Enclosed is a copy of the Compliance Evaluation Inspection for the inspection conducted
at the subject facility on March 23, 2021, by Ori Tuvia. Donald Burkey's cooperation during the
site visit was much appreciated. Please advise the staff involved with this NPDES Permit by
forwarding a copy of the enclosed report.
Overall the facility is well operated and maintained. However, the facility still has not
addressed the repair or removal of the tilting anaerobic digester cover. This is a continuing
violation that was noted on the previous inspection report (dated May 30, 2019). The tilting
cover could cause a catastrophic failure to the structure, which could cause harm to employees
and could impact the environment, and should either be repaired or removed.
Please be advised that this correspondence is being issued as a Notice of Continuing
Violation. You are requested to respond to this Notice, in writing, regarding the above noted
violation, within fifteen (15) days of receipt. The response should include a timeline for the repair
or removal of the tilting cover. Failure to respond and/or failure to resolve the violations could
subject you to further action by the Division of Water Resources
