We have received notification from NHC Engineering that this parcel has applied for an E&SC. I found the attached
request for rescission from November 2011 in the file, but it hasn't been processed. Evidently the city has issued a
permit for this'lot, and so this project is no longer needed.

I am a senior project manager at Kite Realty Group, which is the new owner
of 3804 Oleander Drive. Our ownership entity for this property is KRG
Oleander, LLC. We request the NCDENR rescind the previous stormwater
permit for the property, which is permit #SW8-9600T9 dated June 11, 1996
and was for the former Wilson's -- Oleander Drive project. It is also my
understanding that this previous permit has since expired.
As part of our new Minor Site Plan approval for the Whole Foods at Oleander
project, the City of Wilmington issued a new Stormwater Permit #2011031
dated November 11, 2011 for the existing high density wet pond.

Dear Mr. Couch:
The Division of Water Quality issued a Coastal Stormwater Management Permit, Number
SW8960409 to Boney Wilson and Sons, Inc. for a High Density pond to serve Wilson's —
Oleander Drive on 6 1111996. This permit expired on 6/11/2006. Section .1003(h) of 15 A NCAC
2H .1000 (the stormwater rules) requires that applications for permit renewals shall be
submitted 180 days prior to the expiration of a permit and must be accompanied by a
processing fee, which is currently set at $420.00. If this is still an active project please complete
and submit the enclosed renewal application in a timely manner. If this project has not been
constructed and a permit is no longer needed, please submit a request to have the permit
rescinded. If you have sold the project, or are no longer the permittee, please provide the name,
mailing address and phone number of the person or entity that is now responsible for this
permit. Enclosed is a form for change of ownership, which should be completed and submitted if
the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate
designer for the system installed. This is to certify that the permitted facility has been installed in
accordance with the permit, the approved plans, specifications and supporting documentation.
Please include a copy of the certification with your permit renewal request and processing fee.
Enclosed is a copy of a sample certification. Also enclosed is a new Operation and Maintenance
agreement that should be completed and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-
215.1 and may result in appropriate enforcement action including the assessment of civil
penalties of up to $10,000 per day.

RIP RAP MATERIALS
942-1 PLAIN RIP RAP.
Stone for plain rip rap shall consist of field stone or rough unhewn
quarry stone. The stone shall be sound, tough, dense, resistant to the
action of air and water, and suitable in all other respects for the pur-
pose intended. Where broken concrete from demolished structures or
pavement is avnilnhle, it may he used in place of stone provided that
such use rneets with the approval of the Engineer. However• the use
of broken concrete which contains reinforcing steel will not be
permitted.
The stone or broken concrete shall he l,,raded to meet the following
requirements:
1. For Class 1 Rip Rap. Stone shall vary in weight from 5 to 200
pounds. At least 30 percent of the total weight of the rip rap
shalt he in individual pieces weighing a minimum of 60 pounds
e:ich. Not more than 10 percent of the total weight of the rip rap
may he in individual pieces weighing less than 15 pounds each.
2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250
pourds. At least 60 percent of the total weight of the rip rap
shall be in individual pieces weighing a minimum of 100 pounds
each. Not more than 5 percent of the total weight of the rip rap
mac be in individual pieces weighing less than 50 pounds each.

The stone shall be of a hard, durable nature and shall range in size
as follows:

All stone shall meet the approval of the Engineer. While no specific
gradation is required, the various sizes of stone shall be equally dis.

stone particle will be determined by measuring its long dimensions.

someone in the Lowe's Foods Company that l could talk to regarding the store on Oleander Drive. It has changed
hands twice since the Wilson's sold out, and the permit was not transferred either time. Do you have a name and a
telephone number of someone in the Lowe's Foods company that I could get in touch with to start the transfer
process?

Dear Mr. Norris:
The Wilmington Regional Office received previously requested information for the Stormwater
Management Permit Application for Wilson's - Oleander on May 15, 1996, A preliminary review of that
information has determined that the application is not complete. The following information is needed to
continue the stormwater review:
1. For the outlet structure, how will trash be precluded from clogging the orifice? It appears
that the runoff drains through the 15" pipe from the pond and into the manhole without
benefit of a trash rack.
2. Does Mr. Andrew Couch, as Senior Real Estate Representative, meet the signature
requirements of .1003 (e)(1-4)? The regulations require at least.the level of Vice -President
for a corporation, general partner for a limited partnership, or the proprietor for a sole
proprietorship.
3. On the permit application, the owner is listed as Azalea Plaza, Ltd, c/o Robert Bellamy. If
Hannaford/Boney Wilson and Sons has signed the application, then the owner must also be
listed as Hannaford/Boney Wilson and Sons, or the application must be signed by someone
of at least the level of vice-president or general partner of Azalea Plaza, Ltd. Please clarify.
4. Please add the redevelopment statistics to the application, ie, previous existing impervious
area amount, proposed impervious area, etc., as requested for the Brunswick Community
College project of a similar nature.

Deed restrictions and protective covenants are required to be recorded for all Iow density projects and
all subdivisions prior to the sale of any lot. Please see Attachment A for the specific items that must
be recorded for the type of project applied for.

In regard to your comment letter of May 7, 1996 we are responding
as follows:
1. No agent authorization letter should be necessary as Boney
Wilson and Sons, Inc.. and Hannaford are the same company.
Hannaford has kept the Wilson name in North Carolina because
it is widely recognized.
2. The 1.83 acres has been delineated on the enclosed drawing.
3. The outlet structure functions as our usual design except it
is removed from the pond edge and is located in -line on the
outlet piping. The orifice hole is drilled in a stainless
steel flow control place which is removable for cleaning
purposes.

The Wilmington Regional Office received a Stormwater Management Permit Application for
Wilson's @Oleander Drive on April 8, 1996. A preliminary review of that information has determined
that the application is not complete. The following information is needed to continue the stormwater
review:
1. Please provide an signed agent authorization per NCAC 2H.1003 (e), from the owner,
Hannaford, allowing Boney Wilson and Sons, Inc. to sign the permit application and
maintenance agreement for them. Please make sure the authorization provides the printed
or typed name of the contact at Hannaford. Also, please provide the name of the person
from Boney that is signing the application - I cannot read it.
2. Please delineate the 1.83 acre drainage area to the pond.
3. Please expiain how the outlet structure will function. I am unable to understand how it will
work based solely on the detail provided.

ATTACHMENT A
LOW DENSITY AND SUBDIVISION PROJECTS
GENERAL SUBMITTAL REQUIREMENTS
i . A completed stormwater permit application.
2. Two sets of plans showing north arrow, scale, revision date, property/project boundaries, lot lines,
proposed and existing contours, drainage areas, mean high water line, wetlands, easements, the 30'
minimum vegetated buffer between impervious areas and surface waters, proposed impervious areas,
and road cross -sections.
3. Calculations of the build -upon area, for subdivisions, please show the methodology for arriving at the
per lot built -upon area. For non -subdivision projects, please break down the calculation into
buildings, roads, parking, and other (include all impervious areas).
4_ Low density projects with curb and gutter will require:
a. Drainage area delineation and swale locations shown on the plans.
b. Detail of the swale, showing minimum 5:1 side slope.
C. Velocity calculations, indicating a non -erosive flow for the 10 yr storm.
d. Inlet and outlet elevations. Maximum longitudinal slope is 5%.
e. The type of vegetated cover specified on the plans.
DEED RESTRICTIONS REQUIREMENTS
The following statements must be included for all low density projects, and for all subdivisions:
No more than square feet of any lot, including that portion of the right-of-way between
the edge of pavement and the front lot line, shall be covered by impervious structures, including
asphalt, gravel, concrete, brick, stone., slate or similar material, not including wood decking or the
water surface of swimming pools. This covenant is intended to ensure continued compliance with the
stormwater permit issued by the State of North Carolina. The covenant may not be changed or
deleted without the consent of the State.
No one may fill in or pipe any roadside or lot -line swale, except as necessary to provide a minimum
driveway crossing.
For curb and gutter projects, no one may pipe, fill in, or alter any lot line swale used to meet North
Carolina Stormwater Management Permit requirements.
NOTE: If lot sizes vary significantly, the owner/developer must provide an attachment listing each lot
number, size, and the allowable built -upon area for each lot.
