The Division of Water Quality issued a high density Stormwater Management Permit, Number SW8
951222 to Brunswick Amusements, Inc for the Oak Island Fun Park, Phase 2 project on February 8,
1996. This permit expired on February 8, 2006. A letter was sent to you on July 11, 2007 requesting
that an application for renewing the permit be submitted and, at this time, a response has not yet
been received. Per 15A NCAC 2H.1003(h) (the stormwater rules), it is your responsibility to submit
an application to renew the permit 180 days prior to the expiration of a permit.
If this is still an active project please complete and submit the enclosed renewal application along
with the processing fee, which is currently set at $505.00 prior to June 3, 2013. If this project has not
been constructed and a permit is no longer needed, please submit a request to have the permit
rescinded. If you have sold the project please provide the name, mailing address and phone number
of the person or entity that is now responsible for this permit. Enclosed is a form for change of
ownership, which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
stormwater treatment system, a certification of completion be submitted to the Division from an
appropriate designer for the type of system installed. This is to certify that the permitted facility has
been installed in accordance with the permit, the approved plans, specifications and supporting
documentation. If you have not already provided a Designer's Certification to our office, please
include a copy with your permit renewal request and processing fee. A copy of the certification form
is enclosed for your convenience.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1
and may result in appropriate enforcement action including the assessment of civil penalties of up to
$25,000 per day.
If a renewal application is not submitted prior to .tune 3, 2013, enforcement actions may be initiated,
which may include the assessment of civil penalties. If you have any questions, please feel free to

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number
SW8951222 to Brunswick Amusements, Inc. for a High Density pond to serve Oak Island Fun
Park, Phase 2 on 21811996. This permit expired on 21812006. Section .1003(h) of 15 A NCAC
2H .1000 (the stormwater rules) requires that applications for permit renewals shall be
submitted 180 days prior to the expiration of a permit and must be accompanied by a
processing fee, which is currently set at $420.00. If this is still an active project please
complete and submit the'enclosed renewal application in a timely manner. If this project has
not been constructed and a permit is no longer needed, please submit a request to have the
permit rescinded. If you have sold the project, or are no longer the permittee, please provide
the name, mailing address and phone number of the person or entity that is now responsible
for this permit. Enclosed is a form for change of ownership, which should be completed and
submitted if the property has changed hands.

The site is a tract of land 0.69 acres in size located on
the east side of North Carolina Roads 211 and 133. The soil
types consist primarily of well drained pervious sand, with
small areas of poorly drained fine grained sandy loam in the
lower elevations. Present and proposed drainage from the site
is provided by a ditch along the east boundary line. This ditch
drains into a tributary of Calf Gully Creek, which in turn drains
into a diverted branch of Dutchmans Creek, a class SC stream.
After entering Dutchmans Creek, the drainage is into the Intra-
coastal Waterway, approximately a mile downstream.
Oak Island Fun Park is a proposed entertainment project to
consist of a go-cart race track, and a small car area as shown
on the plan. No industrial wastes or toxic material of any
kind will be generated by this project. A storm water detention
pond will be constructed as shown on the plans. This pond is
designed to control all of the stormwater runoff from the pervious
and impervious areas of the project as constructed, with a one
foot high berm as freeboard. Temporary silt fences will be
located as shown. It is anticipated that nearly all of the 0.69
acres of the site will involve land disturbance.
This stormwater control plan was designed by William R.
Chinnis, P. E., 3069 Oak Drive SW, Shallotte, N. C. 28470,
Telephone No. (910)754-5310.
CONSTRUCTION SEQUENCE
1. Obtain all necessary permits for the project.
2. Install silt fences.
3. pile and burn the vegetation debris resulting from clearing
operation. If conditions for burning do not exist, material
will be hauled off -site for disposal.
4. Install drainage swales with 3h to 1v slopes, and install
culverts.
5. Construct stormwater control pond.
6. Landscape and grass site.
7. Notify officials of Land and Water Quality Sections.
8. Maintain erosion control devices -as necessary.
9. Mow site as needed.
10. Stabilize site as areas are brought up to finished grade.
11. When construction is completed and all areas are stabilized,
notify officials of Land and Water Quality Sections.
12. If site is approved, remove temporary devices.
13. Seed and mulch any remaining bare areas, as necessary.

VEGETATIVE GROUND COVER
Temporary and Permanent
A. GENERAL REQUIREMENTS: The work includes seedbed preparation,
lining, fertilizing, seeding- and mulching of all areas
indicated to be grassed. The work also includes those areas
within or outside the limits of construction that are
disturbed by the contractor's operations.
B. MATERIAL:
1. Lime shall be dolomitic agricultural ground limestone
containing not less than 10 Fercent Magnesium Oxide or
available Magnesium equivalent.
2. Fertilizer shall be standard commercial product of
10-10-10 analysis. All fertilizer shall be delivered in
bags bearing the manufacturer's name, the chemical.
analysis of the product and the weight. If not used
immediately after delivery, fertilizer shall be stored in
a manner that will not allow it to harden or destroy its
effectiveness.
3. Seed shall be certified seed or equivalent based on reort`-L
Carolina Seed Improvement Association requirements for
certification. If the seed is not grown in the state
w4here it is to be used, it shall meet the certification
requirements of the Seed Improvements Association for the
state in Which it is grown. All seed shall be furnished
in sealed standard containers unless exception is granted.
Seed which has become wet, moldy, or otherwise damaged
prior to seeding will not be acceptable.
C. CLEARING: Prior to or during grading (and tillage operations)
the ground surface shall be cleared of stumps, stones, roots,
cable, wire, grade stakes, and other materials that might
hinder proper grading, tillage, seeding, or subsequent
maintenance operations.
D. GRADING: Graces on the areas to be treated shall be
maintained in a true and even condition. Maintenance shall
include any necessary repairs to previously graded areas.
E. TILLAGE: All graded areas shall be thoroughly tilled to a
depth cf at least 4 inches by plowing-, disking. burrowing or.
dther approved methods until-the-condition.of the soil is'-ready•for seeding.

F. LIMING: Limestone shall be uniformly applied at the rate of
2000 pounds per acre (46 Founds per 1000 sq. ft. ) to all
areas to be vegetated. Limestone may be applied to the area
prior to the preparation; of the seedbed. But in all cases it
shall be applied before seeding, and thoroughly -incorporate,
into the entire depth of prepared seedbed. .
G. FERTILIZING: The fertilizer shall be uniformly applied at the
rate of 1000 pounds per acre (23 pounds per 1000 sq. ft.) to
all areas to be vegetated. The fertilizer shall be
incorporated into the upper three or four inches of prepared
seedbed. This can be done just prior to the last tillage
operation or just prior to seeding. But in no case will it be
applied more than 3 days before seeding or before the lime is
applied.
H. MULCHING: The surface of all seeded areas shall be protected
by the application of any of the before-mentio-ed mulch
materials unless otherwise specified.
1. STRAW OR HAY: Shall be applied evenly over the seeded
area in such a manner that thickness of the mulch is
approximately uniform throughout the treated area and
sunlight is not ComD!etely excluded from penetration to
the ground surface. ^The straw mulch shall be applied at
the rate of 1 - 1 1/2 tons per acre and disked with a
straight blade at an approximate depth of one inch to
ensure that the hay is f J rmly tacked.
2. wOJb CEL.LULJSE FILER MULCH: The application of the wood
cellulose fiber mulch shall be with the hydroseeder and
shall be accomplished immediately after completion of the
final tillage operation. The wood cellulose fiber mulch
shall be applied at the rate of 1000 pounds per acre in
combination with water, fertilizer and seed. These shall
be sprayed over the soil in a uniform coat.
3. ASPHALT TREATMENT: Upon completion of the seeding
operation the area shall be given an asphaltic treatment
to prevent erosion. The treatment shall consist of an
application of an SC-1 grade liquid asphalt. The
materials shall be applied in calm weather and preferably
when the soil is slightly moist. Equipment for the
application Of the asphalt shall consist of a boiler to
heat the oil to a temperature of approximately 17S decrees
Farenheit, a distributor, and hose equipped with spray
bars.
I. AN.CHoRING MULCH: Mulch shall be anchored in place as follows:

for a period of 3 months after seeding. Maintenance shall
consist of providing prote_tion against traffic by
approved warning signs or barricades, the mowing of all
grass and weeds tending to smother new'seedlings, and the
repair and reseeding of any surfaces which become gullied
or otherwise damaged.
3. SEEDING: Seed shall be sown as per the following schedule:

K. MAINTENANCE: The contractor shall be responsible for the
proper maintenance of the areas seeded under this contract
until the ground surface is covered with growth at least 1
inch high. but not less than 2 months after planting. Grass
should be mowed before it reaches a height of 6".

Dear Ms, Lewis:
This is in reply to your letter dated January 8, 1996 in regard to your request for
additional information regarding the subject project.
By item number as listed in your letter, the information requested is provided as
follows:
1. The project's physical location with respect to phase I has been added to the revised
plan. The main entrance into this phase will be through Phase 1.
2. The trac"dth has now been added to the plan at several locations along the track.
Likewise, the permanent pool width has also been added.
3. A forebay area, vegetative shelf, and access easement are shown on the revised plan.
4. A thorough on -the -ground survey has shown that no off -site drainage will enter this
project.
Please let me know if any further information is needed. Thank you for your
assistance.

Frequent maintenance of wet ponds is required and can be costly. Wet sediment is harder and more costly
to remove. Again, easy access is critical to proper maintenance. Poor maintenance can cause the pond to
fail, and create nuisance odors, insects, algae blooms and unsightly areas.
The NC Division of Environmental Management requires the use of wet ponds to treat stormwater runoff
in high density developments within the watersheds of some sensitive water bodies (high quality/outstand-
ino resource waters, etc.). DEM should be consulted on specific design and operation and maintenance
requirements. Many local governments also require wet ponds within water supply watersheds and should
be contacted for Further information. Guilford County, North Carolina has extensive experience with wet
