Box 306 Denton, NC 27239 Subject: Modification of NPDES Permit NC0082949 Town of Denton WTP Davidson County Dear Mayor Morris: Division personnel have reviewed and approved your application for minor modification of the subject permit. Accordingly we are forwarding the attached modified permit page. Please remove the existing `Effluent Limitations and Monitoring Requirements" page and replace it with the one attached to this letter. This modification extends the compliance schedule for the collection of effluent flow data through the use of a continuous, recording method. This modification is granted based upon the fact that the plant will be undergoing a comprehensive upgrade, including parts of the wastewater infrastructure. Delaying the requirement for continuous flow monitoring will allow installation of a new flow measurement device to occur as part of the overall site improvement plan. In the meantime, the facility will continue to monitor flow through a weekly, instantaneous sampling method. This modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Until that date, flow monitoring shall be conducted on a weekly basis, using instantaneous sampling methods. 2. The Division shall consider all effluent TRC values reported below 50 µg/L to be in compliance with the permit. However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall below 50 µgfL 3. The pH shall not be less than 6.0 standard units, nor greater than 9.0 standard units. 4. Monitorifig should be performed in conjunction with toxicity testing. 5. See Condition A. (2.) for toxicity testing requirements. Toxicity sampling should coincide with sampling for parameters covered by footnote 4. All samples collected should be of a representative discharge. We are asking for a minor modification. We are requesting a longer time frame for the installation of flow monitoring equipment for our lagoons discharge. Specifically we are requesting that we be allowed to collect grab 11owS, weekly as we were doing prior to the March 2011 deadline, given by your office. This is due to the extended submittal of the plans and the funding time frames. Plans were submitted to your office on May 26th, 2011 by Brad Bucy with Hobbs and Upchurch, for your review. (This has the time frames on it) Part of the request is extending the deadline to Dec. 31, 2012. This should allow for everything that needs to he done. We will contact your office when it completed. It would be a hardship for the Town of Denton, if something were to be put in at this point, as funding for this is included in the upgrade. If something were to be put in now, it would still have to be approved by your office, and it would have to be taken out during the upgrade. We at The Town of Denton want this project to be done so that we are incompliance with our permit, and done so that it will serve as an effective means of flow determination for years to come, and not be piece milled with possible problems in the future. We have a limited staff at the Water Treatment plant and safety issues could result in collecting daily flow samples as we have killed snakes at the outfall site. Two people need to collect samples due to this. Some days there is only one operator here at the plant. Our schedule now is set so that we can have two operators on duty the day that we collect. We ask for any and all consideration and discretion that DWQ would allow on this project. We have been diligent in making sure, through sheer dedication of operators and myself, that we comply with all directives given by your office. Please consider our request.
