification
to the permit.
S. The Director may notify the pen- ittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a
written time schedule to the Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director that the changes have been
made.

H. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for construction and maintenance of the
stormwater management system:
a. The stormwater management system shall be constricted in it's entirety, vegetated and operational
for it's intended use prior to the construction of any built -upon surface except roads.
b. During constriction, erosion shall be kept to a minimum and any eroded areas of the system will
be repaired immediately.
C. All connections into the stormwater system from future areasloutparcels shall be made such that
short-circuiting of the system does not occur.
2. The permittee shall at all tines provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must
be followed in its entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Maintenance of the side slopes to include mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
f. Access to the outlet structure must be available at all times.
3. Records of maintenance activities must be kept and made available upon request to authorized personnel
of DWQ. The records will indicate the date, activity, name of person performing the work and what
actions were taken.
4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions
of this permit, the approved plans and specifications, and other supporting data.
5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation
of this permitted facility, a certification must be received from an appropriate designer for the system
installed certifying that the permitted facility has been installed in accordance with this permit, the
approved plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
6. A copy of the recorded deed restrictions must be submitted to the DWQ within 30 days of the date of the

7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of ten years from the date of the completion of construction.

III. GENERAL CONDITIONS
This permit is not transferable. In the event there is a desire for the facilities to change ownership, or
there is a name change of the Permittee, a formal permit request must be submitted to the Division of
Water Quality accompanied by an application fee, documentation from the parties involved, and other
supporting materials as may be appropriate. The approval of this request will be considered on its merits
and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute
143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and
federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action, including those as may be required by this Division,
such as the construction of additional or replacement stormwater management systems.
The permittee grants DEHNR Staff permission to enter the property for the purpose of inspecting all
components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for
a permit modification, revocation and reissuance or termination does not stay any permit condition.

I. Monthly, or after every runoff producing rainfall event, whichever comes first:
A. Inspect the trash rack; remove accumulated debris, repair/replace if it is not functioning.
B. Inspect and clear the orifice of any obstructions. If a pump is used as the drawdown
mechanism, pump operation will be checked. A log of test runs of the pump will be kept
on site and made available to DEM personnel upon request.
C. Inspect the pond side slopes and grassed inlet swales; remove trash, and repair eroded
areas before the next rainfall event.
D. If the pond is operated with a vegetated filter, the filter will be checked for sediment
accumulation, trash accumulation, erosion and proper operation of the flow spreader
mechanism. Repairs/cleaning will be done as necessary.
II. Quarterly:
A. Inspect the collection system (ie. catch basins, piping, grassed swales) for proper
functioning. Accumulated trash will be cleared from basin grates, basin bottoms, and
piping will be checked for obstructions and cleared as required.
B. Pond inlet pipes will be checked for undercutting. Riprap or other energy dissipation
structures will be replaced, and broken pipes will be repaired.
III. Semi-annually:
A. Accumulated sediment from the bottom of the outlet structure will be removed.
B. The forebay depth will be checked at various points. Sediment removal is required when
the depth is reduced to 75% of the original forebay design depth of 7.5 '.
C. Grassed swales, including the vegetated filter if applicable, will be reseeded twice a year

IV. Annually:
A. The pond depth will be checked at various points. Sediment removal is required when the
depth is reduced to 75 % of the original design depth or 3', whichever is greater. Design
depth is 7.5 ', measured vertically from the orifice down to the pond's bottom.
Sediment must be removed to at least the original design depth.
V. General:
A. Mowing of the side slopes will be accomplished according to the season. Maximum grass
height will be 6".
B. Cattails are encouraged along the pond perimeter, however they will be removed when they
cover more than 1/2 the surface area of the pond. The best time to cut them is at the end
of the growing season, in November. Environmentally sensitive chemical for use in killing
cattails can also be used. Contact your nearest Agricultural Extension Agent.
C. The orifice/pump is designed to draw down the pond in 2-5 days. If drawdown is not
accomplished in that time, the orifice will be replaced with a larger or smaller orifice.
Slow drawdown may be attributed to a clogged system. The source of the clogging will
be found and eliminated.
D. All components of the detention pond system will be kept in good working order. Repair
or replacement components will meet the original design specifications as per the approved
stormwater plan. If previously approved components are determined to be ineffective, the
component must be redesigned and/or replaced.

The Wilmington Regional Office received previously requested information for the Stormwater
Management Pennit Application for Newport FoodLion on January 31, 1997. A preliminary review of that
information has determined that the application is not complete. The following information is needed to
continue the stormwater review:
1. Provide revised pond calculations for 6.36 acres of impervious area.
2. Provide a revised permit application to include the service road.
3. Only 1 each of sheets 2 and 9 was submitted. Please remember that two (2) sets of plans are
required for all submittals, revisions, and modifications.
4. PreviousIy, you had stated that the outparcels were "property of others”, but the ownership
information you now provide is the same as the current applicant. Therefore, the outparcels
cannot be separated from the development, and they must be either included in the pond
design, or a separate pond must be designed for the outparcels. The ourparcels may not be
sold until a deed restriction is recorded which limits the built -upon area and which requires
that the runoff be directed into a pond..

5. The resubmitted application shows an impervious total of 6.36 acres in the breakdown
section, but then switches back to 5.23 acres under the Drainage Basin column, and uses 6.36
as the site area. Please clarify and correct. The project area must include the Phase II, the
future development, the outparcels (if a separate pond is not designed for them) and the
service road. Please remember that the drainage area to the pond will include grassed areas
that naturally flow to the pond.
6. Please note that seeding/stabilization of the pond slopes must occur prior to the construction
of impervious surfaces. Your note on Sheet 2 seems to intimate that seeding is only
accomplished after site stabilization.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to March 13, 1997, or the application will be
returned as incomplete. The return of a project will necessitate resubmittal of all required items, including

Management Permit Application for Newport Food Lion on January 8, 1997. A preliminary review of that
information has determined that the application is not complete. The following information is needed to
continue the stormwater review:
1. The forebay is supposed to be shallower than the main body of the pond. You show the same
bottom elevation for both the pond and the forebay. Please raise the bottom elevation of the
forebay to about 28 or so. The weir separating the pond from the forebay must be set at an
elevation less than or equal to the design storage pool, but greater than the permanent pool.
2. The note on the plans concerning the clearing of the outparcels is a 99% sure bet that the
Erosion Control permit will be required to address those areas, therefore they will be tied to
the stormwater requirements as well. Please provide me with the names and mailing addresses
of the owners of the outparcels. As discussed 12-8-96, each of the outparcels must submit for
a stormwater permit prior to development.
3. How are you collecting the runoff from the access road that connects into Hwy 70? It is a part
of the project and must be treated.
4. Please break out the future areas of Phase I from the currently proposed plan and list the
total in the column on the application form under "Other”.

6. Relocate JB-1 at the property line between outparcels 2 and 3 so that 3 will be able to connect without
encroaching on 2's property.
7. Label and delineate the permanent pool and design pool contours.
8. Dimension the permanent pool contour. Include radii.
0 9. The pond section detail must include both a forebay and a 6A vegetated shelf. Please now begin and end
elevations for the shelf, the width and the slope. For the forebay, it is shallower than the main pond
(generally 3' max) and must hold 20% of the design volume.
10. The storage you have provided for the first inch occurs at elevation 32.95, however, you have used 36,
which equates to 58,125 cubic feet. The orifice has only been sized for 22,163 cubic feet. You must size
the orifice based on the accumulated volume at the designated elevation. The minimum volume
�1 accumulated must meet the calculated requirment, and anything else over the minimum must be accounted
for in the orifice sizing for drawdown. If you chose 32.95 as the storage elevation, and provided an outlet
at that elevation, then your calculations as reported would be correct. Please analyze the 2" orifice for
the 58,125 cubic foot volume.

Dear Mr. Tew:
The Wilmington Regional Office received a Stormwater Permit Application for the Newport Food Lion on
October 9, 1996. The application is incomplete. The following general requirements must be provided prior to
further review by this Office:
1. A completed permit application form.
2. An application fee of $385.00.
3. Sealed calculations.
4. A signed Operation and Maintenance plan.
Upon receipt of the above items, the application will be reviewed within 30 days. If it is determined to be
incomplete, a letter advising how to make the application acceptable will be forwarded. Upon receipt of the
requested information, and a determination that the application is complete, a permit will be issued within 90 days.
This project will be reviewed by Linda Lewis. Please direct all correspondance to the reviewer and reference
the name of the project shown above. If you have any questions, please do not hesitate to call the reviewer at (910)
395-3900.
