We are also requesting a NWP 3 for 0.031 acres of temporary surface water impacts as a result of replacement of the existing outfall structure in the central pond. We are also requesting DWQ4o1- certification for the aforementioned impacts. The project is ±63.o acres in size and is located at 9217 Green Level Church Road in Cary, Wake County (Latitude: 35.7997 1N; Longitude: - 78.905453 °W)• The project is located in the Cape Fear /Jordan Lake basin and onsite waters drain to White Oak Creek. The Water Quality Classification for White Oak Creek is WS- IV;NSW and the Stream Index Number is: 16- 41- 6(0.7). The cataloging unit for the site is 03030002. Project History Ms. Jan Patterson with the Town of Cary issued a Buffer Determination letter for the project site on August 10, 2012. A copy of the Buffer Determination letter has been provided as an Appendix. Please note that impacts to Jordan Lake Buffers will be permitted through the Town of Cary. Dave Shaeffer with the Corps of Engineers issued a final JD and signed wetlands surveys for the project site on 10/29/12 (AID #SAW -2012- 01670). A copy of the JD has been provided as an Appendix. Proposed Project The proposed project consists of the construction of a 242 lot residential subdivision and associated infrastructure (i.e. roads, utilities, stormwater management system, etc.), a 1o' public 1410 Commonwealth Drive I Suite 1011 Wilmington, NC 28403 1 tel: 910.256.9277 1 fax: 910.256.2584 www.withersravene[.com I License No. C -0832 WITHERS II RAVEN EL ENGINEERS I PLANNERS I SURVEYOR5 greenway to betaken over by the Town of Cary, a 6' wide private greenway trail and improvements to Green Level Church Road. The project will also require replacement of the existing outfatt structure within the central pond. The current outlet structure is undersized and must be upgraded to meet loo -year storm levels without overtopping the dam, as well as to meet Town of Cary's requirements. Proposed Impacts The proposed impacts consist 0.24 acres of permanent wetland impacts, 2o6 If of permanent stream impacts and 0.187 of permanent surface water impacts for construction of the infrastructure (i.e. roads, utilities, etc.) and greenway trails. Impact 1 (o.o69 ac of permanent wetland impacts) will result from a cut -de -sac which is being required by the Town of Cary to provide a turnaround for emergency vehicles. This cut -de -sac will remain in place until the adjacent property is developed and the road is extended. Lot 242 will not be sold until the road is connected and the cut -de -sac is removed. Impact #13 (50 If of permanent stream impacts) will result from installation of a culvert for the 1o' Town of Cary greenway trait. The Town of Cary is requiring this crossing to be cutverted, as Cary will take over the greenway easement as part of the Town of Cary greenway trait network. The remainder of the proposed permanent stream and wetland impacts will occur from construction of internal access roads and utilities. Impact #7 (137 If of permanent stream impacts) will occur from the construction of a stub road to the property boundary. The Town of Cary's LIDO requires that developments must construct roads to the property boundary for connection to roads within future development of adjacent parcels. This requirement is to provide internal travel corridors to reduce traffic on major thoroughfares. As a result of this requirement, the applicant is required by the Town of Cary to construct the road to the property boundary, resulting in Impact #7. The Town of Cary will not allow the applicant to bond the section of road from west of the stream to the property tine for future construction in lieu of physically constructing the road. Therefore, the applicant is required to construct the road and impact the stream. The adjacent property which will connect to this road is currently in the planning stages and is expected to be developed in the near future. Impact #11 (0.187 acres of permanent surface water impacts) and Impact #12 (o.008 acres of permanent wetland impacts) will occur from the expansion of Green Level. Church Road. The expansion of Green Level. Church Road is a requirement by the Town of Cary as a condition of approval of the project. The road expansion will not impact the entire surface water. However, due to the small size and poor water quality of the pond, the applicant is proposing to fill the entire pond. The proposed project will also result in 24 If of temporary stream impacts (Impact #8) from installation of a sewer line to service the proposed project. The replacement of the existing outlet structure in the central pond will result in 0.031 acres of temporary surface water impacts. While the replacement of the outlet structure is considered WITHERS RAVENEL Page 2 of ENGINEERS I PLANNERS I SURVEYORS WITHERS II RAVEN EL ENGINEERS I PLANNERS I SURVEYORS maintenance which is authorized under a NWP 3 without notification, we are including this impact in the application for authorization. The proposed project will result in impacts to Jordan Lake Riparian Buffers, which will be permitted through the Town of Cary. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and streams could be minimized. The proposed project consists of two separate developments located on each side of the central pond. In order to minimize impacts to wetlands and streams, both developments are being permitted as a single project so that all proposed impacts for the entire development can be reviewed /permitted and mitigated under a single application. During the initial site plan review, the Town of Cary requested that there be an internal connector road between the two developments on each side of the central lake. Initially, the Town of Cary requested that the connector road be constructed north of the central pond. This design would have resulted in greater impacts to wetlands, streams and buffers than the proposed road to the south of the central pond. On April 12, 2012, the applicant and W &R conducted a meeting with Lauren Witherspoon of DWQ and the Town of Cary to discuss the northern and southern options for providing an internal connector road in regards to avoidance and minimization of impacts. As a result of this meeting, the Town of Cary agreed to allow the internal connector road to be designed to the south of the central pond in order to minimize impacts. Also, both the 6' private greenway and 10' public greenway have been designed to minimize impacts. The greenway trail along the northern edge of the pond has been designed over an existing gravel driveway and culverts to avoid additional impacts. Also, the greenways have been designed to utilize pedestrian bridges to cross streams and wetlands in four different locations to further minimize impacts. Mitigation The applicant proposes to mitigate forthe proposed 206 if of permanent stream impacts through the purchase of stream mitigation credits within the Cripple Creek Stream and Wetland Mitigation Bank at a 1:1 ratio. This will result in the purchase of 218 if of stream mitigation. The applicant proposes to mitigate for the proposed 0.24 acres of permanent wetland impacts through the purchase of riparian wetland mitigation credits from Cripple Creek Stream and Wetland Mitigation Bank. Of the 0.24 acres of proposed permanent wetland impacts, 0.171 acres of impact will occur to herbaceous wetlands that have been significantly disturbed through historic and ongoing agricultural activities, which have resulted in these wetlands being of very low functional WITHERS C\ RAVENEL Page 3 of ENGINEERS I PLANNERS I SURVEYORS WITHERS II RAVEN EL ENGINEERS I PLANNERS I SURVEYOR5 value. Therefore, the applicant is proposing to purchase mitigation at a 1:1 ratio, resulting in the purchase of 0.24 acres of riparian wetland mitigation. The applicant is not proposing mitigation forthe 0.187 acres of permanent surface water impacts. Stormwater Management Plan The proposed stormwater management plan consists of a combination of a constructed stormwater wetland and vegetated filter strips. The stormwater management plan is currently under review by the Town of Cary. A copy of the Town of Cary's stormwater management plan approval will be provided to DWQ upon receipt. The current NWP 29 request is for 0.24 acres of permanent wetland impacts, 218 if of permanent stream impacts, 24 if of temporary stream impacts and 0.187 acres of permanent surface water impacts. The current NWP 3 request is for 0.031 acres of temporary surface water impacts for replacement of the existing outfall structure in the central pond (see the attached maps and PCN for details).
