King Street Boone, NC 28607 Re: Section 401 Water Quality Certification application Dear Mr. Young: On August 15, 2012, the North Carolina Division of Water Quality (Division) received a copy of your application for a 401 General Water Quality Certification install a fill in streams and wetlands for the Town of Boone Water System Improvements in Boone, NC in Watauga County. Additional information is required in order that we may determine your project's compliance with 15A NCAC 2H.0500. The Division will require this information in order to process your application to impact protected wetlands and/or streams on the subject properties. Therefore, we will place this project on hold as incomplete until we receive this additional information, and if we do not receive the additional information requested below, we will return your application as incomplete. Please provide the following information so that we may continue to review your project. 1. Please provide a list of any parcels of land which the Town of Boone does not currently own or have easements on at this time. 2. Please provide a table of impacts for all stream and wetland impact areas that matches the impact area identifiers with the identifiers used in the stream determination documentation. Please also ensure that the engineering plans call out impact areas using these identifiers. It is difficult to review this large project with multiple nomenclatures and/or impact areas without identifiers on the plans. 3. Please provide detailed plan sheets, at a readable scale, of all impact areas that clearly identifies the exact location of all temporary impacts and permanent impacts using shading/hatching etc. The "call outs" on the existing plan sheets do not clearly show the exact location of impacts, installation of dewatering measures, sediment and erosion control measures etc. 4. Please provide detailed plan sheets at a readable scale that clearly shows all sediment and erosion control measures in/near jurisdictional areas. All sediment and erosion control measures proposed within jurisdictional areas must be shown as temporary or permanent impacts on the 401 application documents. 5. At culvert P -1 a proposed riffle grade control appears to be a riprap energy dissipater apron. Please clarify the justification for this measure. If this measure is being provided as a grade control structure only, please provide reference information/justification to indicate that long riffles of this design are appropriate for this stream. 7. At culvert P -1, please provide a design for a floodplain bench above and below the floodplain culvert. A floodplain bench will be required to ensure that the stream channel is of natural width and depth upstream and downstream of this double barrel culvert. 8. Please provide clarification of the dewatering technique for Meadow Creek. If a pump around will be utilized, please provide discussion/justification for aquatic passage during construction. If a temporary channel will be constructed, please provide a detail for the temporary channel. 9. On Page G2.5 and Page G2.6, permanent wetland impacts are identified for culvert installations. Please clarify if there will be any temporary wetland impacts in these areas to facilitate culvert installation and/or to address sediment and erosion control requirements. Please modify all plans and impact tables appropriately if temporary impacts are proposed. 10. On Page G2.6 and G2.7, please clarify the need for road "stubs" at regular intervals along this access road. Please also clarify the need for temporary impacts to wetlands and streams for these "stub" areas. 11. On Page G2.7, please explain the need for temporary impacts to 80 linear feet of stream. It appears this area may be impacted from roadway shoulder construction. Please provide avoidance and minimization justification (headwalls, adjustments to the road alignment, etc). 12. On Page G3.3, please clearly identify the exact location of all temporary impacts and permanent impacts. Please also indicate all temporary impacts from sediment and erosion control measures that will be required. 13. For the culvert on Page G3.3, please clarify whether a pump around will be utilized as the dewatering technique for this culvert. 14. For the culvert on Page G3.3, please provide a design for a floodplain bench above and below the culvert. A floodplain bench will be required to ensure that the stream channel is of natural width and depth upstream and downstream of this culvert. 15. For the culvert on Page G3.3, please explain the need for specified length of temporary impacts upstream and downstream of the culvert. 16. If this measure is being provided as a grade control structure only, please provide reference information/justification to indicate that long riffles of this design are appropriate for this stream. 17. On Page G4.1, a detail is provided for Stream Bed Control. It appears that this detail is proposed for all temporarily impacted streams. The Division requires that all temporarily impacted streams be restored to natural conditions to the maximum extent practical. To that end, for small streams with low flow it is the Divisions experience that riprap bed control is unnecessary. Please provide justification based on size of the stream, slope of the stream, and/or predicted stream flow velocities for all areas that are to be restored using the detail provided on Page G4.1. Please provide a natural channel detail with vegetation and/or erosion control matting on the streambanks for all other stream impact areas. C. Division of Water Quality, Wetlands /401 Certification Unit, 1650 Mail Service Center, Raleigh, NC 27699 -1650. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will return this application as incomplete. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the Division.
