Box 3266, �Kitty Hawk, NC 27949 (252) 261-7707 fax (252) 261-2965 October 8, 2012 Amy Adams NC Division of Water Quality 943 Washington Square Mall Washington, NC 27889 01 Thie Town of Duck, Dare County Dear Mrs. Adams, This correspondence is in response to your letter dated September 1 3 ), 20112 for an application to impact 0.37 acres (16.120 square feet) of Section "404"jurisdictional wetlands associated with the construction of three commercial building and parking located at 124,0 Duck Road adjJacent to the Currituck Sound in the Town of Duck, Dare County, North Carolina, In an atterript to avoid and minimize impacts to the wetlands we have elevated the proposed commercial builds and reduced the wetland impacts to 0.37 acres (25% reduction). Allis Holdings is also proposing to collect roof runoff in several cisterns around the proposed buildings arid use as irrigation onsite. In addition the remaining C� wetlands will be put into a conservation easement so, no future improvements will impact the wetlands. The proposed parking area will remain in its Current location to provide direct access to NC 12. The preliminary storinwater design has been done by Bissell Profe-sional Group and a formal submittal will be submitted to the Division of Water Quality for there review an approval after we have received the 401 certification and US, Army Corp of Engineers permits. Atlantic Environmental has performed a"404" wetland delineation and we have met with the US Army Corp of Engineers onsite for confirmation but have not received any documentation to submit at this time. When we receive the Jurisdictional Determination we will f'orward that information to You.
