SEP 0 7 1990 E RE43Na OFFICE Concerning your letter of August 24, 1990, in reply to violation of General Statute 143-215.1 (a) (1), the following measures have been Metromont Materials Corp. to correct unpermitted discharges and oil North Carolina instituted by products. As your department is aware, an oil slick was discovered on a newly leased parcel of property belonging to Metromont Materials. Metromont employees, in cooperation with inspectors from the Department of Natural Resources, ascertained that this oil slick did not originate from the Metromont Materials plant, nor was it emptied on this property by Metromont. Immediately after the discovery of the oil slick, however, Metromont instituted a clean-up process at our own expense. This process was requested by the Mecklenburg County Department of Natural Resources. Metromont hired an outside waste oil disposal company equipped with tanker trucks. Approxi- mately 4000 gallons of oil and water were removed from the site. This was com- pleted under the supervision of Walter Booker from the Mecklenburg County Depart- ment of Natural Resources. Concerning the concrete debri, excavation of this site has been, and is now occur- ring. The City of Charlotte has replaced a storm water drain pipe at this site, and much of the concrete debri has been removed. At present, Metromont has dug a temporary settling basin to relieve runoff from the plant. Silt fences may, also, be added to help prevent solid runoff. In the near future, Metromont intends to construct a permanent settling basin that will el' lnate runoff entirely. If you have any questions, please contact me at 1-800-476-2607. Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Metromont Development Company Mecklenburg County FOR THE construction and operation of approximately 3265 linear feet of 8-inch gravity sewer line to serve the Metromont Industrial Park, Section I -Phase 2 and the discharge of 20,000 GPD of collected domestic wastewater into the Metromont Industrial Park's existing sewerage system, pursuant to the application received on August 1, 1989, and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment„ Health, and NaturalResources and considered a part of this permit. This permit shall be effective from the. date of issuance until rescinded and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities must be properly maintained and operated at all times, 4. The sewage and wastewater, collected by this system shall be treated in the Metromont Industrial Park Wastewater Treatment Facility prior to being discharged into the receiving stream. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Perrnittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or ma.y not be approved. !Pr 6. Construction of the sewers shall be scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of the State. 7. Upon completion of construction and prior to operation of this permitted facility., a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications. Mail the certification to the Permits and Engineering Unit, P.O. Box 27687, Raleigh, NC 27611-7687. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of five years from the date of the completion of construction. 9. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215,6. 10, The issuance of this permit does not preclude the Permittee from complyingwith any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 11. In the event that the facilities fail to perform satisfactorily, 'including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater collection facilities., 12. Noncompliance Notification: The Permittee shall report by telephone to the Mooresville Regional Office, telephone no. 704/663-1699, as soon as possible, but in no case more than 24 hours or on the next working day :following the occurrence or first knowledge of the occurrence of either of the following: a. Any process unit failure, due to known or unknown reasons, that render the facility incapable. of adequate wastewater transport such as mechanical or electrical failures of pumps, line blockage or breakage, etc. b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. Authorization is hereby granted for the construction of a 0.010 MGD wastewater treatment and disposal facility which consists of a grit chamber, an influent surge tank with dual 20 GPM pumps and a 35 CFM blower, three 5,000 gallon aeration tanks, a 6,200 gallon clarifier, a 5,000 gallon sludge holding tank, dual 170 CFM blowers, a tertiary filtration system with dual cells (4 ft, diameter), a recording flow meter, a 2,644 gallon dosing tank, a 2,237 gallon backwash tank (for chlorine contact), a tablet chlorinator, a 1.,600 gallon post aeration tank, approximately 8501inear feet of 8-inch gravity sewer line, and all other appurtenances to serve the Metromont industrial Park, Phase I. Davco's excavation shall be limited to removal of soil with a backhoe. Purchaser is responsible for establishing benchmark at site for Davco erection crew' 3E Purchaser agrees to provide a clear level work area at least 35 feet vide around the periphery of the erection site. Prior to starting erection, any obstructions in the work area, such as excavations, overhead lines, fences, trees, abrubbery, eto- shall be removed by and at the expense of the Purchaser. The Purchaser shall keep the site properly drained and free from surface water during erection, and until the work has been completed and accepted. The site and site access shall be capable of supporting a crane up to and including 50-ton capacity and other erection equipment. Any fill or devatering necessary to accomplish the above, or additional costs of oversized or special equipment required due to poor site conditions, will be the responsibility of the Purchaser. Site leveling/ grading, etc., after erection, shall be the responsibility of the Purchaser. Davco shall be responsible for the clean up and removal of trash, scrap materials, etc./ left from Davco erection work. 4E Purchaser agrees to provide site access and site working area capable of supporting the delivery trucks (70-75,000 pounds gross weight). Purchaser agrees to maintain site access and working area, daily if required, to allow Davco erection crew to perform work during all weather conditions. Purchaser is responsible for unloading any equipment or accessories shipped to Purchaser for his installation. (Such as base channels to be embedded in concrete foundation by Purchaser, blowers or other accessories to be installed by Purchaser). 8E PURCHASER ACCEPTANCE OF ERECTED EQUIPMENT When erection of the equipment nears completion Davco shall give Purchaser seventy-two hours verbal notice that the equipment shall be ready for inspection and acceptance. Purchaser agrees to provide, on seventy-two hours notice, an authorized agent to meet at the site with Davco erection personnel, to inspect the erected equipment, and accept same for/or on behalf of the Purchaser. Any backordered items not installed at that time shall be listed on the acceptance agreement with the written understanding that Davco is responsible for installing the subject equipment. The Purchaser shall make all preparations for which he is responsible, such as: Influent and effluent connections, installation of the required electrical power supply and circuitry, filling tanks with clean water for testing and otart-up/ etc. It any deficiencies in materials or workmanship by Davco are discovered by the Purchaser while performing this work, the Purchaser Eball immediately notify Davco so that corrective action,can be taken. Davoo is responsible for providing start-up supervision as defined in the equipment proposal. For scheduling purposes, ten days notice of desired start-up date is required. SECURITY AND PROTECTION OF EQUIPMENT Purchaser is responsible for security of equipment stored on his site after delivery prior to arrival of Davoo crews to begin erection; and for any back. - ordered material delivered to Purchaser after departure of Davom erection crews. Davco shall not be responsible for deterioration/ theft, vandalism or damage to equipment which is stored on site or left inoperative after installation due to delays in start-up.
