Box 4893 Wilmington, NC 28406 Subject: NOTICE OF INSPECTION Lowe's Food - Pine Grove Permit No. SW8 001027 New Hanover County Dear Mr. Garrett: Dee Freeman Secretary On June 6, 2010, David Cox of the Wilmington Regional Office of the Division of Water Quality (DWQ) inspected Lowe's Food - Pine Grove in New Hanover County to determine compliance with Stormwater Management Permit Number SW8 001027 issued on February 13, 2001. DWQ file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following deficiencies must be resolved: 1. Provide a Copy of the required Engineer's Certificate 2. Remove woody vegetation from basin slopes. Please inform this Office in writing before July 7, 2010, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, when required, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by July 7, 2010 then DWQ staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. Please be reminded that if any ownership or name change has occurred it is the permittee's responsibility to notify this office in writing. North Carolina 28403 Attention: Mr. Pete Avery Reference : Infiltration Evaluation Pine Grove Drive - Lowe's Foods Wilmington, North Carolina Job No.'. 3374-99 Dear Mr. Avery : December 23, 1999 Soil Tech Engineering, Inc. has recently conducted an evaluation of the existing site conditions for the development of the proposed Lowe's Food stored at the intersection of Pine Grove Drive and Greenville Loop Road in Wilmington, North Carolina. The purpose of this evaluation was to determine the general suitability of the on -site soils for the design and discharge of stormwater runoff from the planned development. We conducted an investigation of the subsurface soils at the designated locations indicated in the provided site sketch on December 13, 1999. The purpose of our evaluation was to determine the suitability of the in -place soils for the discharge of stormwater runoff. We investigated the subsurface soils to a depth of six feet below the existing ground surface. We also classified each subsurface strata encountered by depth and obtained representative soils samples at the designated locations. To evaluate the characteristics of the subsurface soils encountered, selected soil samples were tested in our laboratory for grain size structure in accordance with the American Society for Testing and Material (ASTM) procedures entitled AS T M D-422; "Particle Size Analysis of Soils Our sampling indicated that the subsurface soils at each test location to be moderately drainable stratas of tan to tan orange fine drained sands, Infiltration Evaluation Pine Grove Drive - L.owe's Food Wilmington, North Carolina Page Two These moderately drainable sands extended to the depths we were capable of investigating to using hand tools and was felt practical. We also conducted an evaluation of the subsurface infiltration at the three selected locations. The infiltration rate of the in -place soils were determined at a depth of approximately 30 inches below the existing ground surface at the locations investigated. This depths is where typical discharge systems are installed. The infiltration rate was found to be 0.6 inches per minute at location 1, 0.9 inches per minute at location 2, and 0.8 inches per minute at location 3, based on our analysis. We did not encounter groundwater at the locations investigated to a depth of 6 feet below the existing ground surface We encountered subsurface soils that indicate colorations which reflect drainable subsurface conditions. The seasonal high groundwater condition should be below the depths explored, in our opinion. In our opinion, the subsurface soils, groundwater depth and general site features observed during our investigation and evaluation, should fall within the regulated guidelines for the design of a stormwater infiltration system.
