The North Carolina Department of Transportation (NCDOT) proposes to improve a 15 -mile
portion of existing US 221 from north of SR 1366 (Roper Loop Road) to SR 1153 (Goose Creels
Road) (TIP R -2597) and a 4 -mile portion of US 221 from SR 1153 (Goose Creels Road) to
US 221 -NC 226 (TIP R- 0204D &E) in Rutherford and McDowell Counties. The proposed
improvements consist of widening US 221 from a two -lane roadv, -ay to a four -lane divided
roadN -,-ay and some realignment to straighten curves on US 221 between Thermal City and
Glenwood and near I -40.
Jurisdictional resources (wetlands, streams, and other -,eaters) on the subject project (present
,within 25 feet of the slope - stake line) ��ere field - verified on September 27 and October 1 2012 at
the project location. Prior to specific site review on September 27, Ms. Beck with asked whether
all "NRPW "- designated intermittent channels listed in the Aquatic Upload Spreadsheet should be
changed to "RPW" and Mr. Darling confirmed that because OHWM was applicable in all cases
here that change Nvould be made. Ms. Beck with confirmed that, for Rapanos purposes, W8, W8a,
and W46a (nevv) are the only "adjacent" wetlands, all others are "abutting'.
Thirteen locations were reviewed by the United States Army Corps of Engineers ( USACE, for
jurisdiction and potential mitigation requirement) and the North Carolina Department of
Environment and Natural Resources (NCDENR) Division of Water Quality (DWQ, for
intermittent/perennial status) on September 27 with adjustments agreed as follows:
S4: no change (ephemeral)
S5: no change
S16a: no change
S22b: DWQ requested change to perennial due to biology, USACE concurred

Field review concluded at 3:00 pm on September 27 and scheduled for continuation of DWQ
verification October 1 at 9:00 am. Eleven locations were reviewed by DWQ, for intermittent/
perennial status on October 1 with adjustments agreed as follows:
S53b: DWQ requested change to perennial due to biology
S57b: no change to channel classification; new wetland (W57b) delineated adjacent to
channel
S62a: DWQ requested change to perennial due to biology
S63a: no change
S63b: no change
S65a: DWQ requested change to ephemeral from pond outlet to half way down channel;
intermittent from there to pipe inlet; perennial due to biology on west side of US 221.
S69d: no change
S72aa: DWQ requested change to perennial due to biology
S76b: DWQ requested change to perennial due to biology at Flag "S76c"
S78b: DWQ requested change to perennial due to biology
The USACE and DWQ agreed that, with all the modifications listed above, the jurisdictional
verification was complete and written confirmation would be forthcoming. If any meeting
