Stanley, Outback Steakhouse, Inc. Outback Steakhouse Parkway Shopping Center Morehead City, Carteret County FOR THE construction, operation and maintenance of three bio-retention areas in compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules'? and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this permit. This permit shall be effective from the date of issuance until October 30, 2013, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. Bio- retention systems 1, 2 and 3, have been designed to handle, to the maximum extent practicable, the runoff from 20,460 ft; 1,100 ft and 6,150 ft, respectively, of redeveloped impervious area. 3. The tract and the individual drainage areas will be limited to the amount of built - upon area indicated on page 3 of this permit, and per approved plans. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of the bio-retention areas. d. Immediate repair of eroded areas. e. Maintenance of required landscape plantings and groundcover in accordance with approved plans and specifications. f. Debris removal and unclogging of the bio-retention areas. g. Access to the bio-retention areas must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. At least 30 days prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name, mailing address and phone number of the purchaser or lessee. An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 9. This project was a redevelopment project that disturbed more than one acre after most of the construction was already completed. To the extent practicable, bio- retention has been provided as the stormwater treatment. The storage volume provided in the bio-retention areas may not be quite the 1" normally provided. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 13. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed into the permitted system. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 15. The permittee must maintain the current permitted drainage area. No additional runoff from outside of the permitted drainage area boundary may enter the permitted stormwater facilities without first applying for and receiving a permit modification. Ill. GENERAL CONDITIONS 1. This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 5 of 8 State Stormwater Management Systems Permit No. SW8 020905 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. The permittee shall notify the Division any owner or project name changes, ownership, and mailing address changes within 30 days. Permit issued this the 30th day of October, 2003. I apologize for not seeing this earlier. Based on 1000 trees per acre of bio-retention area, a minimum of 34 plantings is required. The ratio of shrubs to trees should range between 2:1 up to 3:1. So the number of trees should be increased to 8, and the number of shrubs you need to provide at 3:1 is 26, for a total of 34 plants. The number of plantings for Area #1 is also a little deficient. PROJECT DESCRIPTION: This project involves the construction of stormwater treatment facilities to serve the OUTBACK STEAKHOUSE restaurant constructed in Morehead City, North Carolina during the summer of the year 2002. The customer parking area is located on the redeveloped area of a previous bank parking lot. The new restaurant building is located on a portion of this bank site that was grassed. ii. SITE DESCRIPTION: The project site is located within the City Limits of Morehead City North Carolina on the south side of US Highway 70 (Arendell Street) and is an out parcel of the Parkway Shopping Center. The project site area includes 1.17 acres of leased land and totals 1.38 acres of land when the grassed portion of the NCDOT highway right of way between the property line and the street sidewalk is included. The roof of the restaurant and the grass lawn between the restaurant and the street drains stormwater runoff to a catch basin that existed prior to construction of the restaurant. The remainder of the site drains from the parking area across the Parkway Shopping Center asphalt parking lot that subsequently discharges to the headwaters of Peltier Creek at the southwest corner of the shopping center. iii. ADJACENT PROPERTY: The site is bounded on the north side by Arendell Street and on the south, east and west by the Parkway Shopping Center. iv. SOILS: Geotechnical engineering exploration conducted during the year 2002 found that the soils underlying the entire site consisted of sandy type material down to a depth of 16 feet. The groundwater was estimated to have been at an average depth of about 4 to 5 feet v. GENERAL: The stormwater management system will be constructed in its entirety, vegetated, and made operational for its intended use without interference with the operation of the restaurant or creation of sediment runoff from the site. The Owner/Developer shall not fill in, alter or modify any of the vegetative practices (ie. Bio-retention area) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division of Water Quality. Also, the following items will require a modification to the permit: transfer of ownership, project name change, redesign or addition to the approved amount of built upon area, and any revision to the approved plans. The Division of Water Quality may determine that other revisions to the project require a modification to the permit. The stormwater collection system proposed for this site will consist of three bio-retention areas. The area designated as 91 is located along the south side of the parking lot, receives sheet flow of runoff from the parking lot and discharges excess runoffto the existing shopping center parking lot The bio-retention area #2 is within the existing tree island located within the parking lot and receives runoff from a portion of the parking area drive and the adjacent sodded area. The bio-retention area 43 is located at the northeast corner of the restaurant building and receives runoff from the roof of the building. Within the site, including the sodded area between the property line and the sidewalk along Arendell Street, the impervious to pervious ratio is approximately 50/50 with 29546 square feet impervious out of a total area of 60106 square feet. By design, the flow of water near the distribution box is normally outward, from the box toward the area perimeter, serving to keep the box clear of debris. During overflow periods, it is anticipated that inflowing water will continue to push debris away from the box, again keeping debris away from the outlet. Any discharge into the overflow pipe after a rainfall event is expected to be at low enough velocities that the MECHANICAL. Your second question inquires if there is a way to get the water in the box out into the bioretention area. Referring again to the distribution box detail on the revised drawing, note that we have labeled the box to make it clear that the 6- inch gravel layer underlays a bottomless box. The water in the box will infiltrate the underlying soils and/or evaporate at the some rate as the volume of water the bioretention area is designed to capture, eventually producing a dry box. Bio-retention area one treats the stormwater runoff produced by the restaurant parking lot. Although the bio-retention area does not retain a volume equal to the one inch runoff volume for the parking lot, it will provide greater stormwater control than the existing development. What you refer to in your letter as the "Parkway Shopping Center curbing," does not currently exist. We propose its construction as a way to increase detention time and promote increased infiltration of runoff discharges from the parking lot. This short wall will separate bio-retention area one from the Parkway Shopping Center parking lot. Stormwater will be diverted to the ends of the wall where it will exit the site and follow the pre-existing stormwater drainage pattern across the shopping center parking lot. In response to your paragraph 12, we offer the following observation. Most of the trees, shrubs and ground covers specified on the landscape plan are for the general landscaping of the restaurant site. Referring to the plan, you will note that trees T-1 and T-3, shrubs S-1 and S-4, and ground cover GC2 are indicated for the bio-retention areas. These represent willow oak, eastern red cedar, common juniper, creeping juniper, and English ivy, respectively, all of which are found in Tables 4.3, 4.4, and 4.5 of the NCDENR Stormwater BMP manual (the recommended plant species for use in bio-retention areas). They're still good devices. While the project may have been approached in a manner to restrict the size of the land disturbance to under one acre at any given time, the overall measured areas that has been graded, built -upon, paved and/or landscape have exceeded one acre. This mandates that application should have been made under North Carolina General Statue (NCGS) 113A-57(4): "No person shall initiate any land -disturbing activity on a tract it more than one acre is to be uncovered unless, 30 or more days prior to initiating the activity, an erosion and sedimentation control plan for such activity is filed..." (emphasis mine). Mr. Chiles's items #3 and 94 seems to acknowledge that additional sodding work outside the previously declared limits of disturbance took place between the August 2, 2002, inspection and the inspection that precipitated the Notice of Violation on August 29, 2002. This "added area" that was resodded was uncovered and as defined in NCGS 113A-52(6), topography was changed (albeit slightly) to apply the sod, and that area did result in the overall site exceeding the established threshold for plan requirement. Under NCGS 113A-52(10b), "tract" is defined as "all contiguous land and bodies of water being disturbed or to be disturbed as a unit, regardless of ownership." The "regardless of ownership" phrase means that the work not only on the lot, but the adjacent land in the right-of-way between the lot and street pavement that was uncovered was part of the overall land disturbance. The "to be disturbed" stipulation meant that this site should have been permitted from the start, because the final landscaping was part of the overall project. Our staff could not, as a practical matter, prove it until it was done. It is the opinion of the office that the September 5, 2002, Notice of Violation is merited. if proper application is not made to this office as outlined in that Notice, you are welcome to make your opinion the basis of civil penalty appeals in this matter. If we have not received application by October 14, 2002, we will take the enforcement outlined in the Notice of Violation. The violations that were found are: Failure to file an erosion and sedimentation control plan with this office at least 30 days prior to beginning a land -disturbing activity on a tract comprising more than one acre, when more than one acre is to be uncovered, failure to secure this office's prior approval of the plan for any land -disturbing activity prior to beginning the land -disturbing activity. NCGS. 11 3A-54(d)(4), G. S. 113A-57(4) and 15A NCAC 413.0007(c). A land disturbing activity greater than one acre has occurred without an erosion & sedimentation control plan. Until the required plan has been approved, temporary measures must be provided immediately to control erosion and prevent sedimentation damage. Any additional land -disturbing activities conducted without an approved erosion and sedimentation control plan will constitute additional violations of the Act. We will notify you following our review of the plan if additional measures are required. To correct these violations, you must: 1. Submit an erosion and sedimentation control plan. 2. Install adequate and/or necessary erosion and sedimentation control measures. Please note that merely planting grass seed does not satisfy the requirements of "vegetative cover" or of "ground cover sufficient to restrain erosion." These requirements are not satisfied until a standing cover of grass or other ground cover is established which is, in fact, sufficient to restrain accelerated or man-made erosion. The penalty for an initial violation could be an assessment of up to $5,000.00. A time period for compliance is not required for enforcement of this violation pursuant to NCGS 1 13A-61.1 {c) and NCGS 1 13A- 64(a) 1. Therefore, the initial violation has been referred to the Director, Division of Land Resources, for appropriate action. Please be advised that if you fail to respond to this notice or if these violations are not corrected within 30 days of receipt of this notice, the Director, Division of Land Resources, will be requested to take appropriate legal action against you pursuant to NCGS 113A-64. That action could be the assessment of a civil penalty and the amount may be up to $5000 per day for each day of the violation. The penalty may be assessed from the date of the violation, NCGS 113A-61 (a) (1). If these violations are corrected within the time period specified for compliance, no further legal action will be pursued. Please be advised that any new land -disturbing activity associated with this project must not begin until the area presently disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify this office so the work can be inspected. You should not assume that the property is in compliance with the Act until we have notified you. After installation, all erosion control measures must be maintained in proper working order until development is complete and the site is completely stabilized. We solicit your cooperation, and would like to avoid taking further enforcement action. At the same time, it is your responsibility to understand and comply with the requirements of the Act. Copies of the relevant statute and administrative rules may be examined at this office or will be sent to you upon request.
