Zan,
On February 19, 2021, the Division of Water Resources (Division) received your application requesting a 401 Water
Quality Certification from the Division for the subject project. The Division has determined that your application is
incomplete and cannot be processed. The application is on -hold until all of the following information is received:
1. The Division and the North Carolina Wildlife Resources Commission are concerned about impacts to the Eastern
Hellbender [Cryptobranchus alleghaniensis, US Federal Species of Concern (FSC), NC Special Concern (sC)], which
are present in the vicinity of the project, from potential impacts associated with the proposed bedrock removal.
The concerns relate to the potential for tracked equipment to enter the stream to perform the bedrock removal,
the percussive impact from the rock hammer required to remove the bedrock, and the potential turbidity
created from the bedrock removal. Is this aspect of the project necessary to achieve the project purpose? And, if
so, what measures will be implemented to avoid impacts to the noted species as well as potential turbidity
impacts from the rock hammering? [15A NCAC 02H .0506 (b)(1) and (2)]
Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the
proper consideration of the application. Please provide your response by March 25, 2021. If all of the requested
information is not received, the Division will be unable to approve the application and it will be denied as incomplete.
The denial of this project will necessitate reapplication to the Division for approval, including a complete application
package and the appropriate fee.
