On October 5, 2009, the Wilmington Regional Office of the Division of Water Quallty received a request to exclude the subject
proposed redevelopment project from Stormwater Management Permit requirements. Staff review of the plans and supporting
documentation has determined that the project proposes activities that are excluded from State Stormwater permitting
requirements as set forth in Section 2.(d)(3) of Session Law 2008-211, effective October 1, 2008, and the stormwater rules
under Title 15A NCAC 2H.1000, as amended.
Therefore, the director of the Division of Water Quality is hereby providing confirmation that the subject project is excluded from
State Stormwater permitting requirements under the following conditions: 1) The project must be constructed as shown on the
plans submitted to this Office; 2) The proposed built -upon area of 90,360 square feet does not exceed the existing built -upon
area of 96,525 square feet; and 3) The proposed stormwater control, sheet flow, provides equal protection of surface waters as
the existing stormwater control, which is sheet flow.
Under Section .1003 (b) of the stormwater rules, the entire common plan of development must be permitted. Therefore, any
future development or changes to the proposed development, including, but not limited to, the relocation of built -upon area and
the construction of additional built -upon area, may require approval or a Stormwater Management permit application and permit
issuance from the Division of Water Quality prior to any construction. Any construction on the site prior to receipt of the required
approval or permit will constitute a violation of Title 15A NCAC 2H.1000 and Session Law 2008-211, and may result in the
initiation of appropriate enforcement action.
Please keep in mind that this determination does not affect your legal obligation to obtain other permits and approvals, which
may be required by Federal, State, or local government agencies, rule or law. If you have any question, or need additional

The Cover Sheet - GI-0.00 includes a vicinity and site map for this project.
The Detailed Grading Plan - CG-4.01 has been revised. The existing roads shown to be
removed shall be permanently removed and not replaced. The associated road names in these
locations have been removed from this drawing. Note that the existing storm water drainage
system, sanitary sewer system and other utilities are not proposed to be removed at this time.
Spot elevations have been added to the proposed material laydown / stockpile area. A length
dimension of 360-ft and a Width dimension of 251-ft has been shown for the stockpile area.
This proposed stockpile area is approximately 90,360 s[.

On September 21, 2009, the Wilmington Regional Office received a request to exclude the
proposed project, Knox Park, from stormwater permitting requirements per the redevelopment
exclusion option of Session Law 2008-211. This option requires that there be no net increase
in the amount of built -upon area after development and that equivalent stormwater control be
provided. A preliminary review of that information has determined that the application is not
complete. The following information is needed to continue the stormwater review:
Please provide the contact name, mailing address and phone number for the
applicant, Atlantic Marine Corps Communities, LLC.
2. Please provide a vicinity map on the plans, identifying the project location and
showing the nearest intersection of two major roads. A major road is any 1, 2 or 3
digit NC, US or interstate highway.
3. The roads that are being removed are still showing up on the post -development
plan. Are those roads being permanently removed, or only temporarily? If they
will be repaved at a later date, or if they will continue to be used for access to the
lots, then this project does not qualify for the redevelopment exclusion. If the
roads are being permanently removed, then the post -development plan (CG-
4.01) should not show them at all, but their names are still showing up on the
plan, which is confusing.
4. Please provide spot elevations for the new stockpile area to verify that the
proposed drainage (i.e., treatment) is equivalent or better than what currently
exists.
5. Please provide dimensions for the new stockpile area to verify the amount of
built -upon area is less than currently exists.
6. Please provide dimensions for the existing pavement that was removed.
7. Please add the existing, removed and proposed BUA amounts to the plans.

limit is imposed for the return of this information as the application is incomplete until it
is accepted as complete by the Division. You will not receive any further notifications
from the Division regarding this project.
The construction of any part of this proposed redevelopment project prior to receipt of
the approval to do so per SL 2008-211, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A. This includes removal of existing
built -upon area and construction of the proposed built -upon area.

On behalf of Atlantic Marine Corps C0111111L1n1tlCS, L1_C, we request an exclusion from a storm
water permit due to the proposed redevelopment at the Knox Park area. The proposed
redevelopment will improve the quality of the storm water runoff as imperious area (existing
roadway paver11c11t and concrete pacts) will be removed and less imperrOLIS area (a gravel working
area) will be installed. The gravel working area is further away from the edge of water than the
existing roadways and thus will result in a larger buffer strip. Also there IS a rCCILICtion in the
amount of the impervious area. Demolition of approximately 95,900 sf of existing pavement and
concrete is proposed. A work area with a gravel base ot'approximately 90,300 sf will be
constructed.
This work area will be used as a concrete crushing operation. Concrete €rom the proposed
demolition of existing roadways, sidewalks and hOLISCS at Midway Park — Sections I to 4 and
Tarawa Terrace— Phases 5 X-, 6 will be transported and stockpiled here. Then this concrete will
be crushed and graded Cor re-usc at these neighborhoods as a roadway base course.
