VAN DER VAART secretary TRACY DAVIS D;rector Subject: Notice of Permit Extension and Renewal Request State Stormwater Management Permit No. SW8 010647 — Soundview Park State Stormwater Management Permit No. SW8 020613 — Soundview Park Phase It Pender County Dear Mr. Bergman: Effective August 1, 2013 the State Stormwater program has been transferred from the Division of 1'Vater Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMIIR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified, transferred, or renewed. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010, The law extended the effective period of any stormwater permit that was set to expire during this tune frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177. which granted an extra year for a total of four (4) years extension. Accordingly, the subject permits, which were set to expire on the following dates, shall now be effective from the date of issuance until the new expiration date, as noted below, which includes all available extensions. Per 15A NCAC 214.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. Please complete and submit a renewal application prior to October 31, 2016. Please note that if they have not already been submitted to the Division, the permit renewal request must be accompanied by the required Designer's Certification and the recorded documents (if applicable). Please be advised that you are required to comply with the terms, conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7 until you submit the required Name/Ownership Change Form to the Division and receive approval from the Division to transfer the permit. This includes providing the necessary operation and maintenance of the permitted stormwater system. This permit expires on December 11, 2012. Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is still an active project please complete and submit the enclosed renewal application prior to June 11, 2012. If this project has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold the project please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed hands. Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system, a certification of completion be submitted to the Division from an appropriate designer for the type of system installed. This is to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. If you have not already provided a Designer's Certification to our office, please include a copy with your permit renewal request and processing fee. A copy of the certification form is enclosed for your convenience. You should be aware that failure to provide the Designer's Certification and the operation of a stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement action including the assessment of civil penalties of up to $10,000 per day. The proposed BUA's for Basins DE-3 and DE-4 listed on the application are different than what is used in the calculations. Please check and revise as needed. Response: The design has been modified to only involve one basin. This change has been reflected on the enclosed page 2 of 4 of the application. 2. The proposed infiltration basins must be offline, i.e.; the runoff in excess of 1.5" must bypass the basin before it goes through the basin. The current proposal appears to direct all runoff into the basin, and bypass from the basin. You may either revise the plans to provide offline systems, or submit revised calculations which demonstrate that the 25-year, 24-11our stone can be controlled in the basins. Response: The plans have been revised to show the offline system as requested. 3. Please specify on the plans that the boardwalk is to be raised off the ground. For clarity, a detail could be added. The site was formerly a trailer park. Phase 1 of the project has already received a stormwater permit. This submittal is for the Phase 2 improvements. PROPOSED IMPROVEMENTS Proposed improvements will include the construction of park facilities, which will include picnic areas, a riparian boardwalk, and a canoe launch, play area, small game, areas, an amphitheater, parking areas and a paved access to the Phase 1 site. DRAINAGE CONSIDERATIONS As discussed at our pre -application meeting the site built -upon is actually below the low -density threshold, even with the deduction of the wetland areas. But as we understand the parking areas are considered pockets of high density. Those areas are proposed for treatment in the form of infiltration basins. The property is undeveloped at this time, but appears to have been used as a. mobile home park in the past. The areas assessed are depicted on the drawing that you . provided (attached for reference), Field Act#vltles and Observation& We met Mr. Lewis on the subject site. Hand auger borings were made in the locations of the two proposed infiltration structures. The borings were extended to a depth of about 60 inches and the water table and soil conditions were observed North,S.xarmwater Area The soil in this area of the site was found to be loose, granular sand to the depth of boring (60 inches). The colors were dark gray in the surface 6 inches and light gray to a depth of about 18 inches. The water table was observed to be at a depth of 19 to 24 inches below the ground surface. South Sturmwarer Area The soil in this arre of the site was found to be louse, granular sand to the depth ofboring (60 inches). The colors in the first boring (eastern and of atormwater area) rangers from black in the surface 8 inches to light gay to a depth of about 14 inches. From 14 to 60 inches the soil Colors were dark gay, fine was shell fragments were common throughout. The surface 8 inches appeared to have been disturbed. The water table was observed to be at a depth of 14 inches below the ground surface_ The second boring (western end of stormwater area) were dark gray in the surface 6 inches to light gray to a depth of about 24 inches. From 20 to 60 inches the soil colors were dark gay_ Fine sea shell fragments were common, throughout. The water table was obxrved to be at a depth of 18 inches below the ground surface.
