Sullins Director September 22, 2010 cwAL 66 L. 4010 AllOORES VILLE REGIONAL OFFICE 666 - 6, ZOVI K Subject: Monitoring Violations Nov 3 0 National Fruit Company NPDES Permit No, NC0023761 Lincoln County A recent file review found that the Division of Water Quality (DVVQ) compliance reporting database has flagged the National Fruit Company Lincoln county plant for permit monitoring/reporting violations for flow, pH, and temperature in multiple months in the past two years. A listing of the flagged violations appears in the attached table and the following sections will discuss changes you need to make to comply with the reporting requirements of your permit. The compliance database generates violations after the data from your monthly Discharge Monitoring Reports (DMRs) has been entered and compared with the requirements of your permit, NC0023761, Flow Your permit requires that effluent flow be measured monthly through an instantaneous reading. This requirement prompts the DWQ database to look for flow readings on a minimum of one day during a given reporting month. A review of the May 2010 DMR found that you did not report flow on any of the days during the month but did report effluent readings for temperature and total residual chlorine on May 28, 2010, You should have reported flow on May 28, 2010. if there was no discharge from your facility on that day flow should be reported as 0 MGD and no other parameters should be reported since you are stating you did not discharge effluent, Please review the attached table for those DMRs listed with flow monitoring violations and submit an amended DMR to this Office for each DMR. The amended DMR should include a flow reading on at least one day during the monitoring month and should be marked "Amended" at the top of the page with the missing flow data highlighted for easier data entry into the DWQ compliance database. pH Your permit requires that effluent pH be measured monthly in a grab sample when the facility is discharging. This requirement prompts the DWQ database to look for pH readings on a minimum of one day during a given reporting month. A review of the May 2010 DMR found that you did not report pH on any of the days during the month but did report effluent readings for temperature and total residual chlorine on May 28, 2010, This indicates to this Office there was a discharge from the facility. This requirement prompts the DWQ database to look for temperature, readings on a minimum of one day during a given reporting month, A review of the July 2009 DMR found that you reported No Dischargeon the DMR but provided a total residual chlorine (TRC) reading on July 28, 2009. Data entry personnel entered the TRC value and noted there was no flow, temperature, or pH data reported since they assumed there was an effluent discharge (TRC value reported). Please submit an amended July 2009 DMR to this Office without a TRC value if there was No Discharge' during the rnonth, Total Residual Chlorine Sporadically over the last two to three years you have reported "BRL" in the TRC column, which represents "below reporting limit", By using "BRL" you are not meeting the minimum detection level (MDL) requirements for total residual chlorine as required by the permit "SRL' is not an acceptable value as you are required to report a numerical value for each parameter that must be monitored under your permit. National Fruit Company, Inc. has a 17 ug/L permit limit and must demonstrate that you or your designee (contracted analytical laboratory) have calibrated the relevant analytical equipment and can detect total residual chlorine at the permit limit of 17 ug/L (i.e., MDL of 17 ugly For example, if the analytical laboratory calibrates the TRC meter at a level of 15 ug/L (MDL) and they obtain a reading of 12 p.g/L then a value of <15 ugh. would be reported on the corresponding DMR not BRL. If the analytical laboratory obtains a TRC reading above 15 ug/L then that reading since it is above the MDL would be noted on the corresponding DMR. All TRC values s50 tig/L. will be considered as compliant by the Division under the TRC policy issued an May 1, 2008. Please make the necessary changes to your total residual chlorine reporting to substantiate compliance with your permit when there is a discharge from your facility. A listing of the flagged violations appears in the attached table and the following sections will discuss changes you need to make to comply with the reporting requirements of your permit. The compliance database generates violations after the data from your monthly Discharge Monitoring Reports (DMRs) has been entered and compared with the requirements of your permit, NC0023761. Flow Your permit requires that effluent flow be measured monthly through an instantaneous reading, This requirement prompts the DWQ database to look for flow readings on a minimum of one day during a given reporting month. A review of the May 2010 DMR found that you did not report flow on any of the days during the month but did report effluent readings for temperature and total residual chlorine on May 28, 2010. You should have reported flow on May 28, 2010, If there was no discharge from your facility on that day flow should be reported as 0 MGD and no other parameters should be reported since you are stating you did not discharge effluent. Please review the attached table for those DMRs listed with flow monitoring violations and submit an amended DMR to this Office for each DMR. Our first infraction was exceeding our permitted Total Chlorine levels. When Mr. Wes Bell first brought this to my attention, June 29, we had several paths we could pursue to reduce our chlorine release levels. We had the option of installing a de -chlorination system. This would require additional. equipment and engineering, thus extending the time required to comply. We also had the option of increasing residence time in our pond by pumping the influent water in a direction that would allow the full usage of the available surface area. Mr. Bell and I agreed that this would be the best initial course of action. Our aeration pump was relocated to accomplish this on July 7. Since that date our employee field tests have shown compliance levels on total chlorine. That brings us to our second violation, Effluent sampling. We received notice of failure to comply on Record Keeping. It was brought to my attention that this facility was not a certified lab and our employee test results were not valid. Until such time, we will employ an independent lab to collect and test our effluent discharge. We will actively pursue the correct documentation and permits that will enable us to achieve our certified lab status. Please consider our revisions appropriate. As outlined in an October 15, 2001 memo from Steve Tedder, Laboratory Section Chief, regarding Revised Certification Rules (attached), National Fruit obtained a blind sample from NSI Environmental Solutions Inc., in Raleigh NC. The sample, #N23380 was tested for pH. `fhe results and completed forms (attached) were returned to NSI Solutions Inc., as indicated on the cover sheet on November 18, 2002. We indicated that the evaluation results should be reported directly to "State Accreditation Agency (NC DENR DWQ) and US EPA". Since that time, we have operated with the assumption that National Fruit Product Company, Inc. had met the criteria. In a conversation with Mr. James Bealle at the NC DENR DWQ Mooresville office and a follow-up phone call to NSI Solutions, we discovered that NSI Solutions had not received the completed forms and consequently, had not provided any evaluation results to the State Accreditation Agency. As a result of our conversation and Notice of Violation, National Fruit Product Company, Inc. will reapply for Field Parameter Environmental Laboratory Certification. We will obtain another blind sample from NSI Environmental Solutions Inc. This time however, we will follow up and ensure that results are reported to the NC DENR DWQ. The red wastewater appeared to have originated from an accumulation of bottles (sore with product in :.hem) upq.radi,ent of the pond, The ORC indicated. that the bottles were the result of a production shutdown several months earlier. The effluent pond's pH was measured. at 5,77 s,u, and the pond's effluent was measured at 5,90 s,u, (Permit limit violation).
