Division staff has confirmed that the subject permit is no longer required. Therefore, in
accordance with your request, NPDES Permit NC0023761 is rescinded, effective immediately.
If in the future your company wishes to discharge wastewater to the State' s surface waters, you.
must first apply for and receive a new NPDES permit. Discharge of wastewater without a valid
NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day.

Your NPDES permit expires on July 31, 2005. Federal (40 CFR 12.2.41) and North Carolina (15A NCAC
2H.0105(e)) regulations require that permit renewal applications must be filed at least 180 days prior to expiration of
the current permit. if you have already mailed your renewal application, you may disregard this notice.
To satisfy this requirement, your renewal package must be sent to the Division postmarked no later than
February 1, 20O5. Failure to request renewal by this date may result in a civil assessment of at least $500,00. Larger
penalties may be assessed depending upon the delinquency of the request.
If any wastewater discharge will occur after July 31, 2005, the current permit must be renewed. Discharge of
wastewater without a valid permit would violate North Carolina General Statute 143-215.1; unpermitted discharges of
wastewater may be assessed civil penalties of up to $25,000 per day.
If all wastewater discharge has ceased at your facility and you wish to rescind this permit, contact e at the

solids) generated during wastewater treatment are handled and disposed. If your facility has no such

The above requirement does NOT apply to privately mined facilities treating 100%
domestic wastewater, or facilities which discharge non -process wastewater cooling
water, filter backwash, etc.)

Due to a change in fees effective January 1, 1.999, there is no renewal fee required with your
application package.

were clear with no oil sheens or foam. The site grounds were we maintained and the maintenance
personnel were in the process of removing the small amount of fuel frond a deteriorated above ground

evidence of leakages or spills were observed in these areas,

Comment: The records reviewed during the inspection were organized and well
maintained. Discharge Monitoring Reports (DMRs) were reviewed for the period
January 2010 through December 2010. The facility did not report a discharge during
this review period. The facility staff must ensure of the fcllowinT permit required
analyses. are only performed and reported during discharge events, effluent values are
reported down to the method detection level (ex. <10 m.giL and not "BRL°'), and each
applicable DMR (submitted to the Division) contains a written statement that no

A recent file review found that the Division of Water Quality (DVVQ) compliance reporting database
has flagged the National Fruit Company Lincoln county plant for permit monitoring/reporting violations
for flow, pH, and temperature in multiple months in the past two years. A listing of the flagged
violations appears in the attached table and the following sections will discuss changes you need to
make to comply with the reporting requirements of your permit. The compliance database generates
violations after the data from your monthly Discharge Monitoring Reports (DMRs) has been entered
and compared with the requirements of your permit, NC0023761,
Flow
Your permit requires that effluent flow be measured monthly through an instantaneous reading. This
requirement prompts the DWQ database to look for flow readings on a minimum of one day during a
given reporting month. A review of the May 2010 DMR found that you did not report flow on any of
the days during the month but did report effluent readings for temperature and total residual chlorine
on May 28, 2010, You should have reported flow on May 28, 2010. if there was no discharge from
your facility on that day flow should be reported as 0 MGD and no other parameters should be
reported since you are stating you did not discharge effluent, Please review the attached table for
those DMRs listed with flow monitoring violations and submit an amended DMR to this Office for each
DMR. The amended DMR should include a flow reading on at least one day during the monitoring
month and should be marked "Amended" at the top of the page with the missing flow data highlighted
for easier data entry into the DWQ compliance database.
pH
Your permit requires that effluent pH be measured monthly in a grab sample when the facility is
discharging. This requirement prompts the DWQ database to look for pH readings on a minimum of
one day during a given reporting month. A review of the May 2010 DMR found that you did not report
pH on any of the days during the month but did report effluent readings for temperature and total
residual chlorine on May 28, 2010, This indicates to this Office there was a discharge from the
facility. You should have reported pH for the effluent sample collected on May 28, 2010, if there was
a discharge from your facility otherwise the pH and other columns should'have been left blank (no
effluent discharge). Please review the attached table for those DMRs listed with pH monitoring
violations and submit an amended DMR to this Office for each DMR, The amended DMR should

column should be left blank and "Amended" should be noted at the top of the page.
Temperature
Your permit requires that effluent temperature be measured monthly in a grab sample when the
facility is discharging. This requirement prompts the DWQ database to look for temperature, readings
on a minimum of one day during a given reporting month, A review of the July 2009 DMR found that
you reported No Dischargeon the DMR but provided a total residual chlorine (TRC) reading on July
28, 2009. Data entry personnel entered the TRC value and noted there was no flow, temperature, or
pH data reported since they assumed there was an effluent discharge (TRC value reported). Please
submit an amended July 2009 DMR to this Office without a TRC value if there was No Discharge'
during the rnonth,
Total Residual Chlorine
Sporadically over the last two to three years you have reported "BRL" in the TRC column, which
represents "below reporting limit", By using "BRL" you are not meeting the minimum detection level
(MDL) requirements for total residual chlorine as required by the permit "SRL' is not an acceptable
value as you are required to report a numerical value for each parameter that must be monitored
under your permit.
National Fruit Company, Inc. has a 17 ug/L permit limit and must demonstrate that you or your
designee (contracted analytical laboratory) have calibrated the relevant analytical equipment and can
detect total residual chlorine at the permit limit of 17 ug/L (i.e., MDL of 17 ugly For example, if the
analytical laboratory calibrates the TRC meter at a level of 15 ug/L (MDL) and they obtain a reading
of 12 p.g/L then a value of <15 ugh. would be reported on the corresponding DMR not BRL. If the
analytical laboratory obtains a TRC reading above 15 ug/L then that reading since it is above the
MDL would be noted on the corresponding DMR. All TRC values s50 tig/L. will be considered as
compliant by the Division under the TRC policy issued an May 1, 2008. Please make the necessary
changes to your total residual chlorine reporting to substantiate compliance with your permit when
there is a discharge from your facility.
From this point forward, please ensure that you are meeting your monitoring and reporting
requirements under NC0023761 using the discussions above. The requested "Amended" DMRs
should be submitted to this Office by October 29, 2010. Each time the DWQ compliance
database flags a violation it is passed along to the EPA Enforcement and Compliance History Online
(ECHO) database available at http://www,epa-echo,gov/echoie, The EPA database is available to the
general public to track the compliance history of permittees under the Clean Water Act and you may
use this database to track compliance with your permit. If you have questions concerning this matter,

A recent file review found that the Division of Water Quality (DWQ) compliance reporting database
has flagged the National Fruit Company Lincoln county plant for permit monitoring/reporting violations
for flow, pH, and temperature in multiple months in the past two years. A listing of the flagged
violations appears in the attached table and the following sections will discuss changes you need to
make to comply with the reporting requirements of your permit. The compliance database generates
violations after the data from your monthly Discharge Monitoring Reports (DMRs) has been entered
and compared with the requirements of your permit, NC0023761.
Flow
Your permit requires that effluent flow be measured monthly through an instantaneous reading, This
requirement prompts the DWQ database to look for flow readings on a minimum of one day during a
given reporting month. A review of the May 2010 DMR found that you did not report flow on any of
the days during the month but did report effluent readings for temperature and total residual chlorine
on May 28, 2010. You should have reported flow on May 28, 2010, If there was no discharge from
your facility on that day flow should be reported as 0 MGD and no other parameters should be
reported since you are stating you did not discharge effluent. Please review the attached table for
those DMRs listed with flow monitoring violations and submit an amended DMR to this Office for each
DMR. The amended DMR should include a flow reading on at least one day during the monitoring
month and should be marked "Amended" at the top of the page with the missing flow data highlighted
for easier data entry into the DWQ compliance database.
pH
Your permit requires that effluent pH be measured monthly in a grab sample when the facility is
discharging. This requirement prompts the DWQ database to look for pH readings on a minimum of
one day during a given reporting month. A review of the May 2010 DMR found that you did not report
pH on any of the days during the month but did report effluent readings for temperature and total
residual chlorine on May 28, 2010. This indicates to this Office there was a discharge from the
facility. You should have reported pH for the effluent sample collected on May 28, 2010, if there was
a discharge from your facility otherwise the pH and other columns should have been left blank (no
effluent discharge). Please review the attached table for those DMRs listed with pH monitoring
violations and submit an amended DMR to this Office for each DMR. The amended DMR should

Temperature
Your permit requires that effluent temperature be measured monthly in a grab sample when the
facility is discharging. This requirement prompts the DWQ database to look for temperature readings
on a minimum of one day during a given reporting month. A review of the Jury 2009 DMR found that
you reported "No Discharge" on the DMR but provided a total residual chlorine (TRC) reading on July
28, 2009. Data entry personnel entered the TRC value and noted there was no flow, temperature, or
pH data reported since they assumed there was an effluent discharge (TRC value reported), Please
submit an amended July 2009 DMR to this Office without a TRC value if there was No Discharge"
during the month.
Total Residual Chlorine
Sporadically over the last two to three years you have reported "BRL" in the TRC column, which
represents "below reporting limit". By using "BRL" you are not meeting the minimum detection level
(MDL) requirements for total residual chlorine as required by the permit, "BRL" is not an acceptable
value as you are required to report a numerical value for each parameter that must be monitored
under your permit.
National Fruit Company, Inc, has a 17 LigIL permit limit and must demonstrate that you or your
designee (contracted analytical laboratory) have calibrated the relevant analytical equipment and can
detect total residual chlorine at the permit limit of 17 j_Lg/L (i.e., MDL of 17 Li.g/L), For example, if the
analytical laboratory calibrates the TRC meter at a level of 15 Lig/ (MDL) and they obtain a reading
of 12 ug/L then a value of <15 ug/L would be reported on the corresponding DMR not BRL, If the
analytical laboratory obtains a TRC reading above 15 Lig/L.. then that reading since it is above the
MDL would be noted on the corresponding DMR. All TRC values 5_50 ugit will be considered as
compliant by the Division under the TRC policy issued on May 1, 2008 Please make the necessary
changes to your total residual chlorine reporting to substantiate compliance with your permit when
there is a discharge from your facility.
From this point forward, please ensure that you are meeting your monitoring and reporting
requirements under NC0023761 using the discussions above, The requested "Amended" DMRs
should be submitted to this Office by October 29, 2010. Each time the DWQ compliance
database flags a violation it is passed along to the EPA Enforcement and Compliance History Online
(ECHO) database available at http://wvvw.epa-echo.goviechot The EPA database is available to the
general public to track the compliance history of permittees under the Clean Water Act and you may
use this database to track compliance with your permit_ If you have questions concerning this matter,

The subject permit's expiration date is July 31, 2010. Federal [40 CFR 122] and state (15A NCAC
2H.O1O5 (e)) regulations require that an application for permit renewal be filed at least 180 days prior to
expiration of the current permit. To satisfy this requirement, your renewal package should have been sent
to the Division postmarked no later than February 1, 2010.
As of this date, the Division has not received your renewal application. This is a violation of Part I.I.
B. 10. of your permit, which states "Any permittee that has not requested renewal at least 180 days prior to
expiration...will subject the permittee to enforcement procedures as provided in NCGS 143-215.6 and 33
USC 1251 et. seq.". To prevent an assessment of civil penalties you must submit a completed
permit application (see enclosed' forms) no later than March 12. 2010.
Use the enclosed checklist to complete your renewal package. The checklist identifies the items you
must submit with the permit renewal application. If all wastewater discharge from your facility has ceased

This is to inform you that the Division of Water Quality has not received your discharge monitoring report
(DMR) for March 2009,. Water quality regulations require that monthly monitoring reports shall be filed no later
than 30 days after the end of the reporting period for which the report is made, Failure to submit reports as
required will subject the violator to the assessment of a cavil penalty of up to $25,000 per violation, It should also
be noted that your February 2009 DMR was not received in our office until May 5, 2009, more than a month
beyond the regulatory deadline,
To prevent further action, please submit this report to the Division's Central Files office at the letterhead address
within 15 days or notify this office as to any problem preventing its ,timely receipt. You will be considered
noncompliant with the self -monitoring requirements of your NPDES permit until the report has been submitted,
Additional action, including the assessment of civil penalties, may be taken if the report is not submitted within
the time frame specified above.
This letter additionally provides notice that this office will recommend the assessment of civil penalties if future

total residual chlorine violation and the monitoring violations attributed to the facility's continued failure
to obtain a laboratory certification, as detailed in the Compliance Evaluation Inspection. (CEI) report
attached to the letter, Based on the facility's corrective actions as addressed in the written response dated.
July 23, 2007 and the verbal conversations with Mr, Tim Fredeli (Main.tenance Manager), this Office has
decided not to pursue an enforcement recommendation at this time. This Office appreciates your timely

The following is an official response to violation (# NDV-2007-PC-0471) sent to
this facility on July 9 addressed to David Gum (owner of National Fruit Product
Company Inc), The violation has two (2) parts. Our first infraction was exceeding our
permitted Total Chlorine levels. When Mr. Wes Bell first brought this to my attention,
June 29, we had several paths we could pursue to reduce our chlorine release levels. We
had the option of installing a de -chlorination system. This would require additional.
equipment and engineering, thus extending the time required to comply. We also had the
option of increasing residence time in our pond by pumping the influent water in a
direction that would allow the full usage of the available surface area. Mr. Bell and I
agreed that this would be the best initial course of action. Our aeration pump was
relocated to accomplish this on July 7. Since that date our employee field tests have
shown compliance levels on total chlorine. That brings us to our second violation,
Effluent sampling. We received notice of failure to comply on Record Keeping. It was
brought to my attention that this facility was not a certified lab and our employee test
results were not valid. Until such time, we will employ an independent lab to collect and
test our effluent discharge. We will actively pursue the correct documentation and
permits that will enable us to achieve our certified lab status. Please consider our
revisions appropriate.

maximum effluent total residual chlorine violations (2 total) were reported in February 07
and March 07, The Division will separately address these violations by the issuance of
either an NOV or NOV/civil penalty assessment. The facility reported invalid effluent
temperature and pH data during the entire review period (24 total violations). See
"Laboratory" and "Effluent Sampling" Sections for additional comments.

The following is an official response to violation (# NOV-2007-PC-0474) sent to
this facility on July 10, 2007 addressed to Mr. David. Gum (owner of National Fruit.
Product Company Inc). The violation is in response to the company's failure to develop
and implement a Storm Water Pollution Prevention Plan, Qualitative Monitoring
and Permit/Outfalls. This is mandatory under the permit that has been issued to
National, Fruit.
We are currently working closely with Mr. Wes Bell on several items, which
include renewing our storrn water discharge permit, updating our storm water program,
and conducting qualitative monitoring as required.
The updated storm water pollution prevention plan is being written to reflect the
absences of equipment and processes that are no longer in existence here at this facility.
We have also employed a local lab (Prism labs) to conduct testing on storm water as
required. This test will be dependent on the next available precipitation event. Understand
that it is our intention to comply with the permit requirements and we will be happy to
submit our updated plan when finalized. This updated program should be completed
before August 1, 2007.

Enclosed please find a copy of the Compliance Evaluation Inspection Report for the inspection
conducted at the subject facility on June 26, 2007, by Mr. Wes Bell of this Office. Please advise the
facility's Operator -in -Responsible Charge of our findings by forwarding a copy of the enclosed report.
This report is being issued as a Notice of -Violation (NOV)/Notice of Recommendation for
Enforcement due to the effluent total residual chlorine 'limit violation (measured during the inspection) and
the monitoring violations attributed to the facility's continued failure to obtain a laboratory certification in
violation of the subject NPDES Permit, North Carolina General Statute (G,S.) 143-215.1, and North
Carolina Administrative Code (NC AC) 2H .0804, as detailed in the Record Keeping, Effluent Sampling,
Laboratory, and Effluent Pipe Sections of the attached report. Pursuant to G.S, I43-215.6A, a civil
penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person
who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued
pursuant to G.S. 143-215.1.
It is requested that a written response be submitted to this Office by July 30, 2007 addressing the
above -noted violations in the attached report. In responding to the above noted violations, please address

Comment: The pH, temperature, and TRC of the cooling water discharge (at the
holding pond confluence) were measured at 7,20 s.u., 32.1 degrees celsius, and 3,0
mg/1 (3000 ug/I). The reaeration system (pump) used in the holding pond should be
repositioned to the outlet of the cooling water discharge.

In response to Notice of Violation NOV-2006-PC-0107, in November 2002, National Fruit
Product Company, Inc. applied for Field Parameter Environmental Laboratory Certification.
As outlined in an October 15, 2001 memo from Steve Tedder, Laboratory Section Chief,
regarding Revised Certification Rules (attached), National Fruit obtained a blind sample from
NSI Environmental Solutions Inc., in Raleigh NC. The sample, #N23380 was tested for pH.
`fhe results and completed forms (attached) were returned to NSI Solutions Inc., as indicated
on the cover sheet on November 18, 2002. We indicated that the evaluation results should be
reported directly to "State Accreditation Agency (NC DENR DWQ) and US EPA".
Since that time, we have operated with the assumption that National Fruit Product Company,
Inc. had met the criteria. In a conversation with Mr. James Bealle at the NC DENR DWQ
Mooresville office and a follow-up phone call to NSI Solutions, we discovered that NSI
Solutions had not received the completed forms and consequently, had not provided any
evaluation results to the State Accreditation Agency.
As a result of our conversation and Notice of Violation, National Fruit Product Company, Inc.
will reapply for Field Parameter Environmental Laboratory Certification. We will obtain
another blind sample from NSI Environmental Solutions Inc. This time however, we will
follow up and ensure that results are reported to the NC DENR DWQ.
It remains our intent to be compliant with regulations of the NC DENR„

The Environmental Management Commission has approved, by temporary rule, the proposed changes to the
Laboratory Certification Rules (15A NCAC 2H .0800). In accordance with North Carolina General Statutes, the
proposed revisions set out certification criteria for laboratory facilities performing any tests, analyses,
measurements, or monitoring required under Article 21 of 3.3. § 143. The 1...-abc.vatcry Certincetion Rules contain
changes, which will affect those classified facilities that have been formerly exempted from laboratory certification.
Copies of the rules may be obtained from the Division website at: www.esb.enr.state.nc.us/lab, or by requesting a
copy from Carolyn Sanders at (919) 733 -3908 extension 205.
As of October 1, 2001, facilities or management companies analyzing on -site field tests for reporting purposes of a
classified facility must apply for certification status as a Field Parameter Laboratory. All applications must be
received on or before December 31, 2001. No exemptions will be allowed as of October 1, 2001. (Note: If your
facility has not been classified by the Technical Assistance and Certification Unit of the Division, then you do not
require an exemption„ior do you require certifica(ion.) Enclosed for your use are an application form, and an
instructional guidance document to aid you in the application process.
The Division realizes that implementation of this rule will not be without some difficulty. Facilities may have to re-
evaluate the methods in use, and possibly, purchase instruments approved for these analyses. Our laboratory
certification staff will be available to answer questions regarding these changes. We encourage all facility managers
to obtain access to the Internet, as both a cost -savings and communication efficiency measure.

Supervisory Requirements:
e supervisor of a field parameter certified laboratory must meet at least one of the following requirements; 1) an Operator's
ertification equivalent to the type or grade of the regulated facility (es) * These Operators Certificates are issued by the Water
Pollution Control Systems Operators Certification Commission, 2) a minimum of a B,S, or A.B, degree in chemistry or closely related
science curriculum from an accredited college or university plus a minimum of six months laboratory experience in analytical
chemistry; 3) a two year associate degree from an accredited college„ university, or technical institute in chemistry technology,
environmental sciences, or closely related science curriculum plus a minimum of two years experience in analytical chemistry; or 4)
non -degree supervisors may have at !east six years laboratory experience in analytical chemistry.

Instruction Guidance for Completing a Field Parameter Certification Application
1) Supervisory Requirements:
The supervisor of a field parameter certified laboratory must meet at least one of the following requirements: 1) an Operators
Certification equivalent to the type or grade of the regulated facility (les). These Operators Certificates are issued by the Water
Pollution Control Systems Operators Certification Commission 2) a minimum of a B.S. or A.B. degree in chemistry or closely related
science curriculum from an accredited college or university plus a minimum of six months laboratory experience in analytical
chemistry; 3) a two year associate degree from an accredited college, university, or technical institute in chemistry technology,
environmental sciences, or closely related science curriculum plus a minimum of two years experience in analytical chemistry, or 4)
non -degree supervisors may have at least six years laboratory experience in analytical chemistry.
2) Fees:
Do not submit annual fees until you are issued an invoice, Application fees do not apply to Field Parameter Certification.
An applicant for Field Parameter certification is not charged by the Department of Environment and Natural Resources, Laboratory
Section for the evaluation and processing of the application. Invoices for annual Certification fees will be mailed after the evaluation
has been completed, Your facility may continue to analyze samples until the State Laboratory has issued or denied certification.
Annual Certification Fees will be calculated in accordance with 15A NCAC 2H .0800, An annual minimum fee of $100,00 will be
assessed to all Municipal,/ Industrial Field Parameter certified labs arid a fee of $200.00 will be assessed to all Commercial Field
Parameter certified laboratories.
3) Methods:
In accordance with DWQ policy, a facility is expected to use approved methods for the collection, preservation and analysis of
samples following program requirements. All test procedures must produce detection and reporting levels below the permit
discharge requirements and all data generated must be reported to the approved detection level or lower reporting level of the
procedure. Indicate the lowest quality control check standard value in the box labeled "lower reporting limit concentration", For
example, if you currently analyze standards of 100 jig/L, 125 jiig/L and 150 jig/L for Total Residual Chlorine, you would enter the 100
ugIL value as your current lower reporting limit.
4) EPA Lab Code:
To obtain an EPA Lab Code, contact Mr, Charles Feldmann at 513 - 569 - 7671, or e-mail her at Feldmann,Charles@epa,gov If
your laboratory has been issued a US EPA lab code in the past, it can be located on any report issued by the EPA: It is the 7 digit
alpha numeric code beginning with the postal code for the state (NC), followed by 5 numbers. (Example: NC11111)
5) Proficiency Testing:
Once certified, this office must receive acceptable proficiency test sample results from an accredited provider. The following
parameters require annual proficiency testing of blind or "unknown" value: pH, Total Residual Chlorine, Settleable
Residue, and Conductivity. Applicants for 2006 Field Parameter Laboratory Certification must supply acceptable results no
later than December 31, 2006. We encourage all applicants to complete this requirement as soon as possible to prevent

Immediately following the inspection on April 04, 2005, the source of the red wastewater
was identified and eliminated. An aerating pump system was added to the effluent pond to
increase dissolved oxygen levels.. Since the inspection, the pond's effluent has returned to
6.29 s.u., as of April 20, '2005.
Further investigation of the October 04 OMR indicated that the submitted information
matched Novetnber's field data sheet. In other words, the wrong field data sheet was used
to prepare the October DMR, The ORC has been instructed to verify that all DM.Rs
coincide with field data sheets 'before the) are submitted, Ile has been instructed to record.
all production shut -down periods on DMRs. Field data sheets will be reviewed .for
completeness and accuracy. The ORC has been instructed to notify management
immediately if an out -of -compliance condition is found or if any condition is found, that
might compromise the pond,
We regret that this incident has occurred. It has however directed more deliberate attention
to our field data sheets, the DM:Rs and the responsibilities of the ORC. If you have any
additional comments, questions or concerns, please notify the LD. Shockley at the
Lincolnton plant directly at 704-'735-2531.

was identified and eliminated. An aerating pump system was added to the effluent pond to
increase dissolved oxygen levels. Since the inspection, the ponds effluent has returned to
6.29 s.u., as of April 2.0, 2005.
Furth er° investigation of the October 04 DMR indicated that the submitted information
matched Novembers. field data sheet. In other words, the wrong field data sheet was used
to prepare the October DMR. The ORC has been instructed to verify that all DMRs
coincide with field data sheets before they are submitted. He has been instructed to record
all production shut -down periods on DMRs. Field data sheets will be reviewed for
completeness and accuracy. The ORC has been instructed to notify management
immediately if an out -of -compliance condition is found or if any condition is found, that
might compromise the pond,
We regret that this incident has occurred. It has however directed more deliberate attention
to our field data sheets, the DMRs and the responsibilities of the ORC. If you have any

This report is being issued as a Notice of Violation (NOV) due to the monitoring and limit
violations (measured at the time of the inspection) of the subject NPDES Permit and North
Carolina General Statute 143-215.1 as detailed in the Operations & Maintenance and Record
Keeping Sections of the attached report. Pursuant to NCGS 143-215.6A, a civil penalty of not
more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who
violates or fails to act in accordance with the terms, conditions, or requirements of any permit
issued pursuant to NCGS 143-215.1. Should this Office make an enforcement recommendation
relative to the violation, you will be advised in writing.
It is requested that a written response be submitted to this Office by May 2. 2005,
addressing the deficiencies noted in the Operations & Maintenance, Record Keeping, and
Effluent Pipe Sections of the report. In responding, please address your comments to the

A stormwater drainage ditch that discharges into the effluent pond appeared red with a pH of 3,27 s;.u. The
red wastewater appeared to have originated from an accumulation of bottles (sore with product in :.hem)
upq.radi,ent of the pond, The ORC indicated. that the bottles were the result of a production shutdown several
months earlier. The effluent pond's pH was measured. at 5,77 s,u, and the pond's effluent was measured at
5,90 s,u, (Permit limit violation). The permit only allows non -contact cooling water, bottle irGse wa4es,
and stormwater to be discharged into the pond* In addition, the permit requires the facility to be properly
operated and maintained at all times.
RECORD KEEPING SECTION cont'd.
DMRs were reviewed from, January 04 through December 04. No limit violations were reported. The facility
did not sample according to Permit requirements during May 04 and June 04, T e facility noted a production
shutdown from 5/9/04 - 6/11/04, however, the ORC indicated the facility did produce a discharge prior to and
following the above -noted dates. The October 04 DMR, data did not coincide with the facility's field data and
the pH value in August 04 was actually the pH sample's analysis time. In addition, the actual pH value dAxigust
