Please see our responses to your requests, which are in bold letters below. 1) Please justify the Applicant's need to divide lot 91 into two separate lots. As discussed in the Supplemental Information, in an effort to avoid and minimize impacts to wetlands, the Applicant removed 3 multi- family units from his site plan, which resulted in lost revenue for the project. To compensate for some of the lost revenue, the Applicant split lot 90 in two single family lots. The applicant may do the same on other lots throughout the subdivision, but impacts to wetlands are not anticipated, as a result. 2) Please justify the need for fill on lot 90, as it appears to he buildable without permanent impacts (as shown on the plans submitted [previously]). Impacts to wetlands, on lots 89 -91 were overlooked with the Individual Permit (IP) application dated 12121112. As soon as the Applicant and SEGi became aware of the issue, the USACE was contacted for guidance on how to proceed. Keep in mind this took place during the time the project was out for public notice. Ultimately, the Applicant had two options to obtain DoA authorization for the impacts: 1) submit a request to include the impacts, which would increase impact acreage and delay the permit process by weeks if not months, as it would have to go back out for public comment; or 2) after the IP is issued, submit a request for modification. The Applicant, who was under contractual obligation to have the infrastructure installed prior to the building contractor commencing work, could not risk breach of contract and, understandably, the Applicant chose to modify the permit. Avoiding impacts on lots 90, 90A and 91 is not possible due to the minimum front setback of 10 feet. The structures are set back 20 feet. This is necessary to ensure adequate driveway access into the side entrance garage on lot 90 and parking area for lots 90A and 91, as parking on the street is not permitted. In addition, locating the homes within 10 feet of the road diminishes the marketability of the homes. 3) Please provide proof of the County's request to redesign Motts Forest Drive, which has ultimately resulted in additional impacts. Please find enclosed a copy of the email correspondence denoting the [City's] request to redesign Motts Forest Drive. According to Tripp Engineering, the City of Wilmington Planning Department, in conjunction with the NC DOT and NHC, review all subdivision road designs within the county, as part of the Metropolitan Planning Organization. It is our hope that the information found within and attached to this correspondence satisfies the ACOE's request for additional information and the modification will be processed. Provide an additional stub to the adjacent property (Williamson) to the north In the vicinity of the proposed Vernon Court street. ---.�,-2. Redesign Motts Forest Drive to eliminate the 90 degree curve. 3. Driveway locations into the multi- family parcels along River Road will be reviewed as detailed site plans are submitted to the County. 4. The revised plans do not change the density - the proposal indicates a reduction of 17 townhomes and addition of 17 single family homes.
