Based on MRO and CO discussions, as well as CO conversations with the Permittee, the only issue is the existing lagoons. It is CO's opinion that if the lagoons meet the closure requirements, then the permit should be rescinded. Complete if Approved: Rescind Immediately Reason for Approval MRO staff originally denied this request because AQUA did not provide adequate assessment of the site. In the 12-03-2020 email from Mr. Joseph Pearce (AQUA), there is now interest to purchase/develop the land, so AQWA hired a contractor to complete the long overdue site assessment. MRO staff received the Hart and Hickman report via Nathaniel Thornburg email on 12-11-2020. The findings state the site is reverted to a natural state and there is no indication of posing health or environmental risks. The final pages (9 and 10, Section 3.0 Summary & Conclusions) of the report seem to indicate that the site will be graded with permanent closure of on -site ponds and proposes that remaining lagoon residuals be spread onsite and exisiting monitoring wells be abandoned. Upon review of the data, MRO staff is okay with the contractor findings, but feels the permit rescission should happen after completion of the proposed lagoon closures and monitoring well abandonments (including MW-5, if it can be located). MRO staff may also wish to perform a final site visit, as this site has not been viewed since 2016.
