PROJECT SUMMARY: The Town of Beaufort is proposing the construction of a 1,054' pedestrian walkway along Turner St. adjacent to Town Creek. Narrative Description: The proposed Town of Beaufort boardwalk project is located along Turner St. on the northern side of Beaufort in Carteret County. Turner St. is accessed from Hwy. 70 by turning left at the first stoplight when traveling from Morehead City. Town Creek borders the site to the west. The size of the project area is 5.68 acres and varies from 0' to 5' in elevation above NHW. The high ground is composed of Corolla-Urban soils and is vegetated with various grasses. There are no structures existing on high ground other than culverts passing under Turner St. Adjacent to high ground is a 20'-40' fringe of coastal marsh vegetated with Smooth Cordgrass (Spartina altemiflora) and Salt Meadow Grass (Spartina patens). There are clusters of oysters along the shoreline and oyster rocks offshore. At the northern end of the project area there are 4 N.C. Dept. of Transportation culverts that pass under Turner St. This area of Town Creek is classified by the Division of Water Quality as SC waters. It is not a PNA and is closed to the taking of shellfish. There are no shellfish leases in the area. Beaufort's Land Use Plan dated 1996 classifies this area as Parks and Open Space and Conservation within the AEC's. There exists a federal harbor of refuge in Town Creek offshore of the project site. Substrate in the area is mostly sand and mud. No SAV's were visible in the area. 10. Project Description: The Town of Beaufort is proposing to construct a 1,054'X6' boardwalk to allow pedestrians to walk alone, Town Creek from downtown Beaufort to the public boat launch area operated by Carteret County. The proposed boardwalk would begin on high ground and travel 80' before crossing 700' of coastal marsh as it parallels Turner St. It would continue over 100' of open water in the area where D.O.T. culverts pass under Turner St. The boardwalk would then cross over another 130' of coastal marsh before a 13.5' walkway would connect the boardwalk to high ground on the south end. The boardwalk would be elevated a minimum of 5' above the substrate and would extend no farther than 15' landward of NHW. The applicant has indicated that the boardwalk would be open around the clock for activities such as fishing and crabbing. Enclosed in the application package are agreements with Carteret County and D.O.T. allowing the boardwalk to pass through their riparian corridors and Right of Way. 11. Anticipated Impacts: The proposed boardwalk would result in 630 ft2 of high ground and 5,094 ft2 of coastal marsh shaded. An additional 600 ft2 of open water would be shaded and incorporated. The construction of the boardwalk could cause temporary turbidity and impacts to coastal wetlands from pile driving and foot traffic. A total of 6,324 ft2 would be disturbed during this project with no impervious area being created. The proposed dockwalk would provide the public with access to and views of Town Creek. The Contractor shall comply with all OSHA requirements and provide a competent person on site to supervise excavation at all times. 7) All fill areas/backfill shall be compacted to 95% density in accordance with AASHTO T99 as modified by the NCDOT. All material to a depth of 8 inches below the finished surface of the subgrade shall be compacted to a density equal to 100% of that obtained by compacting a sample of the material in accordance with AASHTO T99 as modified by the Department. The Contractor shall dry or add moisture to the subgrade when required to provide a uniformly compacted and acceptable subgrade. All material placed in a maximum of 6" lifts. 8) All earth areas disturbed shall be graded, dressed, seeded, mulched, and tacked with liquid asphalt or other approved means within 10 days of completion of work in any area. 9) All erosion control devices and measures shall be constructed, installed, maintained, and removed by the Encroacher in accordance with all applicable Federal, State, and local laws, regulations, ordinances, and policies. All earth areas disturbed shall be re- graded, and seeded in accordance with NCDOT Standards and Specifications. 10) All workmanship and materials shall conform to North Carolina Department of Transportation Standards and Specifications manual. 11) The encroaching party shall comply with all applicable federal, state and local environmental regulations, and shall obtain all necessary federal, state and local environmental permits, including but not limited to, those related to sediment control, storm water, wetland, streams, endangered species and historical sites. 12) All existing structures, drainage or otherwise, located inside the Right of Way that are affected by this work shall be restored to meet the NC. D. O. T. ,Standards and Specifications as directed by the District Engineer. 13) All driveways altered during construction shall be returned to a state comparable with the condition of the driveways prior to construction. NC.DOT accepts no responsibility for the existing driveways. All traffic signal or detection cables must be located prior to excavation. 20) Excavation material shall not be placed on pavement. Drainage structures shall not be blocked with excavation materials. 21) All soils located inside the Right of Way shall be considered a type "C" soil. All trenching, shoring and excavation shall follow the OSHA guidelines for this type of soil. 22) Any drop off greater than 2" from the edge of pavement shall be made safe by using a 6:1 slope or flatter or a width of 6 feet 23) Proper grading to facilitate drainage shall be done at the end of each day's activities 24)An executed copy of this encroachment agreement, contrac4 and plans shall he present at the construction site at all times during construction. Box 390 Morehead City DICM Beaufort, NC 28516 RE: Permission to Access Riparian Corridor adjacent to SR 1174 (Turner Street) in Beaufort in Carteret County Dear Mrs. Parker-Eakes, We are writing in regards to that portion of the planned 1,055+ ft. long Turner Street Boardwalk to be constructed by the Town of Beaufort through the riparian access associated with the Department's right-of-way. More specifically, we are writing about approximately 240 ft. of the proposed boardwalk to be constructed within the Department's riparian corridor as measured along the boardwalk's centerline and as generally depicted by "Exhibit 1," a copy of which is included with this letter. Given that part of the boardwalk is to be constructed through the Department's riparian corridor, we are writing per the request of the local Division of Coastal Management as expressed to your consulting engineer, Municipal Engineering Services Company, P.A., to advise you that the Department grants the Town of Beaufort the right of ingress, egress and regress, through and onto that portion of the Department's riparian corridor for purposes of constructing and maintaining the boardwalk. We hope that the information contained herein will be sufficient to satisfy the Division of Coastal Management as to the Town's ability to access to the Department's riparian corridor for purposes of constructing and maintaining the proposed boardwalk. Deese, CMC RE: Permission to Access Riparian Corridor Turner Street Boardwalk Dear Terri: I am writing per request by MUNICIPAL ENGINEERING SERVICES COMPANY, P. A. concerning the local NC Division of Coastal Management office's desire to clarify the agreement between the Town and Carteret County regarding a portion of the planned 1,055±ft. long Turner Street Boardwalk to be constructed through a portion of the riparian access associated with the County's property located immediately southwest of the Turner Street - West Beaufort Road Intersection. A portion of the boardwalk is to be located within 100±ft. of the overall riparian corridor associated with the County property. An additional 25±ft. will be constructed on the County property beyond the normal high water line. Given that part of the boardwalk is to be constructed through the County's riparian corridor as well as, on the county property, the Town and the County entered into a written Encroachment Agreement dated October 2, 2006. With this agreement, the County has granted the Town the rights of ingress, egress and regress, through and onto that portion of the County's riparian corridor and property on which the boardwalk is to be located for purposes of constructing and maintaining the boardwalk. This right of access extends from the southwestern-most point of the County's riparian access to the boardwalk's ending on the County property as depicted on the map attached to the Encroachment Agreement titled "Exhibit A." While the County is granting the Town access through our riparian corridor, the County is not relinquishing any of our own riparian rights for access to this property for other purposes. 17re L?
