On behalf of Lufkin Leased Fee, LLC, we are requesting authorization from the USACE to use NWP 39
for o.16 acres of permanent impacts to jurisdictional wetlands and 10 if of permanent stream
impacts for the construction of the proposed project. We are also requesting an Isolated Wetland
Permit from DWQ for 14 if of temporary impacts to an isolated stream, as well as Buffer Compliance
for 4,465 sq ft of permanent impacts and 4,661 sq ft of temporary impacts to riparian buffers.
The project is ±14.73 acres in size and is located southwest of the intersection of Lufkin Road and
Ten Ten Road in Apex, Wake County (Latitude: 35.721653 °N; Longitude: - 78.822625 0W). The project
is located in the Neuse River basin and onsite waters drain to Middle Creek. The Water Quality
Classification for Middle Creek is C; NSW and the Stream Index Number is: 27- 43-1541)• The
cataloging unit for the site is 03020201.
Proposed Proiect
The proposed project consists of the construction of a Sheetz convenience store and associated
infrastructure including access road (driveway), adequate parking, fuel storage, utilities and
stormwater management.
The project consists of four "commercial" parcels. The proposed Sheetz will be located on Parcel 4,
with the additional 3 parcels being developed in the future. The stormwater management pond
located on Parcel 1 will service the impervious area associated with the Sheetz project, but has been
designed /sized to adequately provide water quality treatment for future development on Parcels 1 &
2. Parcel 3 will have its own stormwater management system, which will be designed during the
design of the future development on Parcel 3.
Project History
The Corps of Engineers issued a JD and signed wetland survey for the project site on August 11, 2011.
A copy of the JD and signed wetland surveys has been provided as an Appendix.

Martin Richmond with NC DWQ issued a Buffer Determination on March 7, 2011 (NB /IPRR0 #11 -o22).
A copy of the Buffer Determination Letter has been provided as an Appendix.
The Town of Apex received an Isolated Wetlands Permit from NCDWQ for impacts to the onsite
isolated stream and associated buffers associated with the Lufkin Road (SR 1444) Re- alignment
project (DWQ Project #20110746) in 2011. Please note that the Lufkin Road (SR 1444) Re- alignment
project was a Town of Apex project, and was not associated with the proposed project. Therefore,
impacts are not considered cumulative.
Proposed Impacts
The proposed impacts to 404 jurisdictional features consist of o.16 acres of permanent wetland
impacts and 10 if of permanent stream impacts. The proposed o.16 acres of permanent wetland
impacts will occur as a result of construction of the access road /driveway to provide access from
Lufkin Road. The 10 if of permanent stream impact will occur as a result of the installation of the rip -
rap below the high flow bypass outfall for the stormwater pond.
The proposed project will also result in 14 if of temporary impacts to an isolated stream, as well as
4,465 sq ft of permanent buffer impacts (Zone 1: 2,223 sq ft; Zone 2: 2,242 sq ft) and 4,661 sq ft of
temporary buffer impacts (Zone 1: 102 sq ft; Zone 2: 4,559 sq ft). The proposed 14 if of temporary
isolated stream impact and a portion of the permanent buffer impacts will occur from installation of
a water line. The remainder of the proposed buffer impacts will occur from the temporary
construction corridor for construction of a sewer line and subsequent utility easement.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands, streams and buffers could be minimized. Due to the location of the
onsite wetlands and streams, impacts could not be avoided.
The access point to the site from Lufkin Road was previously determined during the design and
permitting of the Lufkin Road Re- alignment. Due the location of the entrance from Lufkin Road, the
driveway to the Sheetz will impact the entire o.16 acre wetland in order to provide safe ingress and
egress off of Lufkin Road.
Mitigation
The applicant proposes to mitigate for the o.16 acres of permanent wetland impacts through
purchase of o.16 acres of non - riparian wetland mitigation from EEP. A copy of the EEP Letter of
Acceptance has been provided as an Appendix.
Because permanent stream impacts are less than 150 lf, no stream mitigation is proposed.

All buffers impacts are for activities classified as "Allowable" in the Table of Uses. Therefore, buffer
mitigation is not proposed.

The stormwater management plan consists of a wet detention pond with a level spreader to provide
diffuse flow. The Stormwater Management Plan is currently being reviewed by the Town of Apex. A
copy of the Stormwater Management Approval will be provided to DWQ upon issuance by the Town
of Apex.
Diffuse flow will be achieved through a level spreader. Copies of the BMP Supplement Forms for the
wet pond and level spreader have been provided as an Appendix.
The current request is for o.16 acres of permanent impacts to jurisdictional wetlands, 10 if of
permanent impacts to jurisdictional streams, 14 if of temporary impacts to an isolated stream and
4,465 sq ft of permanent buffer impacts and 4,661 sq ft of temporary buffer impacts (see the
attached maps and PCN for details).

petition is considered filed when it is received in the Office of Administrative Hearings during normal office hours.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated
with the proposed activity including SL 2009 -337: An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S.L. 2011 -343.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification /CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In-
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you in your request to use the NCEEP, the impacts that may require compensatory mitigation are
summarized in the following table. The amount of mitigation required for this impact is determined by permitting agencies.
Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. The mitigation will be performed in
accordance with the N.C. Department of Environment and Natural Resources' Ecosystem Enhancement Program In -Lieu Fee
Instrument dated July 28, 2010.
