Please accept this response to the NOVs listed above on behalf of KDHWWTP,LLC.Please note that the
management agreement between KDHWWTP LLC and Atlantic OBX was executed on 10/09/2021.
NOV-2021-LM-0014: Total Nitrogen and Phosphorus reduction is beyond the capability of the plant during this
reporting period. The plant modifications to a 5 stage Bardenpho Process were not completed at time of reporting.
PH frequency violation,March 28 was a Saturday.PH was recorded correctly March 23-27 and again on March 30-
31.
NOV-2021-LV-0139: Total Nitrogen and Phosphorus reduction is beyond the capability of the plant during this
reporting period. The plant modifications to a 5 stage Bardenpho Process were not completed at time of reporting.
NOV-2021-LM-0015: Total Nitrogen and Phosphorus reduction is beyond the capability of the plant during this
reporting period. The plant modifications to a 5 stage Bardenpho Process were not completed at time of reporting.
Total flow,Turbidity and PH was not recorded by the previous Operator/Management company.PH results were not
reported by us until a new PH meter was ordered as the previous Operator/Management company took the meter
from KDHWWTP stock.
Please consider the information provided when assessing whether a civil penalty will be issued.
