On January 11, 2012, the Wilmington Regional Office of the Division of Water Quality issued a
Notice of Inspection for Bolton Parking Expansion (currently Sunbelt Rentals) in New Hanover
County in order to resolve compliance issues with Stormwater Management Permit Number SW8 .
011102. A recent DWQ file review has revealed that a response to this letter has not yet been
received. Please find a copy of the completed form entitled "Compliance inspection Report"
attached to this letter, which summarizes the findings of the previous inspection.
As indicated in the attached inspection report, the following items must be resolved:
1. A written response with a schedule to bring this site into compliance in response to the
Notice of Inspection sent on January 11, 2012 has not been received,
Section 11.15 requires the permittee to respond within the provided timeframe with a written
time schedule to bring this site into compliance.
.2. In researching the evolution of Harris-Murr Association, Inc, it was discovered that the
company has changed names several times and was recently merged into Merrifield Patrick
Vermillion, LLC. County records also indicate that this property has been sold. Sections
11.12 requires the permittee to notify the Division of any name, ownership, or mailing address
changes within 30 days. Section Ill.1 of the permit notes that this permit does not
automatically transfer when the property is sold. The original permittee is responsible for
compliance with the permit for a site until a formal permit transfer request is
submitted to DWQ and approved.
3. Submit a signed copy of the certification (the last 2 pages of the permit)
Section I1.7 of the permit requires a certification from an appropriate designer to be submitted
upon completion of construction certifying that the permitted facility has been installed in
accordance with the permit and approved plans and specifications. Any deviations from the
approved plans and specifications must be noted on the certification as a permit modification
may be required.
4. Ensure that the runoff from all of the built -upon area within � the drainage area is directed to
the stormwater collection system. Several roof drains along the edge of the property appear
to be directed away from the stormwater collection system.
Section 1.6 of the permit requires the runoff from all built -upon area within the permitted
drainage area of the project to be directed into the permitted storrmwater control system.
5. Provide the necessary operation and maintenance including:
a. trim and maintain vegetation on the pond side slopes at a height of 6 inches
b. remove any accumulated debris, trimmed vegetation, or sediment from the pond and
repair any pond features. During the inspection, it appeared that the forebay berm
appeared had eroded away.
c. Ensure that the outlet structure is functioning properly to hold water up to the
permanent pool elevation.
Section 11.3 of the permit requires the permittee to provide the operation and maintenance
necessary to assure the permitted storrmwater system functions at optimum efficiency. The
approved Operation and Maintenance Plan must be followed in its entirety and maintenance
must occur at the scheduled intervals.

Once the compliance issues identified above have been corrected and DWQ has found the site in
compliance, the permit must be transferred to the new property owner. According to the county and
Secretary of State records, the new property owners are Clancy & Theys Construction Co. Per
Section 111,1 of the permit, DWQ must be notified and the permit must be transferred when the
property is sold. The permit will be transferred once all the necessary criteria and documentation in
the Name/Ownership change form has been met and submitted to the Division (this form is available
at: http://portal.ncdenr.org/web/wg/ws/su/statesw/forms docs. At this point the proposed permittee
(the new property owner) has the following two options:
r, Option 1: Clancy 8, Theys Construction Co can accept the transfer of the current permit.
Clancy& Theys.Construction Co should be made aware that a first time transfer is free and
the permit conditions remain the same as when the permit was originally issued under 15A
:. y• , NCAC 2H ,1005 effective September 1, 1995, which is commonly referred to as the 1995
Coastal Rules.,
Option 2: If Clancy & Theys Construction Co refuses the current permit then they will have
to apply for their own. permit', If they do not apply for a permit they will be issued a Notice of
Violation (NOV)'including possible fines for owning and operating a sormwater treatment
system and discharging to_ surface waters without a permit. This option would not be
advantageous to Clancy & Theys Construction Co because the new permit will be issued
under the 2008 Coastal Stormwater Rules (Session Law 2008-211). This means the pond
must be designed according to the standards in Session Law 2008-211 and the latest
version of the Stormwater Best Management Practices (BMP) manual. As a result, changes
in permit conditions and technical changes, such as the increase in the design storm from
1.0 to 1.5 inches, may require significant and costly physical changes to the BMP(s) currently
serving the property.
Please inform this Office in writing before August 18, 2012, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the
requested information, or to respond to this letter by the due date, may initiate enforcement action
including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not
submitted to this office by August 18, 2012 then DWQ staff will re -inspect the site and issue a Notice
of Violation if the listed deficiencies have not been addressed.

On August 8, 2011, the Wilmington Regional Office of the Division of Water Quality (DWQ)
attempted to contact you regarding the renewal of Stormwater Management Permit Number
SW8 011102 issued to Harris-Murr Association, Inc. on February 20, 2002. This letter was
subsequently returned to DWQ as undeliverable. In researching the evolution of Harris-Murr
Association, Inc, it was discovered that the company has changed names several times and
was recently merged into Merrifield Patrick Vermillion, LLC. County records also indicate that
this property has been sold. Please be aware that Section 111.1 of the permit notes that this
permit does not automatically transfer when the property is sold. The original permittee is
responsible for compliance with the permit for a site until a formal permit transfer request is
submitted to DWQ and approved.
On January 5, 2012, DWQ inspected the Bolton Parking Expansion (currently Sunbelt Rentals)
in New Hanover County to determine compliance with Stormwater Management Permit Number
SW8 011102. The DWQ file review and site inspection revealed that the site is not in
compliance with the terms and conditions of this permit. Please find a copy of the completed
form entitled "Compliance Inspection Report" attached to this letter, which summarizes the
findings of the recent inspection.
As indicated in the attached inspection report, the following items must be resolved:
1. Renew the permit prior to the expiration date, February 20, 2012.
Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals must
be submitted 180 days prior to the expiration of a permit and must be accompanied by a
processing fee, which is currently set at $505.00. Please complete and submit the
renewal application, which can be found on the DWQ website:

associated with the permit application, the possible NOV, the design and the
construction for changes to the ponds will be the sole responsibility of Clancy & Theys
Construction Co.

• The signed transfer form has been submitted.
The following items still need to be resolved prior to the transfer:
• As required by the permit, submit a copy of the designer's certification for this site. -A certification could not be found in
the file. I also spoke to the original engineering firm and they did not have one in their files.
• The roof drains along the north side of the property along the Gordon Rd Business Park are directed to an inlet that
does not appear on the approved plans for this site or the neighboring property and it is unclear where this inlet is directed
to. Please confirm whether or not this inlet directs runoff to the forebay of the pond. I did notice another pipe coming from
the direction of the neighboring building's downspouts.
• If the inlet directs runoff to your pond, please confirm that the next door building is not directing runoff to your
collection system:
• If the inlet doesn't direct runoff to your pond and instead directs runoff to your neighbors pond, you could either
re -direct the downspouts to your collection system (preferred) or look at modifying the permits for both properties (can get
very complicated).

Inspection Summary:
In order to correct the deficiencies noted and to bring this system into compliance, the following items must be resolved:
1. Respond, in writing, with a schedule to bring this site into compliance.
2. Submit a completed copy of the certification.
3. Ensure that the runoff from all of the built -upon area within the drainage area is directed to the stormwater collection
system. Several roof drain lines along the edge of the property appear to be directed away from the stormwater collection
system.
4. Provide the necessary operation & maintenance including:
a. Trim and maintain the vegetation on the pond side slopes at a height of 6 inches.
b. Remove any accumulated debris, trimmed vegetation, or sediment from the pond and repair any pond features.
During the inspection, it appears that the forebay had eroded.
c. Ensure that the outlet structure is functioning properly to hold water up to the permanent pool elevation.
7. Once the site is found to be compliant, transfer the permit to the new owners.
