E Director October 19, 2012 Mr. Steve Ward Harnett County Department of Public Utilities Post Office Box 1 1 19 Lillington, NC 27546 Subject Property: Brightwater Medical Complex UT to Neills Creek [030607, 18- 16- (0.7), WSIV] APPROVAL OF MODIFIED STORMWATER MANAGEMENT PLAN Dear Mr. Ward: Dee Freeman Secretary DWQ Project # 10-0251v3 Harnett County On February 3, 2011, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to impact 0.35 acre of 404 Wetlands and 219 linear feet of perennial stream in order to construct the Brightwater Medical Complex in Harnett County. Condition 6 of this certification requires that this project adhere to 401 Stormwater Management Requirements. On September 19, 2012, the DWQ received a Stormwater management plan (dated September 19, 2012) for the addition of the Brightwater Skilled Nursing Complex (Lot 4R) on the Brightwater Medical Complex campus. The DWQ approves the SMP as satisfying Condition 6 of the General Water Quality Certification. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new SMP. This approval requires you to follow the conditions listed in the General Water Quality Certification for the project and the following additional conditions listed below. 1. The SMP approved by the DWQ consists of the two wet detention ponds and all associated Stormwater conveyances, inlet and outlet strictures, and the grading and drainage patterns depicted on the approved plan sheets. The maximum allowable drainage areas and built upon areas shall be as per the table below. Built -upon area (BUA) includes, but is not limited to, roofed structures, asphalt, concrete, gravel, brick, slate, coquina and parking areas, but does not include raised, uncovered open slat decking or the water surface of swimming pools. If this project phase is modified such that it exceeds the maximum drainage area or built -upon area, then the applicant shall be required to submit and receive approval for a revised stormwater management plan by the DWQ. 3. The footprint of all stormwater management devices as well as an additional ten (10) foot wide area on all sides of the devices shall be located in either public rights -of- way, dedicated common areas or recorded easement areas. The final plats for the project showing all such rights -of -way, common areas and easement areas shall be in accordance with the approved plans. 4. The wet detention ponds shall be equipped with a hardened emergency spillway per Chapter 10 of the North Carolina Stormwater BMP Manual. 5. Maintenance activities for the BMPs shall be performed in accordance with the notarized O &M agreements signed by Mr. Hunter Smith (Vice Chairman Manage, Harnett Health Investors, LLC) on June 7, 2012. The O &M agreement must transfer with the sale of the land or transfer of ownership /responsibility for the BMP facility. The DWQ must be notified promptly of every transfer. 6. The applicant and /or authorized agent shall provide a completed Certificate of Completion form to the DWQ within thirty (30) days of project completion (available at htto://portal.ncdenr.org/web/wa/swp/ws/401 /certsandpermits /apply /forms).
