Dear Mr. Trone,
The following includes responses to the additional information request received February 17,
2021 from the N.C. Division of Water Resources:
• In a letter sent to the Division dated February 2, 2021 you indicated the Hebron Road
Extension is neither scheduled nor funded and that a 70’ right-of-way proposed under this
project is necessary for the future possibility the extension is constructed. Additionally, you
have indicated all site improvements at the crossing depicted in the plans submitted are
necessary in order to support the driveway for the high school only. This Office believes
the proposed 136’ culverts, outlet protection, fill, and other associated activities
with this crossing also accommodate the extra width of the 70’ right-of-way being
reserved for future Hebron Road Extension. If this Office has interpreted your
response incorrectly, please provide additional details, including site plans that
more clearly depict the proposed crossing [15A NCAC 02H .0506(b)(1)].
The Hebron Road Extension is not included in the City-County of Durham Capital Improvement
Plan. It is not funded nor planned. Reference to the Hebron Road Extension, is not included or
referenced in the final Construction Drawings for this project.
The 70-foot wide right-of-way is a City of Durham requirement for the school entrance as well as
the NC Department of Transportation (NCDOT) for the proposed high school entrance and is
necessary to safely accommodate traffic and sidewalks for pedestrians and bikers that will utilize
this entrance. The entrance road is classified as a minor thoroughfare by the City of Durham. As
such the City of Durham requires a 70-foot right-of-way with 3 travel lanes (turn-lane,
storage/car-pool lanes, bike lanes and sidewalks on both sides. (i.e. the width of the impact is
determined by the Authority Having Jurisdiction-AHJ).
Furthermore, the NCDOT requirements from the district engineer listed in their review of the
Traffic Impact Analysis for the project, “in order to safely accommodate traffic at the proposed
school, the Wellington Site Drive shall be constructed with one ingress lane and three egress
lanes. The egress lanes shall consist of one exclusive left-turn lane with 150 feet of storage (i.e.

car-pool), a shared left- through lane, and an exclusive right-turn lane with 250 feet of storage
(i.e., car-pool). The egress shall also contain 100 feet of Internal Protected Storage (IPS) before
any parking or crossing maneuvers.” A copy of the June 17, 2020 TIA Review Comments from
NCDOT is included for your reference.
• Please provide detailed engineering plans, profile view, and cross-section of the proposed
culvert for Stream SE. Please include details regarding stream alignment in relation to pipe
alignment, pipe slope, pipe burial, and dissipator pad. The Division previously requested this
information but believes it was not provided. Your response dated February 2, 2021
indicated this information was provided on Sheets C-7 and C-8, however those sheets
appear to address the two 136’ box culverts at Impact Area #1 (Stream SD) and the 63’ box
culvert at Impact Area #2.
The detailed engineering plans, profile view and cross-section of proposed culvert SE is attached.
Buffer impact amounts have been updated and a revised impact table is also included.
• Mitigation is required for losses of equal to or greater than 300 linear feet of perennial
stream. Please provide a mitigation plan that conforms to the requirements of 15A NCAC
02H .0506(c). Furthermore, buffer mitigation is required for some of the proposed buffer
impacts. Please submit a mitigation plan detailing the amount of buffer impact for Zone 1
and/or Zone 2 and how the impact will be mitigated. [15A NCAC 02B .0714].
Statement of Availability Letters have been received from private mitigation banks and are
included as part of this submittal.

SUBJECT: Traffic Impact Analysis for Northern Durham High School - Addendum
Dear Mr. Reinke:
The NCDOT has completed its review of the updated Traffic Impact Analysis for Northern Durham
High School sealed on April 9, 2020. In order to accommodate the site-generated traffic safely and
efficiently, while also attempting to protect the functional integrity and operational capacity of the
adjacent roadway facilities, the below noted improvements and/or restrictions are required.
US 501 at Argonne Drive/Site Drive 1
• Install channelized southbound/northbound left turn lanes on US 501.
• Install a left-over traffic signal that will coordinate with the signals at Site Drive 2 and at
Seven Oaks Road
• Site Drive shall be constructed as a limited movement intersection with one ingress lane
and one egress lane. The egress lane shall consist of 100 feet Internal Protected Storage
(IPS) before any parking or crossing maneuvers and consist of one right turn lane.
• Argonne Drive will be restricted to a right-turn lane only.
• Advisory note: The proposed driveway is subject to meeting NCDOT sight distance
requirements.

Re Project: Northern High School Replacement Project
This document confirms that Durham Public Schools (Applicant) for the Northern High School
Replacement Project (Project) has expressed an interest to utilize 72,190.50 Square Feet of Riparian
Buffer Mitigation Credits from the EBX sponsored Upper Neuse Riparian Buffer Umbrella Mitigation
Bank or EBX-Neuse I, LLC sponsored Bucher Mitigation Bank. The specific bank site to be debited will
either be Cedar Grove, Hatley or Bucher all located in HUC 03020201 and in the Falls Lake watershed.
As the official Bank Sponsor, EBX and EBX-Neuse I, LLC, attests to the fact that mitigation is available
for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
