DWQ file review revealed that the site is in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent file review. As indicated in the attached inspection report, the following deficiencies have been resolved: 1. An engineer's certification for the stormwater infiltration trench system was received on May 8, 2012. 2. Deed restrictions have been amended and recorded on December 21, 2012 as required by the permit. Please be advised that you are required to comply with the terms, conditions and limitations of your Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including operation and maintenance of your permitted stormwater system. Since these issues have been resolved and the permit is deemed compliant, and Avenir Development, LLC is now dissolved, you should transfer the permit to the Homeowners Association by completing the Name/Dwnership Transfer form located at web address http://portal.ncdenr.org/web/wq/ws/su/statesw/formsdocs. DWQ file review and site inspection revealed that the site is not in compliance with the terms and conditions of this permit. Failure to provide the requested information, or to respond to this letter by the due date, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by November 7, 2011, then DWQ staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. The deed restrictions in the permit state that the allowable built -upon area is 3,000 square feet per lot, but the recorded deed restrictions state that the built -upon area of each Lot is limited to 85% of the Lot area. As stated in Section IIJ3 of the permit, the permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all built -upon area is directed into the permitted system. Therefore, the built -upon area must be verified that it is less than 3,000 square feet per lot throughout the subdivision. The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 020406, issued to you on September 11, 2002. The project has been found in violation of Stormwater Permit Number SW8 020406, issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are: Failure to certify the stormwater system. A file review revealed that this office has not received a Designers Certificate. Permit condition states that upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed, certifying that the permitted facility has been installed in accordance with this permit, the approved ' plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 2. Failure to maintain compliance with proposed built -upon area. A file review revealed that the allowable built -upon area in the permit does not match the allowable built -upon area in the recorded deed restrictions. Permit condition states that the permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon area is directed into the permitted system. Provide a written "Plan of Action" which outlines the actions you will lake to correct the violation(s) and a time frame for completion of those actions, within thirty (30) days of receipt of this Notification. 2. Submit the required Designers Certificate. 3. Submit records proving that the allowable built -upon area (BUA) of 3,000 square feet per lot (as stated in the permit) has not been exceeded, and proving that the BUA for each infiltration trench has not been exceeded. Failure to provide the "Plan of Action" within thirty (30) days of receipt of this Notification, or to correct the violations by the date designated in the "Plan of Action", are considered violations of 15A NCAC 2H.1000, and may result in the initiation of enforcement action which may include recommendations for the assessment of civil penalties, pursuant to NCGS 143-215.6A.
