The proposed work fits within the scope of NCDOT's Right-of-Way as amended in 2013. As
such, a Special Use Permit is not required. However, Stipulation 5 in the amended ROW does
restrict in-water work during the anadromous breeding fish moratorium (Feb 15-June 15).
Assuming you would like to complete the work prior to June 15, Wendy is going to consult
with the NC Wildlife Resource Commission to discuss concerns and will be in touch with you
soon regarding any possible allowances.

Yes, the proposed refurbishment of the riprap scour pad will be immediately adjacent the toe
wall/edge of concrete apron. The placement of riprap will not occur outside the right of way.

Wendy forwarded me your email. I'll need to do a little more research before I can
adequately respond. One thing I've found is some paperwork associated with extending DOT's
ROW at each of the culvert locations. I'm sure I'll figure it out after some more digging, but do
you know if that was ever finalized?

Per our phone conversation today I am following up with you concerning the special use permit
requirement for NCDOT to work on the refuge property (NC HWY 94 Causeway) and whether one
would be required for the proposed maintenance of the existing riprap scour pads for culverts no. 2,
16, and 18. Monitoring of the culverts conducted by NCDOT bridge maintenance staff has
discovered subsidence of the scour pads adjacent the culvert toe wall. The subsidence has exposed
2 to 3’ of the toe wall and will require between 9 to 16 cubic yards of riprap to eliminate the toe wall
exposure. Culvert no. 16 will require work on the east and west side while culvert no. 2 and 18 on
the east side only. Placement of the riprap will be done with an excavator working from the bank on
the north and south side of the culvert. Granite will be trucked to the site where the excavator will
grab the granite directly from the dump truck for placement. The in water work should not take
more than a day per culvert location. I attached the original permit drawings for Culvert no. 2 for
reference.
Please respond concerning whether NCDOT needs to submit an application for a special use permit.
