Chapter 143, Article 21 of the North Carolina General Statutes (G.S) authorizes and directs the
Environmental Management Commission of the Department of Environmental Quality to protect and
preserve the water resources of the state. The Division of Water Resources (DWR) has the delegated
authority to enforce adopted water pollution control rules and regulations.
On March 1, 2021, Two Rivers Utilities (TRU) reported to this Office that an estimated amount of
up to 488,125 gallons (maximum flow number assumes that chlorination was lost immediately after
second shift inspected the area, and was out until third shift remedied the issue) of partially treated
wastewater (no disinfection) was discharged into Long Creek from the TRU /Long Creek WWTP late on
February 28, 2021. TRU's follow up written report attributed the bypass to the chlorine system, which
was not feeding due to a blown diaphragm.
