Reference is made to your request for rescission of the subject NPDES Permit. Staff
of the Mooresvil!e Regional 0ffice have confirrned that your faciiity is now attached to the
City of Beirnont sewer systern and this NPDES permit 15 no longer required. Therefore,
in accordance with your request. NPDES General Perrnit No. NCG5502 19 is rescinded,
effective inimediateiy.
If in the future you wish to again discharge wasewater to the State's surface waters,
you must tirst apply for and receive a new NPDES Perrnit. Discharging without a valid
NPDES Permit wili subject the discharger to a civil penalty ofup to SIO,000 per day.

The Division of Environmental Management has recently evaluated ali existng individual perrnits for potential
coverage under general permits currently issued by the Division. 15A N.C.A.C. 2H .0127 allow.s the Division to
evaluate groups of permits having similar discharge activities for coverage under general permits and issue coverage
where the Division finds control of the discharges more appropriate in this rrunner. The Division has deterrnined
that the subject discharge quaiifies for such coverage. Therefore, the Division is hereby issuing the subject
Certifcate of Coverage under the state-NPDES general permit no. NCG550000 which shail void NPDES Perrnit
NC0055727. This Certificate of Coverage is issued pursuant to the requirernents of North Carolina and the US
Environmental Protection Agency Memorandum of Agreement dated December 6, 1983 and as suhsequently amended.
if any parts, measurement frequencies or sampling requirernents contained in this general perrnit are unacceptable to
you, you have the right to submit an individuM perrnit application, associated processing fee and letter requesting
coverage under an individual permit. Unless such de:rnand is made, this decision shafl be final and binding. Please

subject the Permit -tee to an enforcement action by the Division af Environrnentai Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C, Please note that the general perrnit does require
rnonitc ring in accordance with federal Iaw, The monitoring data is not required to be submitted to the Division
unless specifically requested, however, the permittee is required to rnaintain all records for a periocl of at least three
(3) years.

The issuance of this Certificate of Coverage is an administrative action initiated by the Division of
Environmentai Management anci therefore, no fees are due at thls time. in accordance with current rules, there
are no annuai adrninistrative and compliance monitoring fes for coverage under geneiai permits. The only fee
you wili be responsible f�r is a renewal fee at the tirne of renewal. The current perrnit expires July 3L 1997.
This coverage wili remain valid through the duration of the attached general permit. The Division will be
responsible for the reissuance of the general permit and at such tirne, you will he notified of the procedures to
follow to continue coverage under the reissued permit. Urtless you fail to follow the procedures for conhnued
coverage, you will continue to be perrnitted to discharge in accordance with the attached general permit.
The issuance of this Certificate of Coverage does not predude the Permittee from complyLng with any and all
statutes, rules, reguiations, or ordinances which may he required by the Division of Environrnental Managernent
or permits required by the Division of Land Resources, the Coastal Area Management Act or any Federal or Local
other govemmental perrnit that rnay be required.

thirty (30) days foliowing receipt of this letter. This request must be in the form of a written
petition, conforrning to Chapter 150B of the North Carolina General Statutes, and filed with the

identified in this perTult more frequently than or at a ].evel in
excess af that authorized sha].1 constitute a violation of the
pertnit. Azy anticipated faciiity expansions, production increases,
or process modjfjcatlons vhich will result in oew1 different, or
increased discharges of pollutants un.ist be reported by subnission
of a new NPDES application or if such changes wi].i not vo1ate the
effluent 11.mitations specified in this pennit, by notice to the DEM

6. Power FaLlures
In order to utaintair. cop11ance vith the effluent iimitations and
prohibitiofls of thts perm.tt, the pertnittee shall either:
a. Frovide an alternative power source Nufficient to operate
the waste'ater control facilittes;
or, if such a]ternative power Bource is not in existence,
b. Ha1t, reduce or otherwise control production and/or all dis-
charges frc wastewater control tacilities upon the reduction,
loss, or failure of the primary source of power to said waste-
water control facilities.
R.ESPONSIBILITIES
Right of Entry
The permittee sha11 al)ow the Drector of the Division of Environ-
mental Management, the Regior%ai Admtnistrator, and/or their author-
ized representatives, upon the presentations of credentials:
a. To enter upon the permittee's prernises where an effluent
source is ].ocated or in vhich any records are requtred to
be kept under the terms and conditions of this permit; and
b At reasonabie times to have access to and copy any record
required t'o be kept under the terms and conditions of thls
perrnit; to inspect any onitoring equipment or monitoring
method required in this periiit; and to sample any discharge
of poiiutants.
Transfer of Owriership or Control
This perinit is not transferable. in the event of any change in con-
troi or ownership of facilitias fro which the authorzed discharge
emanates or is conternplated1 the permlttee shall notify the prospcL-
tive ovner or controiler by Ietter of the existtnce of this petmit
and of the need to obtain a ermit in the nante of the prospective
ovner. A copy of the letter ha1i be forwarded to the Division of
Environnentai Manageiient.
Permit Modification
After notice and opportunity for a hearing pursuant to NCGS 14
(b)(2) and NCGS 143-215.1(e) respective1y, this permit ay be mo
fied, suspended, or revoked in whoie or in part during its ten
cause including, but not iimited to the foliowing:

Viollation of any terirs or conditions of thls prm11;
b. Obtaining this penult by isrepresentat1on or failure to
disclose fully all relevant fact8; or
c. A change in any condition that requires either a temporary
or penu.anent reduction or elimination 0! the authorized
discharge.
4. Civi1 and Criminai Liability
Except as provided in pen1t conditioris on 'Bypassing" (Part 11.
A-4) and "Pc,wer Failures (Part 11, A-6), nothing in this periit
shall be coristrued to re]ieve the permittee frou civil or criminal
penalties for noncotpiiance pursuant to NCCS 143-215.6 or Section
309 of the Federai. Act, 33 USC 1319.
Froperty Rights
The issuance 0! this permit does not convey any property rights in
either real or personal praperty1 or any exclusive privileges, nor
does it authorire any injury to private property or any invasion of
personal rights, nor any infringewent of Federal, State, or iocai
laws or reguiations.
6. Severability
The provisons af this peruit are severable, and 1! any provision
this perinit, or the applicati.on of any provision of this penult to
any circunstance, is heid invaiid, the application ef such provision
to other circuinstances, and the remainder of this penult shall not
be affected thereby.
7. Expiration of Pertnit
Perittee is not authorized to discharge after the expiration date.
In order to receive authorization to discharge beyond the expiration
date, the perittee shall sub1t such irforaation, forn,s, and fees
as are requi!ed by the agency authorized to issue permlts no iater
than 180 days prior to the expiration date. Ary discharge without
* peruit after the expiration wili subject the permittee to enforce-
ment procedures as provided in NCGS i43-2156 and 33 USC 1251 et seq.

CONSTRUCTION
No construction of wasteater treatnient facilities or sdditioru thereto
shall be begun untll Finai ?lans and Specifications have been eubniitted
to the Division of Environutental Manaement and written epprova]. and
Authorization to Constructhavebeen issued. If no objections to Final
Plans and Specifications have been niade by the DEJI after 30 days 1 ollow-
ing receipt of the plans or issuance of this pel It, whichever is iatter,
the plans niay be considered approved and construction authorized.
C. SPECLAL CONDITIONS
The Pennittee shall be responsible for the fo11cwing iteis regard-
ing the maintenance of the treatent systen:

at ieast yearly to detertnine if solids need to be reuoved
or other niaintenance perforued.

approved location within 24 hours, or otherwise disposed of
at a location and in a manner approved by the State or loca]
agency.
2. The per1ttee shall properly connect to an operatlona1 pubiicly-
owned wastevater collection •ystem vithin 180 days of its availability
to the site.
D. Disposa] Alternatives
The Permittee shall continually evaivate all wastewater disposai alternatives and pursue
the most environrnentally sound alternative of the iasonab1y cost effective
ahernathes. If the facility is in substantial non-compiiance with the terms and
conditions of the NPDES perrnit or governing rules, reguiations, or laws, the
perrnittee shall submit a report in such forrn and detail as required by the Division
evaluating these alternatives and a plan of action within sixty (60) days of notificauon
by the Division.
