ARTICLE X
STORMWATER REGULATIONS AND RESTRICTIONS
The following Covenants are intended to ensure ongoing compliance with State Stormwater
Management permit Number SW8010120, as issued by the Division of Water Quality underNCAC
2H.1000. The State of North Carolina is made a beneficiary of these covenants to the extent
necessary to maintain compliance with the slortnwater management pern-►it. These covenants pertain

to stormwater may not be altered or rescinded without the express written consent of the State of
North Carolina, Division of Water Quality. Alteration of the drainage as shown on the approved
plan may not take place without the concurrence of the State. Lots within C AMA"s Area of
Environmental Concern may Have the permitted maximum built-upnn area reduced dtlC to CAMA
jurisdiction within tile, AEC.
For -High -Density Residential or Commercial Subdivisions_
A. The maximum allowable built -upon area per lot is: Lot -#I- 33.323.00 sf. Lot
42 — 51.836.00 sf, Lot #3 — 46.283.00 sf'. and Lot #4 — 122.186.00 9f. I hj i ul lotted amount
includes any built -upon area constructed within the lot property boundaries, and that porticin
of the right-of-way between the front lot line and the edge of the pavement. Built -upon area
includes, but is not limited to, structures, Asphalt, concrete, gravel, brick, stone, slate, coquina
and parking areas, but does not include raised. open wood decking, or the water surface of
swimming pools.
B. All mnoff from the built-upnn areas can the IQt must drain into the pcnnittcd
system. This may be accomplished through providing roof drain gutters which drain to the
street, grading the lot to drain toward the street. or grading perimeter swalcs and directing
them into the pond or street. Lots that will naturally drain into the 5ystcm are not required to
provide these measures.

DECLARANT RIGHTS AND DUTI.CS; ASSIGNMENT
All rights and duties granted to or vested in the Declarant may be assigned or delegated by
Declarant to such individual or group of individuals as Declarant, in its sole discretion, deems
desirable. Notwithstanding the foregoing, at the time that Declarant no longer owns any lfot in the
Subdivision, any or all such rights and duties shall be assigned to the Association by Declarant at
which time such rights and duties shall be placed in the Mends of the Board of Directors ol` the
Association and. at which time, the Board of Directors shall asyumc the role vFtile Declarant for the
purposes o l'performing or enforcing such rights and duties asset forth herein. Declarant rrttty assign
one or more rights and/or duties to the Association prior to divesting itself of ownership of all Luts-in
the Subdivision, and the Board of Directors may not refuse to accept any such assignment of rights
and duties.
