Director Subject: NPDES Permit Rescission NC0079871 Dixie Yams, Inc Gaston County The Division of Environmental Management has received your correspondence dated December 8, 1992 requesting recission of the subject NPDES perrnit. We have also received information from the Mooresville Regional Office which confirms that the subject facility no longer discharges to the surface waters of the state. Therefore, NPDES Peinnit number NC0079871 is rescinded, effective immediately. Application fees are non-refundable according to North Carolina Administrative Code 15A NCAC 2H .0105 (b)(1). If in the future, you detemilne that you wish to operate a wastewater discharge system, you must first apply for and receive a new NPDES Perrnit. Discharging wastewater without a valid NPDES Permit will subject the discharger to a civil penalty of up to $10,000 per day. The plant is completely shut down and there are no discharges to any streams. Therefore, we request that the application for a NPDES Permit be cancelled and if there is any refund on the $400 processing fee, please forward to Dixie Yarns.
