The Division has deterrnined that the subject discharge quaiifies for such coverage. Therefore, the Division is hereby issuing the subject Certifcate of Coverage under the state-NPDES general permit no. NCG550000 which shail void NPDES Perrnit NC0055727. This Certificate of Coverage is issued pursuant to the requirernents of North Carolina and the US Environmental Protection Agency Memorandum of Agreement dated December 6, 1983 and as suhsequently amended. if any parts, measurement frequencies or sampling requirernents contained in this general perrnit are unacceptable to you, you have the right to submit an individuM perrnit application, associated processing fee and letter requesting coverage under an individual permit. The only fee you wili be responsible f�r is a renewal fee at the tirne of renewal. The current perrnit expires July 3L 1997. This coverage wili remain valid through the duration of the attached general permit. R.ESPONSIBILITIES Right of Entry The permittee sha11 al)ow the Drector of the Division of Environ- mental Management, the Regior%ai Admtnistrator, and/or their author- ized representatives, upon the presentations of credentials: a. To enter upon the permittee's prernises where an effluent source is ].ocated or in vhich any records are requtred to be kept under the terms and conditions of this permit; and b At reasonabie times to have access to and copy any record required t'o be kept under the terms and conditions of thls perrnit; to inspect any onitoring equipment or monitoring method required in this periiit; and to sample any discharge of poiiutants. Transfer of Owriership or Control This perinit is not transferable. in the event of any change in con- troi or ownership of facilitias fro which the authorzed discharge emanates or is conternplated1 the permlttee shall notify the prospcL- tive ovner or controiler by Ietter of the existtnce of this petmit and of the need to obtain a ermit in the nante of the prospective ovner. A copy of the letter ha1i be forwarded to the Division of Environnentai Manageiient. Permit Modification After notice and opportunity for a hearing pursuant to NCGS 14 (b)(2) and NCGS 143-215.1(e) respective1y, this permit ay be mo fied, suspended, or revoked in whoie or in part during its ten cause including, but not iimited to the foliowing: PART 11 Viollation of any terirs or conditions of thls prm11; b. Civi1 and Criminai Liability Except as provided in pen1t conditioris on 'Bypassing" (Part 11. A-4) and "Pc,wer Failures (Part 11, A-6), nothing in this periit shall be coristrued to re]ieve the permittee frou civil or criminal penalties for noncotpiiance pursuant to NCCS 143-215.6 or Section 309 of the Federai. Act, 33 USC 1319. Froperty Rights The issuance 0! this permit does not convey any property rights in either real or personal praperty1 or any exclusive privileges, nor does it authorire any injury to private property or any invasion of personal rights, nor any infringewent of Federal, State, or iocai laws or reguiations. 6. Severability The provisons af this peruit are severable, and 1! any provision this perinit, or the applicati.on of any provision of this penult to any circunstance, is heid invaiid, the application ef such provision to other circuinstances, and the remainder of this penult shall not be affected thereby. 7. Expiration of Pertnit Perittee is not authorized to discharge after the expiration date. In order to receive authorization to discharge beyond the expiration date, the perittee shall sub1t such irforaation, forn,s, and fees as are requi!ed by the agency authorized to issue permlts no iater than 180 days prior to the expiration date. The per1ttee shall properly connect to an operatlona1 pubiicly- owned wastevater collection •ystem vithin 180 days of its availability to the site. D. Disposa] Alternatives The Permittee shall continually evaivate all wastewater disposai alternatives and pursue the most environrnentally sound alternative of the iasonab1y cost effective ahernathes. If the facility is in substantial non-compiiance with the terms and conditions of the NPDES perrnit or governing rules, reguiations, or laws, the perrnittee shall submit a report in such forrn and detail as required by the Division evaluating these alternatives and a plan of action within sixty (60) days of notificauon by the Division.
