Onslow County
On May 8, 2008, Mr. Chad Coburn and Mr. David Cox of the Division of Water Quality
conducted a site inspection for the First Free Will Baptist Church; located at 919 Gum
Branch Road in Onslow County, North Carolina.
Inspection Results:
The following violations were noted during the March IV'inspection:
(I) Other Waste (In -stream sediment)
(II) Wetland Standards

1. Other Waste {in -stream sediment) - Sediment has been released into a tributary to
Mill Creek. There are accumulations of between 2 inches to 8 inches of sediment over a
length of approximately 35 feet of stream. This impact represents a violation of 15A
NCAC 213 .0211 (3) f, which states: Oils; deleterious substances; colored or other wastes:
only such amounts as shall not render the waters injurious to public health; secondary
recreation or to aquatic life and wildlife or adversely affect the palatability of fish,
aesthetic quality or impair the waters for any designated uses,
IL Wetland Standards - Sediment has been deposited in wetlands at depths between 1
to 4 feet over an estimated area of 200 square feet. The deposition of sediment is
violation of the following wetland standards:
• 15A NCAC 02B .0231 (b) (1) requires that:
Liquids, fill or other solids or dissolved gases may not be present in amounts that
may cause adverse impacts on existing wetlands uses.

15A NCAC 02B .0231 (b) (5) requires that:
Hydrological conditions necessary to support the biological and physical
characteristics naturally present in wetlands shall be protected to prevent adverse
impacts on:
(A) Water currents, erosion or sedimentation patterns;
(C) The chemical, nutrient and dissolved oxygen regime of the wetland;
(D) The movement of aquatic fauna;
(F) Water levels or elevations
The project has been found in violation of Storniwater Permit Number SWS
010631, issued pursuant to the requirements of 15A NCAC 2H.1000. The
violations found are:
Failure to provide the operation and maintenance necessary to
operate the permitted stormwater management systems at optimum
efficiency. On the day of the inspection the pond forebay appeared to
be blown out. Vegetation on the pond slopes and forebay were
observed to be inadequate, which appeared to contribute to the
observed erosion.
2. Failure to submit a designers certification. Upon completion of
construction, prior to issuance of a Certificate of Occupancy and prior
to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the
permitted facility has been installed in accordance with this permit
Other Observations — It was noted during the inspection that there are plans to fill areas
on the site to provide a flat base to built a baseball diamond. It is recommended that the
existing wetland areas on site be surveyed and marked to prevent any impacts to these
areas.
Required Response
You are directed to respond to this letter in writing within 30 days of receipt.. You are
encouraged to secure a consultant to assist you with maps, plans, applications, and other
documentation necessary to bring your site into compliance. Your response must include
the following:
1. A Wetland and Stream Restoration Plan for our review and approval to
proceeding with any restoration activities.
a. This plan must include a detailed assessment/delineation of sediment
impacts and depth measurements on site and downstream of the
subdivision property line. This plan must include a map that exactly
depicts the wetlands on the tract and a description and quantification of the
impacts to the wetlands and streams.

b. Sediment in the wetland and stream at depths greater than two (2) inches
must be removed and taken to high ground and stabilized. Sediment must
be removed manually using shovels and buckets.
c. The streambed must be restored to the original profile and the stream
banks must be stabilized where necessary.
2. Please indicate in your response a schedule with dates detailing when the
restoration will be accomplished.
3. Please submit a designers certificate upon completion of the required forebay
repair
4. Please establish vegetation along the slopes of the pond and forebay in order to
prevent future erosion problems
These violations, as detailed above, are required to be immediately and properly
resolved and are subject to a civil penalty assessment of up to $25,000.00 per day for

Received complaint from Ed Beck on Friday afternoon May 2, 2008 at 4:OOpm.
Mr. Ed Harrison was concerned about a yellow colored slime getting into the creek behind his
home. He indicated that it might be coming from the First Free Will Baptist Church on Gum
Branch Rd. He resides at 104 Ivy Ridge Ct., Jacksonville, NC

On the way to the site, I phoned Mr. Harrison and indicated that I would meet him at 9:00am
the next morning.
I also called a contractor that specializes in stormwater maintenance to see if he had that
pond under contract. He indicated that he did not, but had spoken to the pastor and told him
that the pond had several problems that needed attention and that they should be performed
by someone knowledgeable with the business. He stated that the pastor wanted to do it
"themselves".
I arrived at the Church at 6:OOpm and saw the Pastor, Mr. Larry Haggard. I identified myself
and indicated why I was there. He took me to the site of the stormwater detention pond.
There was a backhoe on site at that time. There had been activity occurring at the site. They
had been digging out the forebay area and repairing the berm. I asked what he was doing
with the spoils and he indicated that he didn't know, he had been in Raleigh and was unsure
of what they did with them. I could see some of the spoils stockpiled outside of the pond near
the creek embankment. I asked him if the person digging out the berm was aware of the
design specifications of the pond and if he had the permit and plans available. He was
unaware of any of those items. I told him someone familiar with what their requirements are
for the pond should complete the repairs. At that time I left and told him I would return the
next morning.
That morning, Sat. May 3, 2008, Mr. Harrison heard noises early and went to see what was
happening, he then noted that they were loading the backhoe up and taking it away. Hay had
been placed over the spoils.
At 8:45am, May 3, 2008 1 met with Mr. Harrison and his neighbor (106) to look at the creek
behind their houses. Sediment was noted entering the creek from the spoils taken out of the
detention pond. Each time there is a rainfall event, more enters the creek. Approximately
30-40 feet of creek appeared to be impacted from the added sediment. This amount will
probably change as we have more rain.
