3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
Site vicinity and land use /ownership
The Lassiter Mill Dam is a 205-ft long /12 -ft high intact rock and concrete dam on the Uwharrie River in Randolph County,
NC. The dam and surrounding land is privately owned by Ruth Ann and Amy Grissom, who are fully supportive of this
project to remove the dam. They own the parcel of land that surrounds the dam and includes land on either side of the
river (see parcel map attached). Land use in the vicinity of the project is agricultural and rural residential.
The dam is a complete barrier to aquatic species movement and migration. It also creates a 3+ mile long impoundment in
the river, which has degraded habitat in that reach, altered hydrology, impacted water quality (low DO), and blocked
sediment transport.
Details of the dam and affected river
The dam is comprised of a 160 foot long spillway, a northern abutment, and a foundation of a former mill structure acting
as its southern abutment. The dam appears to have been constructed by backfilling forms with the local riverbed cobbles
and a slurry of concrete. There is no evidence of reinforcement in the spillway structure. A 300 foot long earthen raceway
circumvents the southern side of the spillway, and flows through the mill structure's foundation. The banks of the raceway
show signs of significant lateral erosion. The spillway has a breach along its southern side extending a few feet below the
spillway crest. During low- moderate flow, the full river flow circumvents the dam crest by way of the raceway and breach
in the spillway, therefore the crest of the spillway is dry and easy to access. The dam is in poor condition. A significant
scour hole exists directly downstream of the dam, likely due in part to excavation of river stone during the dam's
construction as well as scour from the flow when it goes over the crest of the spillway.
The downstream river channel is approximately 160 feet wide, narrowing to 100 feet wide approximately 300 feet
downstream of the dam. Cross sections of the downstream channel are included on the engineering plans (see "Final
Engineering Plans" attached). The riverbed's slope is approximately 1.6% and is lined with large boulders and cobbles
embedded in gravel. Large boulders and bedrock outcrops are visible throughout the downstream end of the depositional
bar. The upstream channel is approximately 110 feet and is highly uniform in shape. The channel cross section is
consistently trapezoidal in shape with a solid cobble substrate with pockets of gravel. An ADCP bathymetric survey
demonstrated that the majority upstream channel bed is below the grade of the downstream depositional bar, extending
upstream at an approximate slope of 0.04% through the impoundment.
Sediment analysis and streambanks
The streambanks around the dam are well vegetated but show signs of historic bank failures.
The stream banks along the impoundment are near vertical with a consistent wedge of clay deposited at the toe of the
bank along the entire impoundment length, deposited from former stream bank failures. Evidence of active and historic
stream bank failures are evident along almost 100% of the impoundment, as well as upstream and downstream, and
appear to be a natural stream bank condition for this river system.
Sediment probing and ADCP measurements were completed to determine the spatial distribution of impounded sediment
and bathymetry of the impoundment. Probing demonstrated that impounded sediments were largely absent upstream of
the dam. Isolated small pockets of sediment were encountered on the downstream side of isolated boulders and woody
debris as well as one deposit of Gay approximately 1 -foot wide found near the dam. Collectively, these isolated pockets of
sediment were inconsequential and too small to quantify. The only sediment within the impoundment, which could
potentially be mobilized post dam removal, was limited to a 5-6 foot wide wedge of clay along each bank, resulting from
historic and ongoing bank failures. This wedge of clay along the toe of each bank is not a depositional feature resulting
from the dam and is therefore not considered impounded sediment. In fact there was evidence along non - impounded
reaches of the Uwharrie River that this wedge of Gay at the toe of the bank is a natural and common depositional feature
of this river system. All sediment probes taken within the central reach of the river channel confirmed that no impounded
sediment has accumulated behind the dam (see "Final Sediment Management Plan and Engineering Design Report"
attached). In addition, USFWS staff completed an initial sediment contaminant evaluation that included database review
and on -site reconnaissance; this evaluation identified no issues of concern, and confirmed the lack of impounded
sediment.

The property includes approximately 1290 feet of the Uwharrie River and no tributary streams. The length of the
impoundment created by the dam is estimated to extend over 3 miles upstream.

3d. Explain the purpose of the proposed project:
The purpose of the proposed project is to fully remove the Lassiter Mill Dam and associated powerhouse in order to
restore the Uwharrie River to a more natural, free - flowing state. Ecological benefits (purposes) of removing the dam are:
• Re- establishing American shad, American eel and other diadromous fish spawning access and habitat use to an
additional 14.6 river miles and 174 additional miles of perennial streams.
• Re- establishing habitat connectivity for a number of rare aquatic and resident species.
• Restoring lotic stream habitat, hydrology, water quality and sediment transport in the 3+ mile impoundment created
by the dam.
In addition to ecological restoration, removing the dam will alleviate a serious public safety hazard for those using the
river for recreation (then: is no safe portage around the dam, and the dam creates a dangerous hydraulic in high flow
conditions). It will also eliminate the danger of dam failure, which could result in flooding or injury to people downstream.

3e. Describe the overall project in detail, including the type of equipment to be used:
Engineering Design
A geomorphic field assessment was conducted In November 2011 to investigate impounded sediment depths, substrate
character above and below the dam, the current conditions of the riverbanks, an assessment of bank stability post
removal, the dam condition and character, the tailrace, construction access routes, critical infrastructure that could be
impacted, and the proposed survey extent. Methods and results of this assessment are presented in the "Final Sediment
Management Plan and Engineering Design Report" attached and summarized in Section 3a above.
A topographic and bathymetric survey was completed in January 2012. The survey included locating any infrastructure
(e.g. mill structures, utilities, etc.) that may be impacted by the project, collecting spot elevations of the dam, generating
one -foot contours of the project area, and measuring cross - sections. Information from the survey and field assessment
was used to develop engineering design plans. The plan set includes existing conditions, construction sequence,
proposed conditions, river cross sections and profile, and soil erosion and sediment control details.
Construction Sequence
The construction sequence was developed to limit site disturbance, provide easy access, and remove the dam in the
simplest way possible. The dam will be accessed by heavy equipment (excavator- trackhoe, dump truck) during a period
of low flow from just downstream of the remnant mill structure, utilizing a piped crossing over the raceway. The access
road will then continue across the depositional bar below the dam's scour hole to the northern side of the depositional
bar, where a bypass channel will be cut through the depositional bar. The far side of the dam will then slowly be breached
from top to bottom, redirecting much of the river's flow along the northern side of the downstream channel. The dam will
then be removed from north to south in manageable sections that will be buried in the former mill race and the deep scour
hole beneath the dam. The former mill foundation will be demolished in place and the former mill race will be filled with
concrete from the dam and buried with soil from the adjacent earthen mound. If necessary, clean fill and topsoil will be
imported to attain final grades. Pipes from the temporary raceway crossing will be removed offsite; remaining material will
be placed in the fill zone of the mill raceway. The access road will be removed once the contractor has successfully
worked his way off the site from north to south and has removed the dam, filled in the raceway, and regraded the
southern streambank in the area of the raceway. The site will then be seeded and planted with native species as needed
to reestablish a vegetated streambank, including planting of saplings to replace mature trees that are lost.
Impacts
Due to the lack of impounded sediment within the Impoundment for the Lassiter Mill Dam, no impacts from sediment
mobilization are anticipated. Therefore, no dredging, excavation or relocation of sediment has been included as part of
the dam removal design. Three natural bedrock features located at 0.5, 1.25 and 2.0 miles upstream of the dam will serve
as significant controls on vertical channel adjustment following dam removal, so channel erosion (ie, headcutting) will not
be an issue.
The only anticipated impact of dam removal will be the increased likelihood of stream bank failures within the first mile of
the impoundment for a transitional period of time, until the banks re- equilibrate with the river and stabilize. This would
lead to more woody debris being added to the river during this transitional period. However, bank failures are a common
and natural process within the Uwharrie River, and will continue with or without the removal of the dam. Stabilization of
the streambanks along the impoundment by cutting them back and re- planting is not proposed due to the extensive
length of streambank failure along the impoundment, the fact that this failure occurs both upstream and downstream of
the dam (and therefore is not caused by the dam), and the intrusive nature of this type of modification at that scale.
No infrastructure was identified that will be impacted by dam removal within the upstream reach.
Monitoring
Pre - removal fish and mussel surveys have been conducted upstream and downstream of the dam to determine species
richness and relative abundance. Project partners are committed to completing post - removal biological surveys as well.

Pre - removal fish and mussel surveys have been conducted upstream and downstream of the dam to ensure that sensitive or
rare species would not be impacted by removal. Impounded sediment and stream banks were also carefully assessed as
described above. The project was designed to limit the construction footprint of the project, as well as the amount of time
construction equipment is in the river.

Construction will occur during times of low flow to limit impact to the river. The access road will use part of the existing road,
and removal of trees will be limited to what is absolutely necessary (and those removed replaced with saplings). The access
road will use a temporary piped crossing and rip-rap to cross the raceway to help keep equipment out of the stream flow until it
can be re- directed back to the main channel. Breaching of the dam will occur slowly from the top of the dam working down to
limit turbidity in the river. By filling in the upper raceway with remnants of the dam and covering/grading/reseeding that area,
the river will be directed back to the main channel and that area will become stabilized where it is currently eroding.

and Water Conservation District and Randolph County Planning Department confirmed that the project was not
anticipated to impact floodplains and no coordination was needed to meet FEMA requirements.

SUBJECT: American Rivers FY2011, Explanation of Inclusion of Projects
under the Community -based Restoration Program Programmatic
Environmental Assessment and Supplement (PEA/SPEA) and
Finding of No Significant Impact (FONSI)
The Community -based Restoration Program, under the authority of the Fish and Wildlife
Coordination Act, 16 U.S.C. 661, as amended by the Reorganization Plan No. 4 of 1970, and the
Magnuson- Stevens Fishery Conservation and Management Reauthorization Act of 2006, is
proposing to fund eight restoration activities through our partnership with American Rivers that
are not anticipated to have any significant environmental effect.
After reviewing the proposed project, we have determined that the proposed actions described
below fall within the scope and effect of activities analyzed in the February 6, 2002
Programmatic Environmental Assessment (PEA) for the Community -based Restoration Program
Implementation Plan and the June 23, 2006 Supplement (SPEA). Further, following application
of the criteria used to determine the significance of potential environmental impacts, in
accordance with NOAA Administrative Order 216 -6, Commerce Department Administrative
Order 216 -6, and the Council on Environmental Quality Implementing Regulations for the
National Environmental Policy Act, we have concluded that the proposed actions would not have
a significant effect, individually or cumulatively, on the human environment and, therefore, an
environmental impact statement will not be prepared.
Pertinent project Information
Stearns Dam Removal Design, OR
The Stearns Dam Removal Design project, undertaken by the Crooked River Watershed Council,
will develop designs to provide passage for ESA - listed steelhead and other aquatic species to
over 70 miles of fisheries habitat in the Crooked River, McKay Creek, and Ochoco Creek, all
within the Deschutes River Basin in Central Oregon. Any short -term minor adverse impacts of
survey work, data collection, or other activities associated with design development will be
mitigated through Best Management Practices. This proposal has been assessed for significant
effects, and the proposed activities, including any related educational or administrative actions,
have been found to fall under the CRP PEA and SPEA. The project will have no significant
individual or cumulative effects on the environment as documented on the CRP's NEPA
checklist, and is covered under the associated FONSIs.

Lassiter Mill Dam Removal Design, NC
The Lassiter Mill Dam Removal project, undertaken by The Piedmont Conservation Council,
will develop design plans for the removal of the Lassiter Mill Dam on the Uwharrie River in
Randolph County, NC. Any short -term minor adverse impacts of survey work, data collection,
or other activities associated with design development will be mitigated through Best
Management Practices. This proposal has been assessed for significant effects, and the proposed
activities, including any related educational or administrative actions, have been found to fall
under the CRP PEA and SPEA. The project will have no significant individual or cumulative
effects on the environment as documented on the CRP's NEPA checklist, and is covered under
the associated FONSIs.
Little Lehigh Creek Dam Removal Design, PA
The Little Lehigh Creek Dam Removals, undertaken by the Wildlands Conservancy, will involve
data collection, field surveying and mapping, a sediment analysis, hydrology and hydraulics
study, coordination with Regulatory /Approval entities, public meetings, preparation of
preliminary plans, and completion of final plans and permit applications. These dams — the
Martin Luther King Dam, Robin Hood Bridge Dam, and the Trout Hatchery Dam, are considered
tun -of- the -river dams and the first barriers to migratory fish within the Little Lehigh Creek.
Feasibility .analysis for fish passage is currently being conducted on two downstream dams. The
primary goal of the overall Little Lehigh Creek Dam Removals is to restore anadromous fish to
the Little Lehigh Creek, specifically the American Eel, Alewife and Blueback Herring. Once
fully implemented, the dam removals will result in restoring fish passage and enhance
approximately 8 miles of prime spawning, nursery and growth habitat for anadromous fish
species. Any short-term minor adverse impacts will be mitigated for through Best Management
Practices. This project has been assessed for significant effects and has been found to fall under
CRP PEA and SPEA. The project will have no significant individual or cumulative effects on
the environment as documents on the CRP's NEPA checklist and is covered under the associated
FONSIs.
Raritan River Headgates Dam Anadromous Fish Restoration Feasibility Project, NJ
The Raritan River Headgates Dam Anadromous Fish Restoration Project, undertaken by the New
Jersey Department of Environmental Protection ( NJDEP), will begin a phased approach to fish
passage, beginning with a feasibility study. The project's feasibility phase will include
engineer's feasibility study to examine fish passage alternatives including fish ladder, by -pass
channel (nature -like fishway), rock ramp and the notching or full removal of the Headgates Dam.
The feasibility phase will generate the necessary engineer's reports to address each of the
alternatives and will conclude with a recommendation for action. NJDEP will collect
topographic information, conduct a preliminary hydrology study, conduct a sediment analysis,
assess potential wetland impacts, and research potential cultural/historic resource impacts.
The feasibility phase has been assessed for significant effects, and has been found to fall under
the CRP PEA and SPEA. This phase will have no significant individual or cumulative effects on
the environment as documented on the CRP's NEPA checklist, and is covered under the
associated FONSIs.
Millstone River Anadromous Fish Restoration Project, NJ
The Millstone River Anadromous Fish Restoration Project, undertaken by The Stony Brook
Millstone Watershed Association (SBMWA), will act on the recommendations of the feasibility
study and will carry out the engineering design for the removal of the Blackwell Mills dam, one
of the existing two blockages on the lower Millstone River. The design phase will generate the
necessary engineering reports, drawings and documents for the removal of the dam. In the design
phase SBMWA will collect additional information regarding the constructed materials of the
dam. They will assess in stream and side slope stability and grading and collect all needed
topographic information above and below the dam. Any remaining uncertainties not addressed in
the feasibility report will be addressed here including those pertaining to hydrological conditions
and flooding issues, sediment deposit issues, wetland impacts above and below the dam; historic
preservation; coordination with the state historic preservation office. The design phase has been
assessed for significant effects, and has been found to fall under the CRP PEA and SPEA. This
phase will have no significant individual or cumulative effects on the environment as
documented on the CRP's NEPA checklist, and is covered under the associated FONSIs.
Tidmarsh Dam Removal Engineering and Permitting, MA
The Tidmarsh Dam Removal Engineering and Permitting project, undertaken by the MA
Division of Ecological Restoration, will carry out the engineering and permitting work for
removing two small dams on Beaver Brook in Plymouth, MA in order to provide unobstructed
fish passage and to restore other riverine aquatic functions and values. The project will result in
a set of final plans and permits that will be used to remove these two dams. The funding does
not support any construction at the site. This project has been assessed for significant effects, and
has been found to fall under the CRP Programmatic Environmental Assessment. The project
will have no significant individual or cumulative effects on the environment as documented on
the CRP's NEPA checklist, and is covered under the CRP Programmatic Environmental
Assessment and FONSI. Future construction related funding would require an additional NEPA
assessment.
Bunker Pond Dam Removal Project, NH
The NOAA Restoration Center in partnership with American Rivers will provide funding to the
NH Department of Environmental Services to undertake the construction phase to remove the
Bunker Pond Dam located on the Lamprey River in Epping, New Hampshire. The project will
result in the actual removal of the Bunker Pond dam, providing unobstructed fish passage and to
restore other riverine aquatic functions and values for 27 miles of main stem liver until the next
obstruction. The project has undertaken the full breadth of environmental compliance. The
project development, monitoring, management and construction have been assessed for
significant effects, and has been found to fall under the CRP Programmatic Environmental
Assessment and Supplement PEA. The project will have no significant individual or cumulative
effects on the environment as documented on the CRP's NEPA checklist, and is consequently
covered under the CRP Programmatic Environmental Assessment and FONSI.
Shoreys Brook Dam Removal Project, ME
The NOAA Restoration Center in partnership with American Rivets will provide funding to the
Great Works Land Trust to undertake the construction phase to remove the Shorey Brook Dam
located on Shorey Brook in South Berwick, Maine. The project will result in the actual removal
of the Shorey Brook dam, providing unobstructed fish passage and to restore other riverine
aquatic functions and values for approximately 4.3 miles of main stem river until the next
obstruction. The project has undertaken the full breadth of environmental compliance. The
project development, monitoring, management and construction have been assessed for
significant effects, and have been found to fall under the CRP Programmatic Environmental
Assessment and Supplement PEA. The project will have no significant individual or cumulative
effects on the environment as documented on the CRP's NEPA checklist, and is consequently
covered under the CRP Programmatic Environmental Assessment and FONSI.

Lassister's Mill was placed on the State Study List, a preliminary step in the review of a potential nomination to
the National Register of Historic Places, in 2004. However, as detailed in your letter and shown in the
accompanying photographs, the mill was destroyed during a storm in March 2011. Although the mill dam
remains intact, the site is no longer eligible for listing in the National Register. Accordingly, the proposed
project will have no flea on historic properties.

FOR SHORT-TERM USE BY CONSTRUCTION VEHCLB OR HEAVY EQUIPMENT.
2 PURPOSE
TO PROVIDE A M W FOR CONSTRUCTION VMCLB TO CROSS STREAMS OR WANE OURSB
WITHOUT MOVING SEDIMENT INTO STREAMS, DAMAGING THE STRFAMBED OR CHANNEL, OR
CAUSING FLOODING.
3. CONDITIONS WHERE PRACTICE APPLIES:
WHERE HEAVY EQUIPMENT MUST HE MOVED FROM ONE SIDE OF A STREAM CHANNEL TO
ANOTHER, OR WHERE LGHTGMY CONSTRUCTION VEHICLES MUST CROSS THE STREAM
CHANNEL FREQUENTLY FOR A SHORT PERIOD OF TIME.
4. DESIGN CRITERIA:
A. THE ANTICIPATED LFE OF A TEMPORARY STREAM CROSSING STRUCTURE S USUALLY
CONSIDERED TO BE I YEAR OR LESS REMOVE THE STRUCTURE IMMEDIATELY AFTER IT 6 NO
LONGER NEEDED.
B. DBGN STRUCTURE TO PASS BANKFULL ROW OR PEAK FLOW WITHOUT OVERIOPPING.
ENSURE THAT NO EROSION WILL RESULT.
C. ENSURE THAT DESIGN ROW VELOCITY AT THE OWLET OF THE CROSSING STRUCTURE 6
NOWEROSNE FOR THE RECEIVING STREAM CHANNEL.
D. PROVIDE PROTECTED OVERFLOW AREA.

A. KEEP CLEARING AND EXCAVATION OF ME STREAM BANKS AND BED AND APPROACH
SECTIONS TO A MINIMUM.
B. DIVERT ALL SURFACE WATER FROM THE CONSTRUCTION SITE ONTO UNDISTURBED AREAS
ADJOINING THE SCREAM
C. KEEP STREAM CROSSINGS AR RIGHT ANGLES TO THE STREAM FLOW.
D. ALIGN ROAD APPROACHES WITH THE CENTER LINE OF THE CROSSING FOR A MINIMUM
DISTANCE OF 30 FEE RAGE BRIDGE ABUTMENTS AND CULVERT FILLS A MINIMUM OF I FOOT
ABOVE ME ADJONNG APPROACH SECTIONS TO PREVENT EROSION FROM SURFACE
RUNOFF AND TO ALLOW ROOD ROWS TO PASS AROUND THE STRUCTURE
E. STABILIZE ALL DISTURBED AREAS SUBJECT TO FLOWING WATER, INC LUDNG PUNNED
