Dear Mr. May,
In response to your Notices of Deficiency of March 16, 2021 for our farms:
Cedar Lane (96-4), Wake -Kyle (96-7), Doug Smith (96-40), Ryan West (96-41), Bart
Smith (96-44) and Currie Holt (96-189) I submit the following:
Deficiency 1: Failure to maintain required lagoon freeboard.
We have had a tremendous amount of rainfall in the last 14 months and we have been
very careful in land application so as to not allow ponding nor runoff. Because of the
copious rainfall and wet conditions, several of our lagoons recently encroached the red -
zone. We provided the required 30-day POA to Mrs. Salyer and have since gotten these
lagoons back in compliance, however 96-40, 94-41 and 96-189 have gotten back in the
red. Curtis Barwick notified Marlene of this issue today. We will submit new POAs to
her.
I regret that high freeboard has occurred and we are managing the farm to prevent any
damage to our environment.
