3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application:
The property is located in a residential subdivision with a single family home and
backyard. A drainage stream runs through the back of the property and ultimately
drains to Crabtree Creek. This property is for residential use only and was built in
1998- we purchased in August 2020. It sits in a well -established residential
neighborhood off single-family homes.

4. Proposed Activity
Provide a detailed description of the proposed activity including its purpose and include the type of equipment to be used:*
Our residence has a walk -out basement and a multi -level deck along the entire
length of the (back of the) house. We would like to install a stone patio on the
ground level and in roughly the same footprint as the current deck. The bottom
deck will be removed and replaced by patio, and the patio will extend the width of
the house and connect to (new) lighted stairs leading up the hill to the driveway. A
gas grill will be built on the patio, and both lighting and electricity will be run to
various points (we will apply for permits).
Our existing screened porch and lower deck both encroach on the 50' riparian
buffer, but are clear of the 30' buffer to the stream. We are asking for authorization
to remove the lower deck and replace with stone patio, as well as to extend the patio
under the entire footprint of the screened porch (today the screened porch
encroaches over the 50' buffer by about 4 feet).
The current square footage of deck encroachment into the 50' buffer is
approximately 267 ft.
The proposed square footage of the patio encroachment into the 50' buffer is
approximately 321 ft.
We will keep the existing concrete slab (for hot tub) that also encroaches in the 50'
buffer- patio will be built around the hot tub area. This is included in the above
encroachment figures.
We will be installing a NEW retaining wall flush with the back wall of the house to
protect the existing structure and prevent any land erosion near our air conditioner
units.
Lastly, we would like to build a stone wood -burning fireplace within the 50' buffer
(but outside the 30' buffer). Location is indicated on the drawings of our project.

Comments:
The current buffer impact of existing structures is 267 square feet. This plan
increases the buffer impact to 321 square feet, or a total increase of only 54 square
feet. I was not sure whether to note the entire 321 square feet of buffer impact
(post -project) or just use the difference in what exists today and what is planned.
Both are noted here.
D. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project.*
There will be very little interference in the riparian buffer itself. The only activities
that will be happening in Zone 2 are
1) removing existing wooden deck (above ground)
2) installing a stone patio in the same footprint and
3) building a new stone fireplace
Because most of the grassy area of our yard is outside the 50' buffer, most of the
equipment for cutting the stone can take place on the grass outside the buffer.
Minimal carpentry is needed beyond the initial deck removal, and that will happen in
roughly two days' time so it does not affect the area for a long period of time.
We have placed the vast majority of the patio outside of the 50' buffer to minimize
the amount of impact, and the only place that we will be building the stone patio is
under decks that already encroach. We believe that the riparian buffer was put in
after the home and decks were built.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.*
Equipment such as stone cutting equipment will be primarily on the grassy part of
the property that is outside of the zone 2 buffer. Since the stream curves to the
back of the property line, there is a large amount of the backyard area outside the
buffers and we will be utilizing those for the equipment except where it is absolutely
necessary to have something near the building site.
Our contractor has completed a similar project (installing stone patio and stairs) 4
houses away and is familiar with the riparian buffer rules, as well as how to minimize
machinery placement and utilization within Zone 2.

Our home's back deck and screened porch already encroach in Zone 2 of the
riparian buffer. The home must have been built before the buffer was created. our
current encroachment into Zone 2 is 267 square feet, and the proposed plan
encroaches by 321 square feet. This project increases our encroachment by 54
square feet.

There are existing downspout collectors buried in the backyard that empty into the
stream in the buffer and noted on the project plan. We are just planning to leave
those in place for existing drainage.

This document confirms that the Emily Crawford and Chad Cygan (Applicant) for the
Crawford/Cygan Backyard Patio (Project) has expressed an interest to utilize 482.00 Square Feet of
Riparian Buffer Mitigation Credits from one or both of the following banks, EBX-Neuse I, LLC Neuse
Riparian Buffer Umbrella Mitigation Bank or EBX Upper Neuse Riparian Buffer Umbrella Mitigation
Bank. Specific bank sites that will be debited will either be Buffalo Branch, Bucher, Selma Mill, Cedar
Grove, Ezell, Polecat, Stone Creek, Hannah Bridge, Meadow Spring, Poplar Creek, Uzzle and/or Hatley,
all located in HUC 03020201. As the official Bank Sponsor, EBX-Neuse I, LLC and EBX, attests to the
fact that mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.

Crawford/Cygan Backyard Patio
Our backyard patio project will not create concentrated stormwater flow through the riparian
buffer on our property. The downspouts from the house are routed under the backyard and go
straight to the stream in the back of the yard. Additionally, we will not be changing the pitch of
the backyard- it already slopes away from the property and toward the stream, and the patio
will be installed at ground level at the same pitch.
Zone 1 of the riparian buffer in our backyard is wooded/covered in natural plants- none of that
will be touched or altered in this project. Additionally, most of Zone 2 is natural plant coverage
on top of stones that move drainage down the yard toward the stream. This is all pre-exisiting
and does not change with this project.
There are natural swale areas that were probably designed decades ago when the home was
built, and all of this directs water toward the stream.
