WHEREAS, Donnie F. King, Jr. of 110 Wintergreen Road, Wilmington, NC 28409, hereinafter called the Grantor, is the
owner in fee simple of certain real property described as follows:

WHEREAS, Lot 22R has been required to provide an infiltration system due to the piping that was constructed across the
front of the lot. The system consisting of the collection piping, entrance swale, infiltration basin, bypass structure,
overflow Wier and a 50-foot long vegetated filter.
WHEREAS, the Grantor is the applicant for a Stormwater Management permit, number SW8 020826, to install the
infiltration system on the property in accordance with the plans which form a part of the North Carolina Division of Water
Quality permit.
WHEREAS, a permit to install the piping across the front of the lot would not have been granted but for the installation of
the infiltration basin, and; within 30 days of the receipt of the permit from the North Carolina Division of Water Quality, the
Grantor shall submit to the North Carolina Division of Water Quality a certified copy of this document, as recorded in the
office of the Register of Deeds for Pender County, North Carolina; and the Grantor specifically acknowledges as fact that
said permit is issued in consideration for the execution and recording of this document and compliance with the covenants
and deed restrictions herein.
NOW THEREFORE, the Grantor, for and in consideration of the facts recited above enters into the following covenants
and deed restrictions on behalf of himself, his heirs and assigns,.
The North Carolina Division of Water Quality will have the right to enforce by proceedings in law or equity the
covenants and deed restrictions set out herein and this right shall not be waived by one or more incidents of
failure to enforce said right;
2. The maintenance of the infiltration system is the sole responsibility of the lot owner. Maintenance includes the
following items:
a. After every run-off producing event, or at least monthly, inspect the collection system, basin, bypass
structure and vegetated filter for erosion, trash accumulation, silt accumulation, vegetative cover and
general condition.
b. Repair eroded areas immediately, reseed as necessary to maintain adequate cover, mow to maintain a
maximum height of 6-inches, remove trash as needed, repair structures as needed and restore the
system to design condition.
c. Remove silt annually, or when the design depth is reduced to 1.9-feet. Do not over -excavate the system.
A 2-foot separation must be maintained between the Seasonal high Water Table elevation (1.8-Feet
FMSL) and the bottom of the basin (permitted at 4.00 FMSL).
d. If the North Carolina Division of Water Quality determines that the system is failing (evidenced by
standing water after 5 days without rain), the lot owner is responsible for repairing it to the design
condition or providing replacement stormwater management measures in accordance with 15A NCAC 2H
.1000.
3. The allowable maximum built -upon area assigned to Lot 22R is 8,894 square feet. No more than 8,894 square
feet of the lot shall be covered by impervious materials. Impervious materials include asphalt, gravel, concrete,
brick, stone, slate or similar material, but do not include wood decking or the water surface of swimming pools.
4. Without prior express written consent from the State of North Carolina these covenants may not be changed or
deleted.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of an infiltration basin in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and
the approved stormwater management plans and specifications and other supporting
data as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit.
This permit shall be effective from the date of issuance until June 9, 2013, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data. Collection piping was
added to the subdivision in violation of the low density permit, therefore, this high
density permit for Lot 22R is being issued to treat the collected runoff. The overall
subdivision must maintain compliance with the low density permit requirements
of SW8 950112.
2. This stormwater system has been approved for the management of stormwater
runoff as described on page 3 of this permit, the Project Data Sheet. The
stormwater control has been designed to handle the runoff from 65,464 square
feet of impervious area. The infiltration basin must be operated with a 50'
vegetated filter.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in it's entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. Decorative spray fountains will not be allowed in the stormwater treatment
system.
6. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
8. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
9. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction. If the proposed
BUA exceeds the amount permitted under this permit, a modification to the
permit must be submitted and approved prior to construction.

10. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, or sale of the project area. The project
area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval or a CAMA Major permit
was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12. Prior to the sale or lease of any portion of the property, the permittee shall notify
DWQ and provide the name, mailing address and phone number of the
purchaser or leasee. If access to the stormwater facilities will be restricted by the
sale or lease of any portion of the property, then an access/maintenance
easement to the stormwater facilities shall be granted in favor of the permittee.
13. The permittee must maintain compliance with the proposed built -upon area and
ensure that the runoff from all the built -upon is directed into the permitted system.
14. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
15. The permittee must maintain the current permitted drainage area. No additional
runoff from outside of the permitted drainage area boundary may enter the
permitted stormwater facilities without first applying for and receiving a permit
modification.
III. GENERAL CONDITIONS
1. This permit is not transferable except after notice to and approval by the Director.
In the event there is a desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit transfer request must be
submitted to the Division of Water Quality accompanied by an application fee,
documentation from the parties involved, and other supporting materials as may
be appropriate. The approval of this request will be considered on its merits and
may or may not be approved. The permittee is responsible for compliance with all
permit conditions until such time as the Division approves the transfer request.

2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6_ The permit may be modified, revoked and -reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.

Skipper of New Bern who owns the adjacent property to the Scotts Hill Bluff development. At this time, Mr.
Skipper has more or less tabled the discussion of selling any property to the development in favor of another
proposal. Mr. Skipper would like an easement through the property for his own development. If such 'an
easement were granted to him by the Scotts Hill Bluff POA, he would then designate a portion of land as a
neighborhood park. He would deed that acreage as non -buildable, adding it to the Scotts Hill Bluff development
and covering the overbuilds. I have forwarded to Mr. Skipper the name and telephone number of the property
manager so that he may be added to the agenda of the next meeting to make his proposal. We are no longer
members of the POA, and thus do not attend those meetings unless invited. Mr. Skipper has promised to keep
me informed of the outcome of the meeting. I will, likewise, keep your office informed. Feel free to contact me if

Hello again. Thanks for your return message Friday. 1 believe a word from you may be beneficial in encouraging
the neighborhood to at least listen to Mr. Skipper's proposal for an easement.
The contact person Mr. Skipper will be using is Steve Sulkey at Century 21 Sweyer and Associates Property
Management. He organizes the meetings, handles neighborhood complaints, etc., and is an objective third party.
He also can tell you the name of the POA attorney at this time. His number is 256-2021.
Randy Williams is the POA president at this time. However, Randy is somewhat "one-sided" on this issue since he
is one of the over -built neighbors. His e-mail is .R_ndWil@aol.com.

Donnie King Lots (Scotts Hill Bluff)

Dear Mr. King:
The Wilmington Regional Office received a Stormwater Management Permit Application
for Donnie King Lots (Scotts Hill Bluff) on August 26, 2002. A preliminary review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
V 1. Please provide a vicinity map on the plans and show the nearest intersection of
I two major roads. A major road is any 1, 2 or 3 digit NC, US or interstate highway.
J 2. Please report all built -upon areas in square feet on the application. Small areas are
easier to verify in square feet.
J3. Please provide your methodology for coming up with the 1.14 acre built -upon
area. Based on the permitted 4,414 ft2 of BUA for Lot 23 and 4,480 ftz for Lot 24,
the total onsite BUA maximum is 8,894 ft'. Adding this to the 1.07 acres of offsite
BUA results in a total of 1.27 acres, not 1.14. The system must be designed for the
maximum BUA per lot allowed, not on the;lesser amounts that might actually be
built. Please also check the 1.07 acre offsite BUA against the permitted lot
maximums per the permit issued for SW8 950112.
4. Please provide a copy of the proposed deed restrictions to include the following
conditions and limitations:
a. Lot 22R has been required to provide an infiltration basin due to the
piping that was constructed across the front of the lot. The system consists
of the collection system piping, an entrance swale, an infiltration basin,
bypass structure, overflow weir, and 50' vegetated filter.
b. The maintenance of the infiltration system is the sole responsibility of the
lot owner. Maintenance includes the following items:
1. After every runoff -producing rainfall event, or at least monthly,
inspect the collection system, basin, bypass structure and vegetated
filter for erosion, trash accumulation, silt accumulation, vegetative
cover and general condition.
2. Repair eroded areas immediately, reseed as necessary to maintain
adequate cover, mow to maintain a maximum height of 6", remove
trash as needed, repair structures as needed and restore the VLNW
system to design condition. *A

3. Remove silt annually, or when the design depth is reduced to 1.9'.
Do not overexcavate the system -a 2' separation must be maintained
between the Seasonal High Water Table Elevation (1.8 FMSL) and
the bottom of the system (permitted at 4.00 FMSL).
4. If the Division of Water Quality determines that the system is
failing (evidenced by standing water after 5 days without rain), the
lot owner is responsible for repairing it to design condition or
providing replacement stormwater management measures in
accordance with 15A NCAC 2H.1000.

J 6. Please delineate the entire 3.74 acre drainage area on a topo map.
J 7. The rules require Infiltration systems to be "off-line". All runoff in excess of the
1.5" design storm must bypass the system completely and must pass through a 50'
vegetated filter prior to discharge into Futch Creek. Please provide some type of
bypass structure with a "smart weir" at the inlet of the basin, provide a 50'
vegetated filter (must be on your property) and relocate the emergency spillway so
that any overflow from it will pass through the 50' filter before entering surface
waters. The road ditch on Futch Creek Road does not qualify as a vegetated filter
because it is located on property.owned by the DOT, and you cannot guarantee
that it will remain an open ditch.
8. Please show the mean high water line of Futch Creek or any tributaries of Futch
Creek on the plans.
9. The 20,364 cubic feet of volume is well overestimated. Per Scheuler's Rv method
described in the BMP Manual, the 1.5" design volume would be around 7,250
cubic feet. However, the basin can only accommodate about 4,650 cubic feet.
Please revise the application, calculations and supplement'to provide additional
volume to accommodate the entire design storm.
Please note that this request for additional information is in response to a preliminary
review. The requested information should be received by this Office prior to December 8, 2002,
or the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail or fax your request for
a time extension to the Division at the address and fax number at the bottom of this letter. The
request must indicate the date by which you expect to submit the required information. The
Division is allowed 90 days from the receipt of a completed application to issue the permit.

Thank you for the opportunity to assist you with this project. The results of our study are
presented the following report.
Introduction
Donnie King is planning to construct a private home on the subject site. Regulations
require the construction of a collection facility in which stormwater is collected for
infiltration into the soil. The purpose of this study was to observe the site soils with
respect to their properties influencing permeability to water and the depth to the seasonal
high water table (SHWT).
Hand auger borings were made on the subject site for the purpose of observing soil
conditions to estimate the depth to the SHWT and to estimate the soil permeability. Nine
borings were made to depth of 84 inches, or auger refusal, whichever came first. The
boring locations are depicted on the attached site map, which was supplied by Haggett
Engineering.
Observations
Borings HA-1 through HA-5 and HA-8 indicate difficult soil conditions for siting a
stormwater collection basin or trough. These borings encountered thick layers of sticky,
plastic clay soils within the soil profile. As indicated by the presence of gray colors, these

clayey soil layers have poor internal drainage. in addition, limestone was encountered at
depths of 66 in., 84 in., and 75 in. in borings HA-1, HA-2, and HA-8, respectively. Borings
HA-6, HA-7, and HA-9 revealed deep sandy soils with no indication of wetness shallower
than about 66 inches (HA-7) and no clayey horizons within 72 inches ((HA-7) of the
surface.
Conclusions
The proposed stormwater infiltration trough should be located in the portion of the subject
property where borings HA-6, HA-7, and HA-9 were made. The sandy soil layers
observed in these borings are estimated to have a permeability of at least 6 in./hr.

Narrative
Project Description
This project consists in general of the installation of an infiltration basin on a 1.05 acre
home site. The site is currently undeveloped and contains approximately nine towards the
rear of the site. The piping across the front of the property was installed in accordance
with an agreement with the Subdivision developers. Stormwater from the site will drain by
sheet flow to the grassed swale on the east side of the site and into the infiltration basin.
Additional flow is obtained from upgradient properties and the roadway via the piping
system. Flow in the grassed swale is expected to be non -erosive.
Site Description
The property comprises approximately 1.05 acres that is cleared, but currently
undeveloped. Access to the property is obtained off Marsh Field Drive. Based on sandy
soils and the size of on -site swales it appears that stormwater run-off is not typically a
problem. The site slopes to the northeast at approximately 8%.
Area Land Use
The property is located in a residential setting with adjacent parcels used for residential
purposes. Properties adjacent to U.S. Highway 17 have been converted to various
commercial uses. Areas surrounding the site consist of mixed forest with pine and various
species of hardwoods represented (oak and gum). Due to the site topography sediment
control measures will be placed primarily along the north and east sides of the site in order
to minimize the possibility of off -site impact during installation of the basin and swale.
Soils
The surficial soils at the site are comprised primarily of the Appling series which is
characterized as a well drained soil ranging from silty sands to poorly graded sand -gravel
mixtures. Soil conditioners and fertilizers are typically required to maintain vegetation. The
surface layer is typically a light silty sand approximately 6-inches thick. Permeability in the
surface layer is moderately rapid and becomes rapid in subsequent layers. Available
water capacity is typically medium and shrink swell potential is low.
The maximum non -erosive velocity for unprotected soils is 2.5 fps.
Proposed Sediment and Erosion Control Measures
Silt Fence
Silt fence will be installed along the north and east property lines in proximity to the
basin and swale to control sediment that may be transported by sheet flow run-off.

Seeding/Mulching
Disturbed areas will be stabilized as soon as practical after reaching final grade of
the area and following approval of the Owner. Temporary seeding will be provided
to disturbed areas if the area will not be actively graded for an extended period.
Seeding and mulching specifications are provided on drawing C-2.
Disturbed areas will be stabilized within 15-days after reaching final grade.
All clearing and grading will be planned and conducted to minimize the duration of
exposure of unprotected soils.

Construction Sequence & Schedule
1) Obtain plan approval for stormwater management plan.
2) Obtain other applicable permits.
3) Layout excavation limits for basin and swale and locations for control measures.
4) Conduct pre -construction conference at site to review control measures and
sequence of construction.
5) Install silt fence to prevent sediment from leaving the site to the north or east.
6) Protect trees and other vegetation to remain on -site. Grade basin and swale in
accordance with approved plan. No other site grading is required.
7) Stabilize disturbed areas using seed, fertilizer and mulch after completing land
disturbing activities. Stabilize areas within 15 days to minimize sediment loading to
infiltration basin.
8) Inspect all control measures and seeded areas weekly at a minimum. Inspect after
each rainfall event. Make timely repairs as needed. Provide additional measures if
erosion is evident or if requested by DENR.
9) Remove temporary measures only after vegetation is well established and site is
stabilized. Remove sediment that accumulates in the infiltration basin.
10) Estimated time for site soils to be disturbed is 2 weeks.

Maintenance Plan
1 } All control measures and seeded areas will be inspected after each run-off producing
rainfall event and a minimum of once per week.
2) Seeded areas will be re -seeded, watered, and soil amendments added as necessary
to promote growth of the vegetative cover.
3) Sediment will be removed from behind silt fences when it becomes approximately 6-
inches deep. Silt fence fabric, post, and wire will be repaired as necessary.
5) Remove sediment from the infiltration basin after the site has been stabilized, but
prior to installing the permanent vegetation in the basin.
