Staft of the Groundwater Section - Permits & Compliance Unit have confirmed that this Permit is no longer required. Therefore, in accordance with your request, NPDES Permit No. NC0085197 is rescinded, effective immediately. If in the future you wish to again discharge wastewater to the State's surface waters, you must first apply for and receive a new NPDES Permit. Operating a wastewater facility without a valid NPDESPermit will subject the responsible party to a civil penalty of up to $10,000 per day. Box 37 Re4e County Cliffside, North Carolina 28024 Dear Ms. Sailors: 1996 On March 4, 1996 the Division of Environmental Management issued NPDES Permit No. NC0085197 to Petroleum World, Inc. for their Seller's Texaco site, A review of the permit file has indicated that an error was inadvertently made in the permit. Accordingly, we are forwarding herewith modifications to the subject permit to correct the error. This permit modification is to the effluent page. The modification corrects the effluent benzene limit in the discharge to an unnamed tributary to the Catawba Riber. This unnamed tributary is classified as WS-IV & B CA, therefore the corrected benzene limit is 1.19 ppb in accordance with 15A NCAC 2B .0200. Please find enclosed an amended effluent page which should be inserted into your permit. The old page should be discarded. All other terms and conditions contained in the original permit remain unchanged and in full effect. These permit modifications are issued pursuant to the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency. If any parts, measurement frequencies or sampling requirements contained in this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447, Unless such demand is made, this decision shall be final and binding. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored 21'month at the effluent by grab sample.
