Salisbury St. Suite 942-F Raleigh, NC 27604 rick.trone(ancdenr.gov Re: Response to DWR 3/19/2021 Denial / Request for Additional Information (RFAI) Cleveland Bluffs, Johnston County, North Carolina DWR # 20201842 Dear Rick, SEGi, on behalf of KG Plaza, LLC; herein referred to as the "Applicant", is submitting this response to your 19 March 2021 denial / request for additional information. Below you will find your RFAI (italicized) followed by our response: 1. PERMITTEE RESPONSIBLE MITIGATION: You have proposed a Permittee Responsible Mitigation Plan (PRMP) to address a portion of the mitigation required for the project. Please provide a complete PRMP to address how the mitigation will be implemented. In the plan please describe, at a minimum: the type of mitigation proposed (preservation, restoration, enhancement, or creation), how the mitigation will be constructed, monitored, adaptively managed, protected in perpetuity and reported to the Division. [15A NCAC 02H . 0506(c)]. The Applicant is proposing to off -set impacts to the open water area through Permiee Responsible Mitigation via stream restoration. The proposed mitigation plan is attached to the permit submittal for your review. 2. IMPACT 8 —Aerial Sewer Crossing: Please provide detailed engineering plans, profile views, and cross -sections of the proposed sewer line at Site 8 [15A NCAC 02H.0502 (a) and (c)J. Please see Sheet 5.2 of the Impact Drawings for the proposed aerial sewer crossing. Page 1 of 2 Cleveland Bluff's Response to DWR RFAI 4/05/21 5r CI 3. Impact IB — UT 2 Road Crossing: Please provide adequate justification as to why the road crossing over streamUT2 is needed [I5A NCACO2H.0506 (b)(1)J. Below is the response previously included in the 3-18-2021 RFAI response. The Applicant and I feel this represents adequate justification for the crossing. However, we would be happy to address any specific comments or provide additional information related to the crossing. Impact 1B is a re -located road crossing which provides the only means of access to the Applicant's high ground on the east side of UT2. When the Applicant originally purchased the property this upland area contained a residence that was accessed via an existing crossing further upstream. This original crossing was determined to be located on the school property to the north and had to be relocated further south (downstream) onto the Applicant's property. When the Applicant purchased the property, they had access to this area of uplands, included it as developable acreage in their contract and thus, incorporated it into their plans to develop the property. During design they chose to utilize this space as parking for trailers and recreational vehicles. Understanding that if they not had access to this area, siting the parking area in this location may require additional justification, the Applicant feels they already had access and additional justification should not be necessary. 4. RIP -RAP in UT3: Please provide the quantity, location and design of any proposed temporary impacts associated with removing the unauthorized rip -rap at the aerial sewer crossings. If the rip -rap is proposed to stay in the channel, please provide the same information and not that the requested impacts are permanent [ISA NCAC 02H .0502 (a) and (c)J. The Applicant does propose to remove unauthorized rip -rap within the stream bed. For Sites 5 and 6, the unauthorized rip rap in channel will be removed by hand. The approximate elevation of the bank full bench will be determined by an assessment of elevation data collected and visual observation. If needed, a small bench will be excavated into the existing stream bank to provide a "table" for the rip rap to sit on within the easement. It is anticipated that rip rap protection will extend along the stream bank throughout the easement. Please let me know if you have any questions or need any additional information.
