Reference is made to your request for rescission of the subject NPDES Pernut. Staff
of the Mooresville Regional ©fflce have canfinned that this NPDES pernit is no longer
required. Therefore, in accordance with your request„ NPDES General Permit No.
NCG55O128 is rescinded, effective immediately.
If in the future you wish to again discharge wastewater to the State°s surface waters,
you must first apply for and receive a new NPDES Permit. Discharging without a vaiid
NPDES Permit will subject the discharger to a civil penalty of up to S 1O,00© per day.

The Division of Environmental Management has recently evaluated all existing individual permits for potential
coverage under general permits currently issued by the Division. 15A N.C.A,C. 2H .0127 allows the Division to
evaluate groups of permits having similar discharge activities for coverage under general permits and issue coverage
where the Division finds control of the discharges more appropriate in this manner. The Division has deterrnined
that the subject discharge qualifies for such coverage. Therefore, the Division is hereby issuing the subject
Certificate of Coverage under the state4'41'DES general permit no NCG550000 which shall void NPDES Permit
NC0046108. This Certificate of Coverage is issued pursuant to the requirements of North Carolina and the US
Environmental Protection Agency Memorandum of Agreement dated December 6, 1983 and as subsequently amended,
If any parts, measurement frequencies or sampling requirements contained in this general permit are unacceptable to
you, you have the right to submit an individual permit application, associated processing fee and letter requesting
coverage under an individual permit. Unless such demand is made, this decision shall be final and binding. Please
take notice this Certificate of Coverage is not transferable. Part 11, E.4. addresses the requirements to be followed in
case of change of ownership or control of this discharge.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee skill take immediate corrective action, including those as may be required by this Division, such as the
construction of additional or replacement wastewater treatment or disposal facilities, Construction of any
wastewater treatment facilities will require issuance of an Authorization to Construct from this Division.
Failure to abide by the requirements contained in this Certificate of Coverage and respective general permit may
subject the ?errnittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C. Please note that the general permit does require
monitoring in accordance with federal law. The monitoring data is not required to he submitted to the Division
unless specifically requested, however, the permittee is required to maintain all records for a period of at least three
(3) years.

The issuance of this Certificate of Coverage is an adrninistrative action initiated by the Division of
Environmental Managernent and therefore, no fees are due at this ti me. In accordance with current rules, there
are no annual administiative and compiance monitoring fees for coverage under general perrnits. The only fee
you wil] be responsible for is a renewal fee at the time of renewal. The current permit expires July 31, 1997.
This coverage will remain valid through the duration of the attached general permit. The Division will be
resportsible for the reissuance of the general permit and at such time, you will be notified of the procedures to
follow to continue coverage under the reissued permit. Uriiess you fail to follow the procedures for continued
coverage, yoi. wili continue to be permitted to discharge in accordance with the attached general perrnit.
The issuance of this Certificate of Coverage does not predude the Permittee from compiying with anv and all
statutes, rules, regulations, or ordinances which may be requirecl by the Division of Environrnental Managernent

a. The inonthly average, other than for fecal coiiforui bacteria, is
the aritlunetic mean of all the composite sarnples coilected th a
one -month period. The monthiy average for fecai coiiform bacteria
is the geometric mean of sampies collected in a one -month period.
b. The see11y average. other than for fecai colitorm bacteria, Is the
arithinetic tnean of all the composlte samples coiiected during a
one -week period. The weekly average for fecal coliform bacteria
is the geometric mean of sainples coilected iri a one -week period.
c. Flow, M3/day (MGD): The fiov limit expressed iri this permit is the
24-hour average fiow, averaged monthly. It is determined as the
arithjnetic inean of the total. daily fiows recorded during the calendar
rnonth.
d. Arithmetic Mean: The arithinetic inean of any set of vaiues is the
sumnaton of the individuai values divided by the number of indi-
vidual values.
Ceometric Mean: The geometric mean of any set of values is the Nth
root of the product of the individual values where N is equal to the
nuinber of individual values. The geometric mean is equivalent to
the antilog of the ari thrnetic rnean ef the logarlthms of the indi-
viduai values. For purposes ef caiculating the geometrlc mean,
vaiues of zero (0) shall be considered to be one (1).

PATT 11
A. MANAGEMENT REQUIREMENTS
Change iri Discharge
Ali discharges authorized herein shali be consistent with the ternis
and conditions of this permit. The discharge of any poiiutant
identified iri this perulit more frequently than or at a level In
excess of that authorized shall constitute a violation af the
perulit. Any anticipated faciiity expansions, production increases,
or process modifications whlch will result in new, different, or
increased discharges of poilutants rnust be reported by submission
of a ne NPDES application or, if such changes will not violate the
effiuent limitations specified in this permit, by rtotice to the DEM
of such changes. Foliowing such notice, the perrnit may be modified
to specify and iixnit any poiiutants not previousiy iirnited.
2 Faciiities Operation
The permittee shail at all times maintain itt good working order and
operate as efficientiy as p058ib1e ali treatment or control facili-
ties or systems instailed or used by the perniittee to achieve corn
pliance with tbe terms and conditions of this pennit
Adverse Impact
The perrnittee :shall take all reasonabie steps to rninimize any adverse
irnpact to navigabie waters resulting from noncornpiiance with my
effluent iimitations specified in this permit1 including such accei
erated or additionai monitoring as necessary to determine the nature
and impact of the noncompiying discharge.
4 Bypassing
Any diversion from or bypass of faciities necessary to tnaintain com
piiance with the terms and conditions of this perinit is prohibited.

property damage, or (11) where excessive stortn drainage or runoff
would damage any facilities necessary for compliance with the
effiuent ilniltations and prohibitions of this perrnit. The pertnitte

Reinoved Substances
Soiids, siudges, filter backwash or other poiiutants rernoved in the
course of treatrnent or controi of wastewaters shali be disposed of itt
a manner such as to prevent any poiiutant from such materiai from
entering waters of the State or riavigabie waters of the United
States.

in order to maintar compiiance with the effluent limitations und
prohibltions of this petmit, the perrnittee shall either:
a. rovide an alternative power source sufficierit to operaie
the wastewater control facilities;
or, If such alternative power source is not in existence,
b. Halt, reduce, or otherwise controi production and/or ali dis-
charges frorn wastewater control faclllties upon the reduction,
ioss, or failure of the priniary source of power to said waste-
water cantroi faci1ities
RESPONSIBILITIES
Right of Entry
The permittee shail al]ow the Director of the Division of Environ-
mental Managernent, the Regioriai Administrator, and/or their auhor-
ized represerttatives, upon the presentations of credentials:
a, To enter upon the perinittee's premises where an effluent
source is iocated or In which any records are required to
be kept under the terms and conditlons of this permit; and
b. itt reasonabie tiines to have access to and copy any records
required to be kept under the terms and conditions of this
permit; to inspect any monitoring equipuient or monitoring
method required in this perrnit; and to sarnple any discharge
of poliutants.
2. Transfer of Owne
p or Control
This permit is not transferabie. In the event of any change in cnn-
troi or ownership of faciiitles from which the authorized discharge
emanates or is contemplated, the permittee shail notify the proSpcc-
tive owner or controiier by ietter of the existence of thls permit
and of the need to obtain a permit in the name of the prospective
owner, A copy of the ietter shall be forwarded to the Division of
Environrnental Management.
Permit Modification
After notice and opportunity for a hearing pursuant to NCGS 143-215.1
(b)(2) and NCGS 143-215.1(e) respectivei, this perrnit may be modi-
fied, suspended, or revoked in whole or in part during its terrn for
cause lnciuding, but not limited to, the foliowing:

a. Violation of any terms or conditions af
b. obtalning this permit by misrepresentation or failure to
dlsclose fully ali relevant facts; or
c. A cliange In any condition that requlres either a temporary
or permanent reduci:lon or elirninatior of the authorized
discharge.
4. Civii and Criminal Liabiiity
Except as provided in permit conditions on "Bypassing" (Part 11.
A-4) and 'tPower Failures (Part I1 A-6), nothing in this permit
shall be construed to relieve the pertnittee frotn clv11 or criminai
penaities for noncornpiiance pursuant to NCGS 143-215.6 or Section
309 of the Federal Act, 33 USC 1319,
Property Rights
The. issuance of this pernhlt does not convey ariy property rights in
either real or personal property, or any exciusive privileges, nor
does it authorize any injury to private property or any nvasion of
personal rights, nor any infringement of Federal, State, or locai
laws or reguiations.
6. Severability
The provislons of this pennit are severable, and if any provision oJ
this permit, or the appiication of any provision of this pernit to
any circurnstance, is heid invalid, the appiication of such provision
to other circumstances, and the remainder af this perinit shail not
be affected thereby.
Expiratlon of Permit
Permittee is not authorized to discharge after the expiration date.
In order to receive authorization to discharge beyond the expiration
date, the perrnittee shail submit such, inforrna tion, forms, and fees
as are required by the agency authorized to issue pertnits no later
than 180 days prior to the expiratlon date. Any discharge without
a perndt after the expiration will subject the pennittee to enforce-
ment procedures as provided in NCGS 143-215.6 and 33 USC 1251 et seq..

PART 111
A. PREVIOUS PERNITS
All previous State water quaiity permits lssued 10 this faciiity,
whether Lor construction or operation, or discharge, are liereby
rcvoked by issuance of th1 permit. The conditions, requiremeuts,
terms, arid provislons of this permit authorlzirig d1schare under thc
National Poilutant Dlscharge E1iinat1on Systein govern discharges
from this facllity.
B. CONSTRUCTION
No construction of wastewater treatrnent facjiitics or additions thcreto
shail be begun until Final Plaris and Specifcations have been submitted
10 the Division of Environmental Management and writter approval arid
Authorization to Construct have been issued. If no objections to Final
Plans and Specifications have been made ky the DEM after 30 days fo11ow-
ing receipt af the plans or issuance of this permit, whichever Is lacter,
the plans may be considered approved and constructiori authorized.
C. SPECIAL CONDITIONS
The Perniittee shall be responsible for the foliowing

a. Septic tanks shall be maintained at ali tirnes to prevent.
seepage of sewage or effluents to the surface of the ground.
b. Septic tanks need routine rnaintenance and should be checked
at least yearly to decermine if solids need 10 be removed
er other rnaintenance performed.
Contents removed from septic tanks shali be discharged into
an approved sewer system, buried or plowed under at an
approved iocation w1thn 24 hours, or otherwise disposed of
at a location and in a manner approved by the State or local
agency.
2. The perrnittee shail properly connect to an operational pubiiciy-
owned wastewater coiiection system within 180 days of 1ts availability
to the site.
