This lift would be positioned to provide a minimum of two feet of water at MLW at the creek -side end per the attached sketches. Since 1994 we have kept a 21' Sunbird Odyssey boat in the water, either at 636 Bayshore (1994- 1999), or at 640 Bayshore (2000 — present). An 18' center console fishing boat has also been moored at 640 Bayshore periodically. The pier and dock at 640 Bayshore were built under Permit #26399 in 2000. During this time period we have repainted the bottom of the Sunbird boat at least 13 times with anti- fouling paint, mainly ablative cuprous oxide coatings. This practice has four clearly deleterious effects: 1. These coatings are toxic to marine life. 2. They are not'ali that effective, especially on the hull portions which sink into the creek bottom at low tide. Manual hull scraping is needed on a frequent basis. 3. The coatings are very expensive, approximately $500.00 per job at today's prices. 4. Keeping the boat in the water fulltime tends to trap silt along the face of the floating dock and is contributing to the shoaling of the adjacent navigable channel. The development of Marsh Oaks subdivision in the last 12 years has accelerated shoaling of Page's Creek due to inadequate erosion control measures taken in that area. That problem continues to this day. Adding a boatlift at 640 Bayshore would help permit freer movement of tidal flow in Marshy Branch Canal and would likely lessen accretion of silt deposits in the immediate vicinity. The benefits of stopping annual coatings which are toxic to marine life are obvious. Ending the annual expense is also a plus for us personally, but it is the least important factor for us because it will take many years to recoup the cost of the boatlift. We can see no downside to this project, other than the personal expense involved. We intend to have John King build this lift for us. We know from prior dealings with him that he is very respectful of the marine environment, is exceptionally skilled at marine construction, and is scrupulously honest. The project entails hydro - jetting four treated wooden pilings set in a square pattern 12 feet apart from each other immediately adjacent to the east end of the existing 40' floating dock, as per attached sketches. Kenneth and Carol Morris, Page 2 9. PROJECT DESCRIPTION: The project site is located at 640 Bayshore Drive, adjacent to Pages Creek, Middle Sound, in New Hanover County. To locate the property from the Wilmington Regional Office (WiRO) turn right onto Market Street (NC Highwayl7) and travel north approximately 3 miles until you reach the entrance to Bayshore Estates Subdivision, which will be located on the right. Turn right and travel east on Bayshore Drive for approximately 0.75 miles until Bayshore Drive turns to the left. Continue to head northeast onto Bayshore Drive approximately 0.8 miles until you reach the property of interest, which will be located on the right. The existing highground development includes a single - family residence, which borders the confluence of Bridgers Creek Canal and Marshy Branch Canal, within Pages Creek, in Middle Sound. Upland vegetation consists of ornamental shrubbery, lawn grass and hardwood species such as Live Oak. The lot is approximately 0.6 acres in size and averages approximately 9' above normal high water (NHW). The approximately 115' of shoreline frontage is stabilized by vegetation consisting of Coastal and §404 Wetlands, averaging approximately 20' in width consisting of Marsh Elder (Iva frutescens), Grounsel -bush (Baccharus halimifolia), Wax Myrtle (Myrica cerifera L.), Salt Meadow Grass (Spartina patens), Black Needle Rush (Juncus roemarianus) and Spike Grass (Distichlis spicata). Waterward of this area of high marsh and §404 Wetlands, the vegetation transitions to low marsh in an area approximately 15' in width, consisting primarily of Smooth Cordgrass (Spartina altemiflora). There is an existing ditch outfall located on the northern property line. The applicant currently maintains a private docking facility, which was authorized through CAMA General Permit No. 26399 on 07/17/2000. Extending in an easterly direction from the highground towards Pages Creek is an existing uncovered deck, which measures approximately 16' in length by 10' in width. An access pier, measuring approximately 21' in length by 5' in width extends from the platform towards Pages Creek, which is elevated over the existing wetlands. An access ramp then leads onto an existing floating dock, measuring approximately 36' in length by 8' in width, which runs parallel to the shoreline and channel. The existing docking facility currently accommodates two (2) vessels. The application states that existing water depths at this location of the docking facility ranges from approximately -0.6' to -1.1'@ normal low water (NLW) (See Sheets 1 through 3 of 3). The Wilmington /New Hanover County Land Use Plan 2006 Update classifies adjacent waters and high ground area of project site as Conservation. The waters of Pages Creek are classified SA by the Division of Water Quality. They are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CONDITIONALLY CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to install a new boatlift at an existing docking facility in Pages Creek. The boatlift, measuring 12' in length by 12' in width, would be located on the northern side of the existing floating dock. The application states the water depth at this location would range from approximately -0.6' to -1.1'@ NLW. The application also states that the waterward end of the proposed boatlift at the location of where the stern of the boat would be located; the water depth is approximately —2.0'@ NLW. Further, the application states that the proposed boatlift would be equipped with an automatic electronic stop, which would prevent the cradle of the boatlift from contact with the substrate. The height of the cradle would result in a minimum of —3' @ NLW under the propeller location at the earliest possibility of launching the vessel. The proposed boatlift would accommodate one (1) additional vessel for a total of three (3) vessels at this location (See Sheets 1 through 3 of 3 and Project Narrative). ANTICIPATED IMPACTS: The boatlift would incorporate approximately 144 sq. ft. of Estuarine Waters and Public Trust Area, which would allow the facility to provide docking space for up to three (3) vessels. The waterward end of the proposed boatlift at the location of where the stem of the boat would be located; the existing water depth is approximately —2.0'@ NLW. The proposed structures would extend approximately 19' into a waterbody, which measures approximately 93' across. This distance would conform to both the % width distance rule and the established pier head alignment. Based on the application, the proposed structures would not encroach into the adjacent 15 foot riparian corridor setback requirement or the channel of Marshy Branch Canal.
