Sorry for late reply. I have been in data discovery mode for the last 2
weeks since I had a hard drive giving me problems.
I have attached for you the determination:
Allow me to refresh your memories:
You personally had visited the site and had determined that the stream
starts 140 feet inside my property and what is up the stream is ephemeral.
This matter was disputed with OAH, a settlement agreement was reached, and
expert was hired and he has reconfirmed this matter over again.
What would be appropriate from my point of view is that:
That even if the call was made on the adjacent property up the stream no
such buffer will be applicable inside my property lines, except as was
agreed based on the variance and the settlement agreement that was reached.

If we made such a determination, it would be in writing. Any idea who
made the call and when so I can look for it? Also if you have a copy of
the letter that would be helpful. Let me know and I will investigate.

intermittent. This is the last few feet of the stream that was
designated by the order of our settlement agreement to be ephemeral
about 140 feet from the eastern end of the property line. This
seems to be an error that would need to be addressed.
What would be the best way to address this matter. Since I have been
informed recently I would like to take a quick action to make sure
this matter will be quickly clarified.
Please advise if I should file with OAH. Or should I seek other
remedies with yourself.
