Section D.1.a. Avoidance and Minimization

Revised July 2012
The layout of the project has been carefully planned to minimize wetlands impacts while
at the same time maximizing the potential of the project. Olde Towne Point Blvd. is aligned to
cross the stream at an existing culverted crossing, thereby minimizing wetlands and stream
impacts. The existing Boulevard was originally designed as a divided 4 lane (2 lanes each way)
street with a 23' median. At the stream /wetland crossing, the Boulevard design has now been
narrowed to a 2 lane, 26' wide road with no asphalt trail, in order to minimize the
stream /wetland crossing. It is anticipated that when warranted in the future, the additional two
lanes with median and asphalt trail will be permitted and constructed. In addition, the
proposed roads throughout Wantlands Ferry have been positioned so that there will be no
other wetlands impacts.
The locations of the proposed water and sewer utilities are proposed to occur within the
footprint of the proposed road so as not to have additional impacts for the water and sewer
extensions. The location of the water and sewer mains at the proposed road impact areas are
shown on the Impact Area Exhibit Map.
For stormwater treatment, stormwater ponds are placed along a stream or low area
within the subdivision so the pond outlet is close to the lowest wetland outlet elevation. The
ponds are located at least 50' from the top of the bank of a stream. As designed, the
stormwater ponds will not disturb any wetlands.
Concerning possible draining of the Wetlands adjacent to the stormwater ponds, the
stormwater section of NCDENR -DWQ currently requires soils borings, at the pond, by a Soil
Scientist to investigate the soils material and seasonal high water table (SHWT) and provide
calculations using the Skaggs Method to show that the water table in the wetlands will not be
lowered.

Note that the Bank provides wetland credits in 0.10 -acre increments. Based upon receipt of the completed
Credit Request Form (transmitted by email to Land Management Group, Inc. on August 1, 2012), the Bank
will reserve 0.20 credits of riparian wetlands and 58 stream credits for a period of up to six (6) months.
Upon receipt of payment, Bachelors Delight Mitigation Bank will provide confirmation of the credit transfer.
It is the applicant's responsibility to ensure that the credit types and amounts requested are consistent with
the compensatory mitigation requirements of the permit(s) issued. The Bank and /or its agents are not

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions and your submitted revised application and attached information dated 7/17/2012 (received 7/18/2012) and
additional information dated 8/22/2012 (received 8/24/2012), and 10/4/2012 and 10/8/2012 via email. Any violation of the
attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration
order and/or appropriate legal action.
This verification is valid until the NWP is modified, reissued, or revoked. All of the existing NWPs are scheduled to be modified,
reissued, or revoked prior to March 18, 2012. It is incumbent upon you to remain informed of changes to the NWPs. We will issue a
public notice when the NWPs are reissued. Furthermore, if you commence or are under contract to commence this activity before the
date that the relevant nationwide permit is modified or revoked, you will have twelve (12) months from the date of the modification or
revocation of the NWP to complete the activity under the present terms and conditions of this nationwide permit.

1) The permittee shall execute and cause to be recorded in the Onslow County Register of Deeds an
amendment to the Master Declaration of Covenants and Restrictions acceptable to the Corps of Engineers
(draft reviewed and approved received 10/8/2012 via email) for the purpose of maintaining the
conservation areas, as shown on the reviewed plat (Preliminary Plat, Wantlands Ferry, Section I at Towne
Pointe, dated 9/2/2012, received via email 10/4/2012) in their natural state in perpetuity, prior to the sale or
conveyance of any lots or other property within the subdivision. The permittee shall enforce the terms of
the restrictive covenants and, prior to conveyance of the property, shall take no action on the property
described in the covenants inconsistent with the terms thereof. The permittee shall provide a copy of the
recorded restrictive covenants to the Corps of Engineers within 15 days of recording.
These provisions relating to the wetlands cannot be amended or modified without the express written
consent of the U.S. Army Corps of Engineers, Wilmington District.
2) Transfer of General Permit Verification (see Nationwide Permit Condition 29). Within 15 days of the
permittee transferring ownership of the subdivision open space or common area associated with the
nationwide permit verification to the subdivision Home/Property Owners Association, the permittee shall
submit a letter to the Wilmington Regulatory Field Office to validate the transfer. The letter must be
acknowledged, signed and dated by both the permittee and the transferee. A copy of the nationwide permit
verification must be attached to the letter, and the letter must contain the following statement:
"The terms and conditions of the nationwide permit verification, including all special conditions, identified
as Action ID SAW- 2009 - 00315, will continue to be binding and enforceable on the Home/Property Owners
Association, as the new owner(s) of the property subject thereto."
3) In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance
with the provisions outlined on the most recent version of the attached Compensatory Mitigation
Responsibility Transfer Form. The requirements of this form, including any special conditions listed on
this form, are hereby incorporated as special conditions of this permit authorization.
4) The wetland boundary, as marked on the "Grading, Drainage, Erosion and Sediment Control Plan,
Wantlands Ferry, Section I at Towne Pointe" (dated 7/17/2012, received in permit application package
dated 7/17/2012 [received 7/18/2012]), shall be physically /visually identified using silt fence, safety fence, or
similar products during all phases of construction in the following areas:
a. The limits of the wetland impacts authorized by this permit
b. The wetland boundaries within 50 feet of all construction and other land disturbing activities
within the Wantlands Ferry, Section I at Towne Pointe subdivision project.
5) Future phases of the Towne Pointe subdivision will be considered part of the Towne Pointe single and
complete project, and impacts will be considered cumulative with impacts permitted during earlier phases.
As such, if impacts proposed in future phases in combination with impacts permitted in earlier phases
exceed the Nationwide Permit threshold, future phases will be subject to Individual Permit review.
Current authorized permanent impacts to Waters of the U.S. for the Towne Pointe single and complete
project total 0Z13 acre, including impacts to 0.193 acre of riparian, non- riverine wetlands, and 111 linear
feet (0.02 acre) of stream.

Mitigation Bank or the North Carolina Ecosystem Enhancement Program (NCEEP), who will then sign the form to verify the

• Once this document has been signed by the Mitigation Sponsor and the USACE is in receipt of the signed form, the
Permittee is no longer responsible for providing the mitigation identified in this form, though the. Permittee remains
responsible for any other mitigation requirements stated in the permit conditions.
• Construction within jurisdictional areas authorized by the permit identified on page one of this form can begin only
after the USACE is in receipt of a copy of this document signed by the Sponsor, confirming that the Sponsor has
accepted responsibility for providing the mitigation requirements listed herein. For authorized impacts conducted by
the North Carolina Department of Transportation ( NCDOT), construction within jurisdictional areas may proceed' upon

NOW THEREFORE, the Declarant does hereby publish and declare all of the property
described below shall be held, conveyed, hypothecated, encumbered, used, occupied and
improved subject to all the terms and conditions set forth in said Master Declaration, and as
thereafter amended; which is declared and agreed to in furtherance of the plan for the
improvements of said property in the division thereof and shall be deemed to run with the land
and shall be a burden and a benefit to Declarant, its successors and assigns, and any person

2. WETLANDS AND CONSERVATION SPECIAL PROVISIONS: As to the property
described in Exhibit A, attached hereto only, the following provision shall apply:
A. Conservation Areas: The property subject to this Amended Declaration
and shown as as conservation areas shall be maintained in perpetuity in their natural or mitigated
condition. No person or entity shall perform any of the following activities on such conservation
area:
(1) fill, grade, excavate or perform any other land disturbing activities
(2) cut, mow, burn, remove, or harm any vegetation
(3) construct or place any roads, trails, walkways, buildings, mobile homes,
signs, utility poles or towers, or any other permanent or temporary
structures.
(4) drain or otherwise disrupt or alter the hydrology or drainage ways of the
conservation area.
(5) dump or store soil, trash, or other waste
(6) graze or water animals, or use for any agricultural or horticultural purpose
This covenant is intended to ensure continued compliance with the mitigation condition of a

Contractor shall insure that he and all his workers (contractors,
subcontractors and other site personnel) do not damage construction
stakes or other measures used in laying out the project whether by
the Engineer or another entity including those under the employ of the
contractor. Contractor shall cause his workers to observe and verify
to the fullest extent practicable that stakes, other measures and grades
are, or appear to be, accurate and correct, and immediately, but prior
to any associated work, notify the staking entity of any potential conflict,
error or question regarding the work. The Engineer shall not be responsible
if all of the above measures are not strictly adhered to. The Engineer shall
not be responsible where due to damage, his staking can not be verified.
For critical or costly components of the work, where the contractor belie °ves
that staking may not be presery ed, the contractor shall regyest the staking
entity to place staking in on, area where its preservation can be insured.
