DANIEL SMITH NORTH CAROLINA Director Environmental Quality March 16, 2021 Ms. Kathryn Hinckley Stanley Black & Decker 700 Stanley Drive New Britain Connecticut 06053 SUBJECT: Notice of Deficiency (NOD-2021-CV-0001) Recovery Well Permit Application Former Black & Decker Facility 1758 South Fayetteville Street Asheboro, Randolph County, North Carolina Dear Ms. Hinckley: It has been brought to our attention by Mr. Daniel McDonnell of HRP Associates, Inc. that three (3) groundwater recovery wells were installed at the subject site without first obtaining a recovery well permit from this office. 15A NCAC 2C .0105(a)(4) states that no person shall locate or construct any recovery well until a permit has been issued by the North Carolina Department of Environmental Quality. Please ensure that in future assessments and corrective actions at this site, all required well permits are obtained before the wells are constructed. If this deficiency occurs again, a Notice of Violation may be issued. Thank you for your cooperation in this matter.
