Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The townhome site is currently undeveloped. A 45-ft wide road (Edgewater Way) currently runs through the northern part of the site and provides access to other phases of the larger tract, which is under development. A 15-in culvert was previously under the road. The contractor removed this culvert and installed two larger culverts prior to obtaining permits. Therefore, the requested stream impact and Wetland Impact #3 are after the fact. 4b. Explain the purpose of the proposed project:* The purpose of the project is to construct a townhome development within a portion of the tract along Belt Road. Additionally, the existing road that provides access to other phases of development will be improved. Wetland impacts are needed for grading fill associated with the townhomes. Stream impacts are needed to improve the road. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The townhome development will have 60 units, associated parking, utilities, and stormwater facilities (see Site Plan; CS-101). One stormwater pond is proposed north of the road, as depicted in Figure CS-100. A retaining wall will be used at Wetland Impact #1 to reduce fill. The project also entails the upgrading of an existing road to widen it and also to replace the existing culvert with (2) 30" culverts to accommodate large storm events (see Stream Crossing Detail). Standard construction equipment will be used. The extreme variation from normal flow to the flow following large storm events raises potential concerns when designing the culvert upgrades. The engineer considered both single pipe and double barrel culverts when designing the road improvements. These considerations were based on the culvert being sized to handle flow from the 25-year storm event without overtopping the roadway embankment. This sizing was based on the use of the USGS streamstat report at this location, and associated design flow of +/-95 cfs. Modeling results indicate that in order to provide the necessary design flow without significantly altering the stream grades and flow velocities, either (2) 30" pipes or a single 48" pipe is required. Given the shallow normal flow, the narrow width, and relatively flat natural grade of this particular stream, both of these options require a widening of the natural stream bed to accommodate the culverts. The engineer felt that the (2) 30" pipes were a better option given the adjacent site grades and proposed roadway grade. If a single 48" pipe is to be used, the roadway grade would need to be raised to provide sufficient pipe cover for protection of the culvert. This would result in additional tie grading limits, and increased linear stream impacts, as well as increased wetland impacts compared to the use of (2) 30" pipes. 4j. Impacts couldn't be avoided without eliminating several buildings, which wasn't economically feasible. Additionally, several feet of fill is needed and impacts are needed to tie into existing grades. The applicant will utilize a retaining wall at Wetland Impact #1 to reduce impacts. 1b. The Atlantic sturgeon and American alligator are known to occur within one mile of the site. The sturgeon is likely within Topsail Sound, located - 3/4 mile southeast of the site. The American alligator may be found within lower sections of Mill Creek, located off property. The stream within the site is likely too small to provide suitable habitat for the species. Additionally, the site supports a pine -hardwood canopy or a hardwood canopy with a dense shrub layer and would not provide suitable habitat for the red cockaded woodpecker. Forested areas within the site may support appropriate roosting habitat for the northern long-eared bat. The NLEB is known to occur in Pender County; however, no roost trees are known in the County.
