The two large, currently developed parcels west of the multifamily lots will be cleared and remain undeveloped to serve as septic fields for the project. The septic fields are outside of all riparian buffers. Current conditions of the property include impacts within all zones of the riparian buffer and lakeside of the 760 contour. As part of the proposed redevelopment of the property, we will remove a large portion of the existing buffer impacts and restore the buffers back to a natural state. Any proposed impacts were deemed unavoidable due to the physical limits of the site and will be mitigated. 2. Provide a description of how diffuse flow will be maintained through the protected riparian buffers (e.g., re- planting vegetation or enhancement of existing vegetation, gutter splash pads, level spreader to control of runoff from impervious surfaces, etc.).* Our proposed development will include the removal of majority of the existing impervious area within the riparian buffer. The buffer will be re-established with grass and vegetation improvements. The site storm drainage plan will provide for surface drainage off roofs and impervious surfaces via splash pads and shallow grassed swales to enhance buffer treatment of runoff to the lake. 2. Demonstration of Need for a Variance The variance provision of the riparian buffer rules allows the Division or the Environrrental Mtenagerrent Commission to grant a variance w hen there are practical difficulties or unnecessary hardships that prevent compliance with the strict letter of riparian buffer protection. 1. Explain how complying with the provisions of the applicable rule would prevent you from securing a reasonable return from or make reasonable use of your property. Merely proving that the variance would permit a greater profit from the property shall not be considered adequate justification for a variance. The Division will consider whether the variance is the minimum possible deviation from the terms of the applicable Buffer Rule that shall make reasonable use of the property possible.* This site currently has a significant amount of buffer impacts both in Zone 1 & 2, as well as lakeside of the 760 contour. In our preliminary design, we are removing a large portion of those impacts from the buffers except those that are absolutely unavoidable due to the geometry of the site, including the existing Ranger Island Marine Road and a retaining wall. Based on the geometry of the property and access requirements to the island, including for emergency services, the access rive, in both its existing conditions and the proposed extension, is unavoidable to realize a reasonable re -development program. The project proposes a significant reduction in the current impacts to the buffers. 2. Explain how the hardship results from application of the Buffer Rule to the property rather from other factors such as deed restrictions or other hardships (e.g. zoning setbacks, floodplains, etc).* As further discussed in section 5 below, it is the geometry of the site that contributes to the need of a variance, not the setbacks or floodplain. 3. Explain whether the hardship was caused by the applicant knowingly or unknowingly violating the applicable Buffer Rule.* The applicant is knowingly applying for this variance in order to redevelop an existing site that would otherwise be undevelopable. Overall, the applicant is proposing to remove a significant amount of existing impervious area from the buffers and believes that the proposed design is a significant improvement to existing buffer conditions and a reasonable redevelopment program that provides for significant avoidance and minimization efforts. 4. Explain how the hardship results from physical nature of the property, such as its size, shape, or topography, which is different form that of neighboring property. * The dimensions of the property and associated footprint of the buffers requires the variance request for a reasonable redevelopment program while providing for a reduction to the current buffer impacts. 5. Explain how the hardship is rare or unique to the applicant's property, rather than the result of conditions that are widespread.* The dimension constraints of the island portion of the property is unique, as well as the significant historical impact to the buffers that will be reduced to the greatest extent practical. I.
