On October 19, 2011, the Division received an incomplete State Stormwater Management Application for the project
listed above. The application and check number 13,22, in the amount of $505 is being returned to the entity which
applied to modify this permit, the Villas at Murrayville, LLC because the application package lacked the necessary
elements to accept it for review. Please provide the following information upon the next submittal of this application
package:

1. Process'. You are currently the permittees for this permit. I understand that you plan to sell or have sold this
property to The Villas at Murrayville, LLC and that that entity would like to subdivide that lot and also provide
lot(s) in the subdivision a specified amount of impervious area. There are two ways to do this:
a. Option 1: Have the current permittee modify the permit to subdivide it and then transfer it to the
new permittee. ;I
b. Option 2: Transfer the permit to the new permittee and then subdivide the permit into several lots.

2. Deed Restrictions: The attached agreement shows that there is an agreement for 21,955sf of impervious
area to be given to Angela S. Williams. I understand that there may be a discrepancy regarding the amount
of impervious area that you intend to grant each lot. Please include deed restrictions with your resubmittal,

THIS EASEMENT AND AGREEMENT, made this day of

WITNESSETH THAT
WHEREAS, GRANTOR owns icertain real property located in New Hanover
County more particularly described in a deed recorded in Book 5216, Page 2470 in the
office of the Register of Deeds of New (Hanover County ("Grantor's Property"); and
WHEREAS, GRANTEE owns certain real property located in New Hanover County
more particularly described in a deed recorded in Book 5392, Page 1432 in the office of
the Register of Deeds of New Hanover County ("Grantee's Property"), and
WHEREAS, GRANTOR has agreed to grant to GRANTEE an Easement over
Grantor's Property for the purpose of piroviding connection to and use of stormwater and
sewer facilities as more particularly described below.
NOW, THEREFORE, GRANTOR, for and in consideration of the sum of Ten
Dollars ($10.00) and other valuable considerations to it in hand paid by the GRANTEE,
the receipt whereof is hereby acknowledged, by these presents does hereby grant unto
GRANTEE, her successors and assigns, an Easement as more f0y described below.

1. Easement.
GRANTEE shail have a non-exdlusive perpetual Easement upon, through, in and
under the Grantor's Property for the pu` poses of connecting to and use of the stormwater
and sewer facilities (the "Facilities") to fated on Grantor's Property for the benefit of
Grantee's Property.
2. Purpose of Easement.
The purpose of this Easement is' for GRANTEE and its successors and assigns to
connect to and use the stormwater and' sewer facilities located on Grantor's Property for

the benefit of Grantee's Property. GRANTEE'S rights shall include the right to do all
things necessary to install, construct, repair, maintain and use the Facilities.
3. Specific Terms. !
GRANTOR shall retain fee simple ownership of the Facilities located on Grantor's
Property. GRANTEE and her successor and assigns shall have the right to connect to
the Facilities at her sole cost and expense, and in accordance with all applicable State
and municipal ordinances. ;
GRANTOR shall maintain the Facilities located on Grantor's Property at its sole
cost and expense, in good repair until such time as responsibility for maintaining the
Facilities is accepted by the State of North Carolina or other applicable municipality.

GRANTEE shall maintain the Facilities located on Grantee's Property at her sole
cost and expense, in good repair until sluch time as responsibility for maintaining the
Facilities is accepted by the State of North Carolina or other applicable municipality.
GRANTEE' rights to connect to'the stormwater facilities shall originate at the site
labeled "18" Plug inv. 31.75" on the attached Exhibit Map incorporated herein by this
reference and shall run upon, through, iI n and under the Grantor's.Property to the
" Stormwiater Detention Pond" located thereon.
GRANTEE' Property shall be permanently allocated 21,955 square feet of

permitted impervious area out of the total 331,818 square feet allowed under the
applicable Stormwater Permit No. SW8,060717.

GRANTOR agrees to cooperate with and assist GRANTEE in the modification of
said Stormwater Permit No. SW8 060717 or any other permit necessary for Grantee to
connect to said Facilities located on Grantor's Property.

GRANTEES rights to connect to the sewer facilities shall originate at the site

labeled "SSMNH NO. 1 K" on the attached Exhibit Map incorporated herein by this
reference and shall run upon, through, 1, and under the Facilities located on Grantor's
Property and shall terminate at the site labeled "SSMH NO. 1 E".
This Easement and Agreement shall supersede and replace that certain Deed of

Easement recorded in Book 5216, at Pi ge 2466, New Hanover County Registry.
TO HAVE AND TO HOLD, the aforesaid non-exclusive Easement and all
privileges and appurtenances thereunt o belonging to GRANTEE and her successors and

The easement says 21,955sf. Please see the attachedlletter which will be mailed today.
As far as the deed restrictions, the two forms (high density commercial subdivision and high density development with
outparcels) are similar. You would use the "outparcel" form if it were a situation such as Wal-Mart building a big pond
and maintaining ownership of most of the project butiiselling a few outparcels. You would use the subdivision form if
there is no "main" entity who will build and maintain the pond but rather there will be some sort of owners association
or other arrangement. So, there isn't a cut and dry answer. We just provide the two forms for flexibility.

Garry,
I talked with Rodney Williams this morning (cc'd), and I think I better understand the situation. I know that you
represent the new owner who would like to subdivide the project per the easement recorded on 6/29/11 which gives
21,955sf to Angela Williams (Rodney's wife) for the lot that she owns. Rodney's interest is to make sure that the
21,955sf gets carried over to the permit. Here is what I recommend as to how to proceed. Please submita notarized
deed restriction form, http://Portal.ncdenr.orp/web)wc/ws/`su/statesw/forms docs, saying that in addition to the
recorded easement that your client will also record these restrictions to ensure that Angela Williams' lot will receive the
appropriate allocation of impervious area. That way II can accept the application once I get that form rather than
returning the package at this point, and also Mr. Williams will get the assurance that his wife's lot will get the
appropriate allocation in the permit. k
I received the documentation that Samantha Davenpl rt is the manager, so once we receive the deed restriction form as
well as the ownership change form signed by all parties we can accept the application. Please submit this within the
next week.

This is a really complicated subject, but basically the (regulations say that the permit doesn't transfer with the sale of the
property. So, the original permittee always has to sign the transfer. Generally, we don't have problems getting people
to sign forms that get them out of having responsibility. People are generally happy to get out from under it. If there is
a significant issue then please let me know and I can figure out what to do from the Attorney General's office.

We received the application to subdivide this permit, and I have two questions for you:

1.) The current permit was applied for by Franklin R Williams and Michael J. Rokoski and it was not under an LLC's
name. The current application is to be covered under Villas at Murrayville, LLC which requires a
name/ownership change form, http://portal.6cdenr.org/web/wg/ws/su/statesw/forms docs (under
miscellaneous) to transfer the permit from being under two individuals to being under an LLC. There are two
available transfer forms (there used to be only one). There was a new law passed this summer (Session Law
2011-256) that addressed transferring permits from the current permittee to a Home Owners' Association which
you can use if the subdivision was developed 'pursuant to the Planned Community Act. (You can read the details
of that in the transfer form that has been written for home owners associations.) If the development was not
developed pursuant to that act, then you use the old form (the one that doesn't say "HOA" in the title).
2.) The current application is signed by Samantha Davenport, manager. However the Secretary of State's records
(attached) do not list her as a manager. We will need a manager of the LLC to sign the appropriate paperwork.

We can hold onto applications for a short time if these things can be resolved fairly quickly. Otherwise we will return
the application. How long do you anticipate it will take to get the appropriate signatures? If it will take more than a few
days I will have to return the application.

I talked with Rodney Williams this morning (cc'd), and I think I better understand the situation. I know that you
represent the new owner who would like to subdivide the project per the easement recorded on 6/29/11 which gives
21,955sf to Angela Williams (Rodney's wife) for the lot that she owns. Rodney's interest is to make sure that the
21,955sf gets carried over to the permit. Here is what 1 recommend as to how to proceed. Please submit a notarized
deed restriction form, http://aortal.ncdenr.org(web/wcaiwsisuistatesw/forms _dots, saying that in addition to the
recorded easement that your client will also record these restrictions to ensure that Angela Williams' lot will receive the
appropriate allocation of impervious area. That way can accept the application once I get that form rather than
returning the package at this point, and also Mr. Williams will get the assurance that his wife's lot will get the
appropriate allocation in the permit.
I received the documentation that Samantha Davenport is the manager, so once we receive the deed restriction form as
well as the ownership change form signed by all parties we can accept the application. Please submit this within the

property. So, the original permittee always has to sign the transfer. Generally, we don't have problems getting people
to sign forms that get them out of having responsibility. People are generally happy to get out from under it. If there is
a significant issue then please let me know and I can figure out what to do from the Attorney General's office.

We received the application to subdivide this permit, and I have two questions for you:
1.) The current permit was applied for by Franklin R Williams and Michael J. Rokoski and it was not under an LLC's
name. The current application is to be covered under Villas at Murrayville, LLC which requires a
name/ownership change form, htt ortal.ncdenr.or web w ws su statesw forms dots (under
miscellaneous) to transfer the permit from being under two individuals to being under an LLC. There are two
available transfer forms (there used to be only one). There was a new law passed this summer (Session Law
2011-256) that addressed transferring permits from the current permittee to a Home Owners' Association which
you can use if the subdivision was developed pursuant to the Planned Community Act. (You can read the details
of that in the transfer form that has been written for home owners associations.) If the development was not
developed pursuant to that act, then you use the old form (the one that doesn't say "HOA" in the title).
2.) The current application is signed by SamanthajDavenport, manager. However the Secretary of State's records
(attached) do not list her as a manager. We will need a manager of the LLC to sign the appropriate paperwork.

We can hold onto applications for a short time if these things can be resolved fairly quickly. Otherwise we will return

THIS EASEMENT AND AGREEMENT, made this day of J tkAel
2011 by and between VILLAS AT MURRAYVILLE, LLC, a North Carolina limited liability
company with a mailing address of P. O. Box 1564, Wrightsville Beach, NC 28480,
whether one or more, called GRANTOR, and ANGELA S. WILLIAMS whose mailing
address is 5103 Lancome Court, Wilmington, NC 28409, whether one or more, called
GRANTEE.
WITNESSETH THAT:
WHEREAS, GRANTOR owns certain real property located in New Hanover
County more particularly described in a deed recorded in Book 5216, Page 2470 in the
office of the Register of Deeds of New Hanover County ("Grantor's Property"),- and
WHEREAS, GRANTEE owns certain real property located in New Hanover County
more particularly described in a deed recorded in Book 5392, Page 1432 in the office of
the Register of Deeds of New Hanover County ("Grantee's Property")-, and
WHEREAS, GRANTOR has agreed to grant to GRANTEE an Easement over
Grantor's Property for the purpose of providing connection to and use of stormwater and
sewer facilities as more particularly described below,
NOW, THEREFORE, GRANTOR, for and in consideration of the sum of Ten
Dollars ($10.00) and other valuable considerations to it in hand paid by the GRANTEE,
the receipt whereof is hereby acknowledged, by these presents does hereby grant unto
GRANTEE, her successors and assigns, an Easement as more fully described below.
1. Easement.
GRANTEE shall have a non-exclusive perpetual Easement upon, through, in and
under the Grantor's Property for the purposes of connecting to and use of the stormwater
and sewer facilities (the "Facilities") located on Grantor's Property for the benefit of
Grantee's Property.
2. Purpose of Easement.
The purpose of this Easement is for GRANTEE and its successors and assigns to
connect to and use the stormwater and sewer facilities located on Grantor's Property for
the benefit of Grantee's Property. GRANTEE'S rights shall include the right to do all
things necessary to instali, construct, repair, maintain and use the Facilities.
3. Specific Terms.
GRANTOR shall retain fee simple ownership of the Facilities located on Grantor's
Property. GRANTEE and her successor and assigns shall have the right to connect to
the Facilities at her sole cost and expense, and in accordance with all applicable State
and municipal ordinances.
GRANTOR shall maintain the Facilities located on Grantor's Property at its sole
cost and expense, in good repair until such time as responsibility for maintaining the
Facilities is accepted by the State of North Carolina or other applicable municipality.
GRANTEE shall maintain the! Facilities located on Grantee's Property at her sole
cost and expense, in good repair until such time as responsibility for maintaining the
Facilities is accepted by the State of North Carolina or other applicable municipality.
GRANTEE's rights to connect. to the stormwater facilities shall originate at the site

connect to said Facilities located on Grantor's Property.
GRANTEE's rights to connect to the sewer facilities shall originate at the site
labeled "SSMNH NO. 1K" on the attached Exhibit Map incorporated herein by this
reference and shall run upon, through, in and under the Facilities located on Grantor's
Property and shall terminate at the site labeled "SSMH NO. 1 E",
This Easement and Agreement shall supersede and replace that certain Deed of
Easement recorded in Book 5216, at Page 2466, New Hanover County Registry.

From what I understand after talking with Mr. Williams is that the small outparcel towards the front of the property
needs to split out as an outparcel/offsite lot in association with this permit. This would require a modification to the
permit for the Villas at Murrayville. An application, deed restriction form, and fee would all have to be submitted along
with any other necessary documentation.
The system isn't capable of having two open permit actions at once so the modification cannot be accepted until the
plan revision is either issued, returned, or withdrawn. The changes proposed with the plan revision could be approved
as part of the modification. The transfer could be submitted with the mod and approved after everything else is
straighten out and permitted.
It is up to the parties involved to decide how much BUA to assign to this offsite lot— it could be the full available/future
amount or a portion of it.

Mr. Williams,
I took a look at the plans and drainage area approved for the Villas at Murrayville back in 2006. I'm guessing you are
referring to the small lot along N. College Rd to the north of the apartment complex that is included in the drainage
area. 1f this lot will have a separate owner than the complex, it would be best to modify the permit to designate this lot
as an offsite lot in the permit. That would require a modified application, deed restriction form, and any other necessary
documents identified in these forms to be submitted. These forms can be found on the following website:
http:/Iportal.ncdenr.orp/web/wq/ws/su/statesw/forms dots (note the table has tabs for other forms, including the
deed restrictions).
Since this permit was originally issued to both you and Mr. Rokoski, both parties will have to sign the forms. If the plan
revision and possible name/ownership change that is currently pending on this project gets returned, then I believe the
transfer paperwork can be submitted at the same time as the modification. This would allow the permit to be modified
to add the offsite lot then would be transferred to the new owners.
The application has likely been updated since the last application was submitted for this project, but the table on page 3
of the application is where the outparcel area and allocated impervious area would be split out from the apartment
complex. The deed restriction form is to show your intent to record the necessary deed restrictions on that outparcel.

What would you like me to do with this regular program project? They have already had 58 days to respond to both
addinfos. The two week extension he is asking for here would put him at 72 days.
Background: This project originally came in as a plan revision without the PR application. I asked for the PR application
in my first addinfo with a few other small clarification items. When I got the PR application, they had a different owner
listed on the application than the permittee. My second addinfo asked to confirm the owner of this project and, if
necessary, submit a name/ownership change form. The problem is that this permit was written to 2 individuals and I
guess they are having trouble tracking down the second original owner.

The Wilmington Regional Office received and accepted a revision to the State
Stormwater Management Permit Application for the Villas at Murrayville on March 1,
2011 with additional information received on May 25, 2011. A preliminary in-depth
review of that information has determined that the application is not complete. The
following information is needed to continue the stormwater review:
Please confirm the ownership of this project. The plan revision form submitted
on May 25, 2011 indicates the owner of this project is the Villas at Murrayville,
LLC with Michael Winstead Jr. as the Manager; however, the permit was issued
on October 26, 2006 to Mr. Williams and Mr. Rokoski. Section 11.10 and 111.3 of
the issued permit requires the permittee to give notice in the event of a change in
ownership for approval by the division.
If Mr. Williams and Mr. Rokoski still own this project, please submit a corrected
plan revision form indicating them as the owners. If Mr. Williams and Mr.
Rokoski no longer own this project, please submit a name/ownership change
form with the associated documents. Please also be aware that the division
cannot approve the transfer unless the project is found in compliance with the
permit. Additionally, please keep in mind that since the 2006 permit was issued
to both Mr. Williams and Mr. Rokoski, both will have to sign any forms submitted
to the division. The two aforementioned forms can be found at the following

The Wilmington Regional Office received and accepted a revision to the State
Stormwater Management Permit Application for the Villas at Murrayville on' March 1,
2011. A preliminary in-depth review of that information has determined that the
application is not complete. The following information is needed to continue the'
stormwater. review:
1. Please provide a complete plan revision application form with an original
signature. This application form is available at the following website:

2. Please add the nearest intersection of two major roads to a legible vicinity map
on the plans. A major road is any 1, 2 or 3 digit NC, US or interstate highway.
3. All roof drainage must be directed to the pond. Please identify the roof drain
collection lines to the plan or add a note indicating that the roof drains will be
directed to the stormwater collection system.
4. Please provide additional spot elevations and/or contours to demonstrate that the
runoff from the impervious areas not previously permitted is directed to the
stormwater collection system (such as the pool enclosure and the parking in that
.area.)
Please note that this request for additional information is in response to a preliminary
review. The requested information should be received in this Office prior to May 19,
2011, or the application will be returned as incomplete. The return of a project will
necessitate resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail, email or fax your
request for a time extension to the Division at the address and fax number at the bottom
of this letter. The request must indicate the date by which you expect to submit the

the approved stormwater permit. As of today. March 1, 2011 108,102 SF of built -upon -
area (BUA) has been constructed. The site was permitted for 331,818 SF of BUA. The
attached plans show an additional 201,910 SF of BUA. After this area is constructed the
total amount of BUA will be 310,012 SF leaving an additional 21,806 SF for future BUA.

8. Corrective Actions Needed:
Silt fence needs maintenance along the retaining wall, along the east side of the pond and along the west side of the
pond. These areas of silt fence are more than half full of sediment and close to failing. Maintain silt fence
immediately.
The west side of the pond was observed rutting. Repair pond slope, and stabilize disturbed areas.
'I'he areas that were seeded appear to be dying out and limit permanent grasses were observed. Over seed as
necessary.
Was the incomplete letter addressed and a new plan showing the retaining wall located on the west side of the
property submitted?
NPDES.reports should stilt be being performed once a week and within 24 hours of a half inch or rain or more.
Reports were not observed on -site.
Time To Comply: 2 weeks to make all necessary repairs and stabilize.
