Dear Ms. Merritt:
With this letter Restoration Systems is submitting the fifth year (2012) monitoring reports for Lane
Island Bank Parcel and Wellons Farm Bank Parcel approved by DWQ in 2008 and authorized under
the RS Neuse River Basin Riparian Buffer and Nutrient Mitigation Umbrella Banking Instrument ( #08
510, March 17, 2008). These reports indicate that both Sites are exceeding the requirements stipulated
within the banking instrument. In accordance with the NC DWQ both parcels have been transferred to
the North Carolina Wildlife Habitat Fund for permanent holding.
According to the credit release schedule within the above referenced mitigation banking instrument,
and contingent upon a DWQ Site review, the Lane Island and Wellons Farm Bank Parcels are entitled
to the release of the remaining 15% of generated credits from each parcel. With this letter Restoration
Systems formally requests the release of these credits.

EXECUTIVE SUMMARY
Restoration Systems, LLC (Restoration Systems) has completed riparian buffer restoration at the
Lane Island Mitigation Bank Parcel (hereafter referred to as the "Bank Parcel ") to intercept and
treat agricultural runoff, which conveys pesticides, fertilizers, and animal wastes to local surface
waters. The Bank Parcel is located approximately 6 miles west of Goldsboro, in Wayne County.
This portion of Wayne County is located within the Neuse River Basin in United States
Geological Survey Hydrologic Unit 03020201 (North Carolina Division of Water Quality
subbasin 03- 04 -12). The Bank Parcel consists of 53 acres immediately adjacent to unnamed
tributaries to the Neuse River, which will be used for both nutrient offsets and buffer impact
credit generation.
Prior to restoration, Bank Parcel land use was characterized by row crop agriculture and cleared
of native forest vegetation. Bank Parcel reforestation, consisting of native hardwood species,
was implemented within the entire 53 -acre Bank Parcel, extending up to 200 feet from the top of
stream banks. The primary goals of this buffer restoration and nutrient offset project focused on
reforestation with native species to 1) improve water quality by intercepting and retaining
nitrogen, phosphorus, sediments, and fecal coliform conveyed by runoff from the upstream
watershed.; 2) eliminate agricultural production and fertilization within riparian areas; 3) reduce
sedimentation/siltation; 4) increase channel bank stability; 5) filter and reduce pollutants prior to
entering the Neuse River; 6) serve as a wildlife corridor by providing connectivity to forested
areas adjacent to the Bank Parcel; 7) provide increased habitat for aquatic and terrestrial wildlife;
8) restore shade to open waters of the Bank Parcel; and 9) prevent the potential utility of the
Bank Parcel as animal waste spray fields.
Overall, vegetation densities were above the required 320 stems per acre with an average of 949
tree stems per acre in the Fifth Monitoring Year (Year 2012). In addition, only one plot (Plot 9)
was below success criteria, with 283 stems per acre (only one stem short in Plot 9). In line with
Section IV of the Riparian Buffer and Nutrient Mitigation Umbrella Banking Instrument (signed
by Restoration Systems and the North Carolina Division of Water Quality [NCDWQ] in March
2008) all mitigation activities have successfully been met based on monitoring requirements.
Additionally, Restoration Systems has transferred the Bank Parcel Conservation Easement to the
North Carolina Wildlife Habit Foundation (Appendix C). At this time with the transferred
easement and successful five years of monitoring, Restoration Systems requests to accept the
final release of generated credits.

1.0 INTRODUCTION
Restoration Systems, LLC (Restoration Systems) has completed riparian buffer restoration at the
Lane Island Mitigation Bank Parcel (hereafter referred to as the "Bank Parcel ") to intercept and
treat agricultural runoff, which conveys pesticides, fertilizers, and animal wastes to local surface
waters. The Bank Parcel is located approximately 6 miles west of Goldsboro, in Wayne County
(Figure 1). This portion of Wayne County is located within the Neuse River Basin in United
States Geological Survey Hydrologic Unit 03020201 (North Carolina Division of Water Quality
subbasin 03- 04 -12).
Prior to restoration, Bank Parcel land use was characterized by row crop agriculture cleared of

As constructed, the Bank Parcel provides 53 acres of riparian buffer restoration immediately
adjacent to unnamed tributaries to the Neuse River, which will be used for both nutrient offsets
and buffer impact credit generation. A Bank Parcel Development Package and Riparian Buffer
and Nutrient Mitigation Umbrella Banking Instrument were completed for the Bank Parcel in
March 2008. The plan outlined methods designed to reforest the entire 53 -acre Bank Parcel with
native species. Carolina Silvics planted the Site during February 2008. An additional 500 stems of
persimmon (Diospyros virginiana) were planted within the Site in late 2008 /early 2009 due to
seedling mortality noted during first year monitoring (2008). Seedling mortality resulted from
drought conditions that immediately followed Site planting and continued throughout most of the
2008 monitoring season. Additional stems were planted in the vicinity of vegetation plots 8 and 9
on December 3, 2010; additional planting and vegetation success were subsequently approved
during a Site visit with NCDWQ representative Lia Gilleski on December 15, 2010.
This monitoring report outlines the fifth year of consecutive successful vegetation. The methods
implemented and monitored have resulted in the successful restoration of 53 acres of riparian
buffer.

2.0 VEGETATION MONITORING PROGRAM
Monitoring procedures for vegetation were designed in accordance with Section IV of the
Riparian Buffer and Nutrient Mitigation Umbrella Banking Instrument (signed by Restoration
Systems and the North Carolina Division of Water Quality [NCDWQ] in March 2008). Outlined
in Part 3 of the Lane Island Bank Parcel Development Package monitoring of restoration efforts
were performed for five consecutive years.
Monitoring of vegetation occurred within twenty -seven sample plots, installed shortly after
planting to equally represent the Bank Parcel (Figure 2). Each plot measures 10- meters by 10-
meters (0.0247 acre). The vegetation parameters monitored in each plot included species
composition and species density. During the first year, vegetation received visual evaluations on a
periodic basis to ascertain the degree of overtopping of planted species by nuisance species.
Subsequently, quantitative sampling, of vegetation was performed during the fall of each
monitoring year for five consecutive years.
2.1 Vegetation Success Criteria
Success criteria were established to quantify the density and growth of "Character Tree Species."
Character Tree Species include planted species, those observed in forest stands near the Bank
Parcel, and those listed in appropriate community descriptions from Classification of the Natural
Communities of North Carolina (Schafale and Weakley 1990). "Characteristic Tree Species"
include, but are not limited to species listed in Table 1.

Vegetation success criteria for the Bank Parcel consist of an overall density of at least 320 stems
per acre five years after initial planting. Additional seedlings were expected to sprout from
adjacent forested community seed sources and were also counted in the overall success rate for the
Bank Parcel provided they are native hardwood tree or Character Tree Species.
No quantitative sampling requirements were proposed for herb assemblages as part of the
vegetation success criteria. Development of floodplain forests over several decades will dictate
the success in recruitment and establishment of desired understory and groundcover populations.
Coverage of herbaceous species was documented through annual photographs. Photographs of the
vegetation plots for year five monitoring are included as Appendix A.
2.0.2 Vegetation Sampling Results and Comparison to Success Criteria
Quantitative sampling of year five vegetation monitoring was conducted in late September 2012.
Results are provided in Table 2. Fifth year vegetation success criteria of 320 stems per acre was
exceeded for the 2012 annual monitoring year with an average density of 949 stems per acre.
Additionally, each individual plot met success criteria with the exception of Plot (9), which was
one stem shy of making success criteria. Supplemental planting which last occurred in December
of 2010 in the area of vegetation plots 8 and 9 continues to do well through the Year 5 (2012)
monitoring season. The success of year 5 monitoring marks five consecutive years of successful
vegetative development based upon the guidelines outlined above. Table 3 summarizes the
vegetation monitoring over the past five years.

3.0 CONCLUSIONS
As a whole, vegetation density across the Bank Parcel were above the required 320 stems per acre
with an average of 949 tree stems per acre in the fifth monitoring year (Yr. 2012). In addition,
each individual plot met success criteria with the exception of Plot (9), which was one stem under
success criteria. Supplemental planting which last occurred in December of 2010 in the area of
vegetation plots 8 and 9 continues to do well through the year 5 (2012) monitoring season. Table 3
summarizes vegetation plot results for the Bank Parcel throughout the five year monitoring period.
The large increase in average tree stems per acre between monitoring year 1 and monitoring years
2 -5 was due to the increase of natural successional recruits particularly that of red maple (Acer
rubrum), sweetgum (Liquidambar styraciflua), and black gum / swamp tupelo (Nyssa sp.). Higher
natural seedling recruits occurred near existing natural seed sources, within and around monitoring
plots 11, 20, and 26. Seedlings of these species overall are very small in size averaging 0.5 -1 feet
in height, and are of no concern to the regeneration of a native hardwood forest community.
Likewise, concerns over the increase in Baccharis halimifolia (eastern baccharis) recruits outlined
by the NCDWQ in response to the year 4 monitoring should not affect regeneration of a native
hardwood forest. Baccharis is a native successional understory species, its presence is consistent
with the Bank Parcel's primary goals of improving water quality through intercepting and
retaining nitrogen, phosphorus, sediments, and fecal coliform conveyed by runoff from the
upstream watershed during the early development succession. In addition, a strong native
understory provides increased habitat for terrestrial wildlife while limiting the ability of invasive
understory species such as Ligustrum to establish within the Bank Parcel. Lastly, planted
hardwood saplings are continuing to thrive in areas with strong baccharis recruitment (plots 3, 4,
& 5). It is likely that once a hardwood canopy is established baccharis numbers will slowly recess
as the understory becomes heavily shaded.
With overall densities of planted trees and shrubs well -above the fifth year requirement of 320
stems per acre and all other restoration activities successfully met, Restoration Systems is prepared
to accept the final release of generated credits. Restoration Systems is prepared for an on -site
review by the NCDWQ. In addition, Restoration Systems is aware that final the Bank Parcel
"closeout" will not occur until the credit ledger reads `0' available credits.

and NORTH CAROLINA WILDLIFE HABITAT FOUNDATION, a North Carolina non-
profit corporation, whose mailing address is P. O. Box 29187, Greensboro, North Carolina
27429 -9187, ("NCWHF ").
WITNESSETH THAT:
WHEREAS, Lane Farms, Inc., a North Carolina corporation, heretofore executed and
delivered to RS a Deed of Easement upon certain lands therein described, dated March 26, 2009,
and recorded in Book 2690, Page 641 -646, in the office of the Register of Deeds of Wayne
County, North Carolina; and
and
WHEREAS, RS has agreed to transfer and assign said Deed of Easement to NCWHF;
WHEREAS, NCWHF has agreed to accept such transfer and assignment.
NOW, THEREFORE, RS, as aforesaid, in consideration of One Dollar ($1.00), has
assigned, bargained and sold and does hereby assign, bargain, sell and convey unto NCWHF, its
successors and assigns, all right, title and interest of RS in and to said Deed of Easement and in

and to the lands therein described and conveyed, together with all rights and powers therein
given to RS except as specifically set forth herein. Said Deed of Easement is incorporated herein
by reference as if set out herein in fill.
TO HAVE AND TO HOLD the same to it, NCWHF, its successors and assigns, in the
same manner and to the same extent as RS now holds the same.
NCWHF hereby acluiowledges receipt of the Deed of Easement and accepts it on the
terms and conditions contained therein.
NCWHF acluiowledges that RS reserved unto itself a right of entry to the property
described in the Deed of Easement sufficient for RS to perform enhancement and restoration to
riparian resources and such activities described in the Deed of Easement and all other obligations
of RS as set forth therein.
IN TESTIMONY WHEREOF, the parties hereto have caused this instrument to be
executed on their behalves on the day and year first above written.
